Peja, indictment filed for public procurement fraud and document forgery

The Serious Crimes Department of the Basic Prosecution Office in Peja has filed an indictment against R.K. and a legal entity. They are suspected of the criminal offenses of “Abuse and fraud in public procurement” and “Document forgery.”

The indictment states that R.K., as the owner and authorized representative of an economic operator, had participated in a public procurement procedure conducted by the General Hospital in Peja for the supply of protocol books.

During the procedure, he is suspected of submitting and using forged and unauthorized documents. According to the Prosecution’s allegations, the submitted file contained a CV, an employment contract, and a university certificate belonging to another person, which were used without that person’s knowledge or permission.

The prosecution alleges that the documentation was used to influence the contracting authority’s decision-making and secure the contract.

R.K. is also suspected of drafting a forged employment contract with the intention of presenting it as an original document in the public procurement procedure.

The indictment also includes the legal entity, which is suspected of submitting and using false and unauthorized documentation while participating in the procurement procedure. According to the Prosecution, the aim was to influence the contracting authority’s decision and secure the contract.

The Prosecution considers that there is a well-founded suspicion that R.K. committed the criminal offenses of “Abuse and fraud in public procurement” and “Document forgery.” Meanwhile, the legal entity is suspected of the criminal offense of “Abuse and fraud in public procurement.”

The prosecutor handling the case has asked the court to find the defendants guilty and sentence them in accordance with the law for the criminal offenses with which they are charged.

Until their guilt is established by a final court ruling, the defendants are presumed innocent.
