The previous framework, established by a 2013 decision, will be repealed.

Under a draft decision of the Council of Ministers approved this Wednesday, the Agency for the Treatment of Concessions and Public-Private Partnerships will have three months from the act’s entry into force to prepare standard documents for concessions and PPPs. Once drafted, these documents will be sent to the Public Procurement Agency for publication.

The agency will also be tasked with drafting guidelines and explanatory manuals for the relevant procedures. Their use will be mandatory for every contracting authority or entity involved in conducting concession and public-private partnership procedures.

The draft stipulates that the Agency for the Treatment of Concessions and Public-Private Partnerships will prepare guidelines and explanatory manuals for concession and PPP procedures, which every contracting authority or entity must use when carrying out these activities.

The decision is based on Law No. 88/2025, “On Concessions and Public-Private Partnerships,” and was proposed by the Minister of Economy and Innovation.

Point 4 of the draft provides for the repeal of Decision No. 575, dated July 10, 2013, “On the Approval of Rules for the Evaluation and Award of Concessions/Public-Private Partnerships,” as amended.

The new act will enter into force after publication in the Official Gazette. All central and local institutions will be involved in its implementation.
