Government decisions/ New rules for control of companies using cannabis for medical and industrial purposes

A draft decision of the Council of Ministers defines how entities engaged in activities with the cannabis plant for medical and industrial use will be monitored. The implementation of control will be carried out by the National Cannabis Control Agency, in accordance with Law No. 61/2023.

The rules include all stages of the process, starting from the import of seeds and seedlings, continuing with cultivation, harvesting, processing, storage, and transport, up to export and disposal of material.

Inspections will be planned through an annual program drawn up on the basis of risk analysis. However, checks may also be carried out unannounced, especially when there are suspicions of violations. The Agency will be able to monitor companies’ camera systems 24 hours a day, as well as use sensors, drones, and satellite imagery. If a control is obstructed, inspectors will be assisted by the State Police.

Every transfer of material will be entered into the national traceability system. After the harvest is completed, material will not be allowed to move to subsequent stages unless it has been registered and, in cases where required, analyzed. For industrial cannabis, a maximum limit of 0.8% THC has been set. When this percentage is exceeded, the batch is placed in quarantine, while the entity has the right to request retesting within two working days.

If violations are identified, companies will be assigned corrective measures, which must be fulfilled within a maximum deadline of 30 days. A second check will then be carried out. Material under suspicion may be temporarily seized, while confiscation may be ordered by the Minister of Health. Destruction will be carried out only by authorized entities.

Licensed entities may appeal against the measures and have the right to request the protection of their commercial data. Licenses will undergo a reassessment process at least once every three years.

Approved draft laws:

– On determining the content and manner of completing the Volunteerism Register, as well as the rules, deadlines, and procedures for reporting by volunteerism providers to the employment services database.

– On rules related to the organization, functioning, and access to the electronic register of alternative family care.

– On rules and procedures for monitoring the condition of a child placed in alternative family care, as well as for organizing and carrying out monitoring and inspection of this service.

– On determining detailed rules for the control of licensed and permitted activities with the cannabis plant, as well as for the production of its by-products for medical and industrial uses.

– On the Fiscal Council of the Republic of Albania.

This law creates the legal basis for the establishment, organization, functioning, and definition of responsibilities of the Fiscal Council of the Republic of Albania. The Fiscal Council will be an independent public legal entity and will aim to contribute to fiscal discipline, transparency, and sustainability of public finances, in line with European Union requirements and best international practices.

– On additional supervision of credit institutions, insurance companies, and commission companies that are part of financial conglomerates.

– On crypto-asset markets.

This law defines the rules and requirements for offering crypto-assets to the public and for admitting them to trading on a trading platform, as well as the conditions that crypto-asset service providers must meet.
