Diana Kastrati’s murder: Trial in absentia sought for Adnan Jashari

Fifteen years after Diana Kastrati’s murder, the filing of an indictment and a request to try Adnan Jashari in absentia have renewed hopes that the case will be resolved by the justice system.

Diana Kastrati was killed in May 2011 at an intersection in Prishtina after she was shot by her former partner, Adnan Jashari. The Basic Prosecution Office in Prishtina has requested that the proceedings against him take place without the accused present.

The killing occurred 22 days after Diana had sought an emergency protection order from the Municipal Court in Prishtina, saying that she and her daughter had been threatened. Her request was not considered in time, although the law required the court to make a decision within 24 hours.

The indictment states that Jashari shot her twice with a firearm, striking her in the neck at the intersection of Haxhi Zeka and Xheladin Kurbaliu streets in Prishtina.

The court has also issued a public appeal to Adnan Jashari, asking him to surrender and appear before it so that the proceedings can take place in his presence.

“Pursuant to Article 303, paragraph 8, of the Criminal Procedure Code, the court calls on the accused, Adnan Jashari, to surrender and appear before this court as soon as possible so that these criminal proceedings can take place in his presence. The court calls on anyone with information to contact the police to help secure the presence of the accused, Adnan Jashari, in these criminal proceedings.”

Lawyer Ardian Bajraktari described the start of the proceedings as a source of satisfaction for Diana Kastrati’s family and relatives.

He said that although the case has faced numerous delays over the years, the trial offers hope that justice will be served.

“The filing of the indictment and the start of judicial proceedings through a trial in absentia for the murder of the late Diana Kastrati are a source of satisfaction for her family and relatives.

“Although these proceedings have been marked by many delays, there is still hope that justice will have its say, however late it may be,” Bajraktari said.

The lawyer explained that the laws in force allow a trial in absentia for the criminal offense with which the defendant is charged.

“For the criminal offense of aggravated murder, with which the defendant is charged, the law permits a trial in absentia,” he said.

Regarding the possibility of extradition, Bajraktari explained that the procedure depends on the rules of international legal cooperation and the decision of the state where the defendant is located.

“His extradition falls within the scope of international legal cooperation, and whether it takes place depends on the willingness and decision of the state where the defendant is located,” Bajraktari said.
