Constitutional Court rejected initiative against linear pension increase

The Constitutional Court of North Macedonia rejected an initiative to examine whether the linear increase in pensions is in line with the Constitution. The initiative was submitted after the North Macedonian government decided to increase pensions uniformly.

According to the Court’s assessment, there is no reason to examine Article 2 of the Law amending the Law on Pension and Disability Insurance. Furthermore, under Article 38 of the Constitutional Court Act, the conditions for rejecting the initiative have been met.

In March, the Constitutional Court suspended proceedings to assess the constitutionality of Article 2 of the 2025 amendments to the Law on Pension and Disability Insurance, closing its review of the linear increase in pensions. According to its announcement, the proposal did not secure a majority of votes, and the act remains part of the legal order.

The proceedings were initiated after the Court assessed that the linear increase provided for in Article 2 could infringe constitutional equality, the right to property and the principle of social security. According to the Court, the measure gives equal treatment to pensioners who have paid different amounts in contributions and could produce disproportionate consequences.
