The Supreme Court ruled that the dispute between the commercial companies and the Public Housing Enterprise must be reheard by the court of first instance.

The decision came after the court found the appeals filed by “Made Group Construction” LLC, “Arkos” LLC and “Madekos” LLC to be well-founded, along with those filed by the Public Housing Enterprise JSC (NPB), as the defendant, and the intervening party, the Municipality of Pristina.

The legal dispute concerns the fulfillment of a contract or compensation for material damages, including actual loss and lost profits.

The dispute stems from a co-investment agreement that NPB signed in 2021 with three companies—“Made Kos,” “Made Group” and “Arkos”—which was not carried out.

The Commercial Court had ordered the Public Housing Enterprise to pay the companies €32.5 million in lost profits.

In August, the Public Housing Enterprise announced that its bank accounts had been blocked as part of enforcement proceedings related to the court dispute.
