The document in question concerns the loan agreement with the USA for military equipment.
In the Socialist Party’s request, it was stated that Agron Shehaj forcibly took the physical copy of the document and left with it. Also according to the Socialists, a parliamentary advisor who tried to stop him and retrieve the document fell on the stairs and sustained injuries.
“MP Agron Shehaj, with his repeated violent and aggressive behavior, has endangered the advisor who found herself defenseless against this violent and unacceptable conduct. These behaviors seriously and intolerably violate the safety of Parliament staff during the exercise of their duties. The MP’s behavior of taking the classified document by force and removing it from the chamber constitutes a serious violation of legislation on classified information,” the request stated.
Furthermore, the Socialist Party is requesting that the case be referred to SPAK for potential assessment of several criminal offenses, including misappropriation or illegal acquisition of classified information, forms of illegal appropriation of the document, obstruction of a public official’s duty, and other offenses related to the protection of classified information and national security.
“Also, referring to the provisions of the Criminal Code, articles 139-142, 294-296, 235, to immediately refer the matter to the Prosecution Office, specifically the Special Structure against Corruption and Organized Crime, on suspicions that the citizen Agron Shehaj has committed the criminal offenses of:
(i) misappropriation or illegal acquisition of classified information, given that the document contains information protected by law;
(ii) theft or other forms of illegal appropriation, due to the manner of taking;
(iii) robbery because the document was taken using force or threat against the person possessing it;
(iv) obstruction of a public official’s duty because force was used against a public employee during the exercise of their duty;
(v) the document relates to state secrets, and in this case special provisions for the protection of classified information can also be verified, which foresee more serious criminal offenses, especially when the action undermines national security and the suspected person may have intended to deliver this material to other actors, unidentified by us but who must be investigated by prosecutors,” the request stated.
