The defense team of Hashim Thaçi has opposed the position of the Specialist Prosecutor’s Office based in The Hague, according to which the continued detention of the former Kosovo leader constitutes a proportionate measure.

According to Thaçi’s legal representatives, the prosecution’s claim that he may have large sums of money at his disposal and can easily find support is merely an assumption. The defense argues that remaining in detention, his unemployed status, and his withdrawal from the political scene since the end of 2020 have inevitably reduced any kind of support, especially in the face of the high costs of the two judicial proceedings he is currently facing.
Regarding the concern raised by the Specialist Prosecutor’s Office that Thaçi could flee to states beyond the jurisdiction of the Kosovo Specialist Chambers, the defense team considers the proposal to surrender travel documents sufficient – a measure identical to that imposed on other co-accused persons. This, according to them, minimizes any potential risk of flight.
Another key element offered by Hashim Thaçi is a financial guarantee in the amount of 50,000 euros, aimed at further limiting the possibility of flight. The submitted documentation emphasizes that the guarantors of this sum are his brother and individuals from his close circle of friends.
Based on these arguments, the defense reiterates its position by requesting Thaçi’s release under conditions they consider reasonable and appropriate.
