Institutional crisis in Kosovo/ EU: Constitutional Court must rule on the Assembly and Government

The European Union has reacted to Sunday’s developments in Kosovo, when the Assembly was constituted and the new Government was voted in, stressing that the interpretation of the legality of these steps falls to the Constitutional Court.

“We are aware of Sunday’s votes, as well as the decisions to constitute the Assembly and form the Government. We are also aware of the request submitted to the Constitutional Court regarding the constitutionality of these decisions. It is for the Constitutional Court to rule on the request that has been submitted,” a spokesperson for the European Commission told Radio Free Europe.

According to the spokesperson, Kosovo needs “fully consolidated institutions to advance reforms and make progress on its path toward EU integration, including within the framework of the Western Balkans Growth Plan.”

The EU also confirmed that it had been informed of the complaint submitted to the Constitutional Court to assess whether the decisions concerning the Assembly and Government comply with the Constitution, reiterating that the decision on this matter belongs to the country’s highest court.

After the constitution of the Assembly and the election of the Government, the PDK turned to the Constitutional Court, requesting that an interim measure be imposed against the new Assembly. The party is seeking for the measure to remain in force until the review of the constitutionality of the Assembly’s constitution is completed.

The complaint was submitted on Monday morning by MPs Arian Tahiri and Përparim Gruda, together with lawyer Faton Fetahu, on behalf of the PDK.

After submitting the request, Tahiri told the media that an interim measure should first be imposed, “so that damage and more serious situations in legal and institutional terms are not caused.”

PDK representatives claim that the ruling Vetëvendosje Movement violated the 30-day constitutional deadline for constituting the Assembly. According to them, the rule requiring a session to be convened every 48 hours until the constitution process is completed was also violated.

A Constitutional Court ruling from last year stipulates that the Assembly must be constituted within 30 days of the certification of the results. This deadline expired on August 7, 2026.

The constitutive session was held on Sunday, September 13. During the session, deputy speakers of the Assembly were elected from the ranks of the Democratic League of Kosovo, the Serb community and non-Serb minorities. Speaker Albulena Haxhiu declared the Assembly constituted even though the deputy speaker from the ranks of the Democratic Party of Kosovo, the country’s second-largest political force, had not been elected.

Several hours after the session, MPs voted in Kosovo’s new Government, led by Albin Kurti. Only MPs from the Vetëvendosje Movement and non-majority communities took part in the extraordinary session, while the PDK, LDK and the Alliance boycotted it.

The PDK, which also failed to attend the constitutive session, had earlier withdrawn Vlora Çitaku’s candidacy for the post of deputy speaker of the Assembly after the LVV had not supported her at the September 11 session. The LVV later said it would vote for Çitaku, but the PDK did not attend the session.

On September 11, the deputy speaker from the LVV was elected, while Albulena Haxhiu had been voted in as speaker of the Assembly during the previous session, on September 9.
