Kosovo’s Acting President, Albulena Haxhiu, has addressed the chair of the Kosovo Judicial Council, Rrustem Thaçi, with a request that the resignations of judges from the Serb community, submitted during 2022, be handled without delay.
In the letter obtained by Telegrafi, Haxhiu raises concern over the fact that these cases have still not been processed, recalling that the legislation in force stipulates that, following a judge’s resignation, the KJC proposes to the President that the judge be relieved of office.

“Through this letter, allow me to express my concern over the non-approval of the resignations of judges from the Serb community, submitted in 2022,” Haxhiu’s letter states.
According to her, the review and decision-making on these resignations fall under the KJC’s responsibility, but so far this institution has not taken the necessary steps to complete the relevant procedures.
Haxhiu assesses that keeping these positions in suspended status for such a long time is directly affecting the functioning of the justice system.
“Keeping these positions suspended for such a long period undermines legal certainty, hampers the full functioning of the justice system, and affects the efficiency of the responsible institutions,” the letter emphasizes.
In conclusion, Haxhiu asks the KJC, in accordance with the Constitution and the laws in force, to take the necessary legal actions to guarantee the regular, effective and inclusive functioning of Kosovo’s justice system.
