Administrative Court: A driving ban cannot be postponed without legal grounds

The Administrative Court of Kosovo has ruled that the Kosovo Police has no right to set a later start date for a protective measure banning someone from driving if there is no legal basis for doing so.

The ruling was issued on October 30, 2026, in administrative case Ap.nr.337/26, in which the Court partially upheld a lawsuit filed by a citizen identified by the initials L.G. against the Ministry of Internal Affairs, specifically the Kosovo Police and the Decision-Making Commission.

In this case, the plaintiff had been given a six-month driving ban. However, the Police had decided that the measure would take effect on February 6, 2026, after an earlier measure expired. That measure had been in force from August 7, 2025, to February 6, 2026.

According to the Court, setting the period in this way contravenes Article 251, paragraph 1, of the Law on Road Traffic Rules. This provision states that the period of a protective measure banning someone from driving begins on the day it is imposed.

The Court also clarified that only the law can determine the circumstances and procedure for doubling a protective measure or postponing its implementation to another period.
