Acting President of Kosovo Albulena Haxhiu has turned to the Constitutional Court to obtain an interpretation regarding the exercise of presidential powers after the end of her six-month term, if the Assembly fails to elect a new president.

The request was submitted on October 5 and confirmed by the President’s Office on October 6, which also marks the deadline for electing the new president.
According to the President’s Office, the Constitutional Court must clarify the manner and authority that will exercise the necessary presidential powers if the six-month mandate of the acting president ends without her successor being elected.
In this situation, the question of who will call the elections also remains unresolved if the acting president’s mandate ends without the election of a new president.
Kadri Kryeziu, a former member of the Constitutional Court, said that this issue has now been referred to that institution for review, and that it must provide the relevant clarification.
“The question has been submitted to the Constitutional Court, which has a duty to clarify the situation; otherwise, there are legal and constitutional gaps in this unprecedented case in the Republic of Kosovo,” he told “Bota sot.”
The importance of this issue is also linked to the constitutional consequences that could arise if the Assembly fails to elect a president. In such a case, the Assembly is dissolved and the country goes to early elections.
