What Sentence Could Fatmir Sheholli Face if Found Guilty?

Fatmir Sheholli is expected to appear before the court for the first time on September 7, where he will be informed of the Special Prosecutor’s Office indictment charging him with espionage and blackmail.

The Basic Court in Pristina has announced that the initial hearing will begin at 9:30 a.m. and will be open to the public.

According to lawyer Skënder Musa, the indictment is extensive and contains many details, including matters that may have previously been known to the public but that have now received an institutional resolution in connection with the espionage of Kosovo Albanians in the Republic of Serbia.

“The indictment has been issued; it is quite extensive and has revealed many details that may indeed have been known to the public, but the matters concerning the espionage of Kosovo Albanians in the Republic of Serbia have now been given a state-level resolution,” said Skënder Musa, the lawyer.

The offense of espionage is addressed in Article 124 of the Criminal Code of the Republic of Kosovo.

Paragraph 3 of this article stipulates that any person who joins a foreign intelligence service, collects data for it, or otherwise assists its activities shall be sentenced to at least five years in prison.

This means that, if the court finds him guilty of espionage, Sheholli faces a minimum sentence of five years in prison.

Lawyer Musa describes this as a particularly serious criminal offense, as it is directly linked to state security and Kosovo’s constitutional order.

“It falls under the chapter on serious offenses, the chapter on offenses against the integrity and constitutional order of the Republic of Kosovo, so naturally, light sentences cannot be imposed. Only if the perpetrator of the criminal offense is a cooperating witness for the Special Prosecutor’s Office and discloses other cases, whether involving senior officials or a collaborator working in institutions, the police, the investigative services, the Kosovo Intelligence Agency and sensitive institutions, can the sentence be reduced. Otherwise, these offenses directly threaten Kosovo’s constitutional order and territorial integrity,” lawyer Musa said.

In addition to the espionage charge, Sheholli also faces a charge of blackmail. When the circumstances referred to in paragraph 2 of the relevant provision are present, the Criminal Code provides for a fine and imprisonment of between one and ten years.

This penalty applies, among other circumstances, when the blackmail is carried out by a member of a group, with a weapon or dangerous instrument, or when the act results in an unlawful gain exceeding ten thousand euros.

Regardless of the charges, Fatmir Sheholli continues to be considered innocent at this stage. His criminal liability can be determined only through a court decision.

He was arrested on October 9, 2025, in the Pristina region, following a months-long investigation by Kosovo Police investigators. The operation was carried out on the orders of the Special Prosecutor’s Office and with the assistance of the Kosovo Intelligence Agency, while Sheholli was suspected of espionage.
