The measure was imposed by the General Department’s Criminal Division following a request by the Basic Prosecution in Pristina and a hearing held on the matter.
According to the court, there is a possibility that the defendant could repeat the criminal offense or take steps to carry out the threat of which he is suspected. This risk was assessed as concrete, real and supported by the specific circumstances of the case.
The preliminary proceedings judge granted the request of the Basic Prosecution in Pristina to impose remand custody on the defendant G.G., for whom there is a well-founded suspicion that he committed the criminal offense of “Threatening,” under Article 181, paragraph 2, of the Criminal Code of the Republic of Kosovo.
Following the hearing, the court ordered remand custody for a period of 1 (one) month.
In its reasoning, the court emphasized that this measure was appropriate, as the suspected manner and circumstances in which the offense was committed, the content and intensity of the threats, as well as the defendant’s conduct after the incident, indicate a specific risk that he could repeat the offense or carry out the threat.
The court also assessed that, if released without appropriate preventive measures, the defendant might attempt to contact the injured party, L.M., again, exert further pressure on him through threats or take steps to fulfill the alleged threat.
According to the decision, alternative measures to remand custody would not be sufficient to prevent the repetition of the criminal offense or the commission of the offense with which the defendant is suspected of threatening the injured party. For this reason, at this stage of the proceedings, remand custody was deemed necessary, while none of the other measures provided for under Article 171 of the Criminal Procedure Code of the Republic of Kosovo was considered sufficient to eliminate the concrete risk.
The parties have the right to file an appeal with the Court of Appeals of Kosovo.
