According to the court’s statement, house arrest is considered sufficient to reduce the risk of a repeat offense, protect the alleged victim and allow the criminal proceedings to proceed normally.
In its reasoning, the court said the conditions for imposing the measure on the defendant, G.B., had been met and that it was sufficient to prevent a repeat offense, protect the alleged victim and ensure the proceedings continue normally.
According to the court, the decision takes into account that the defendant and the alleged victim no longer live together as a family. Berisha will serve his house arrest at a property where she does not live, to prevent direct contact between them.
The police station in Vushtrri has been tasked with enforcing the measure and monitoring compliance. If Berisha fails to comply with the order, police must immediately notify the pretrial judge.
Before the court’s decision, prosecutors had detained the hospital director for 48 hours on suspicion of domestic violence.
The detention was confirmed by Kaltrina Shala, spokesperson for the Basic Prosecution Office in Pristina, who said it had been carried out on the order of the prosecutor on duty.
Shala had said that a person identified by the initials G.B. had been detained for 48 hours on suspicion of committing the criminal offense of domestic violence.
She added that the State Prosecutor was taking the necessary investigative steps to fully clarify the circumstances of the case.
