Avdullah Hoti, an MP from the Democratic League of Kosovo, has announced that he has signed on to the Kosovo Law Institute’s (KLI) legislative initiative to amend and supplement the Criminal Code.

According to Hoti, the initiative seeks to ensure that failure to comply with Constitutional Court decisions carries criminal liability.
“As an MP in the Assembly of Kosovo and a member of the Democratic League of Kosovo, I have signed the legislative initiative to amend and supplement the Criminal Code, launched by the Kosovo Law Institute (KLI), with the aim of ensuring that failure to implement Constitutional Court decisions does not go without criminal liability,” Hoti stated.
He said that the functioning of the rule of law cannot depend on whether institutions are willing to implement Constitutional Court decisions.
“There can be no rule of law under the following standard: the Court rules, and the Government chooses whether or not to implement the decision,” Hoti said.
The initiative also provides for criminalizing the misuse of public funds for electoral gain, to prevent the state budget from being used to influence citizens’ votes.
The LDK MP described the move as a clear warning to any government seeking to circumvent the Constitution.
“This initiative sends a clear message to any government that thinks it can bypass the Constitution. Constitutional Court decisions are not political recommendations. They are a constitutional obligation,” Hoti said.
