Mushkolaj calls for strong state mobilization in the Appeal phase

University professor Gjyljeta Mushkolaj has commented on the verdict of the Special Court in The Hague, as well as the possible appeal phase.

According to her, the burden of this process should not remain solely with the defense team, but should also involve all state mechanisms.

Mushkolaj emphasized that the appeal is first and foremost the responsibility of the defense, but at the same time it should be treated as a state matter. She called for strong mobilization of all state capacities, with the aim of overturning the verdict on Appeal.

Asked whether the Appeal review could last for years, the professor assessed that this phase of the procedure should be concluded within a shorter period of time.

She stated that, although this is a local court, its composition is entirely international. According to Mushkolaj, such international institutions tend to prolong their activity, since with the continuation of work, payments and other related matters also continue. However, she clarified that this case differs somewhat, due to the existence of the roster of judges, who are paid only for the period during which they are active.

Mushkolaj said she expects the Specialist Chambers to close the appeal procedure stage very quickly as well.

According to her assessment, the process could last about a year, while she called for greater diplomatic pressure to prevent exceeding this deadline.

She stressed that the duration is not related only to the decision itself, but also to the position in which the entire state will find itself until the final decision is issued.

Mushkolaj also mentioned the Specialist Chamber of the Constitutional Court, saying there is room for action in relation to it as well. She recalled the report commissioned by the Ombudsperson and drafted by a segment of the British Bar Association, which had arrived very late and addressed various procedural violations, as well as infringements of the defendants’ rights throughout the entire judicial process.
