EU: Constitutional Court should rule on the constitution of the Assembly and Government

The European Union said it had been informed about Sunday’s vote, through which the Assembly of Kosovo was constituted and the new Government was formed, but stressed that it is up to the Constitutional Court to assess whether these actions comply with the Constitution.

“We are aware of Sunday’s votes, as well as the decisions on the constitution of the Assembly and the formation of the Government. We are also aware of the request submitted to the Constitutional Court concerning the constitutionality of these decisions. It is up to the Constitutional Court to rule on the submitted request,” a European Commission spokesperson told Radio Free Europe.

According to the spokesperson, Kosovo needs “fully consolidated institutions to move reforms forward and advance on the path toward EU integration, including within the framework of the Growth Plan for the Western Balkans.”

During Sunday’s constitutive session, on September 13, the Assembly elected deputy speakers from the Democratic League of Kosovo, the Serb community and non-Serb minorities. Assembly Speaker Albulena Haxhiu declared the constitution of the legislative body complete, although the deputy speaker belonging to the Democratic Party of Kosovo, the country’s second-largest political force, had not been elected.

Several hours later, lawmakers held an extraordinary session at which they approved Kosovo’s new Government, led by Albin Kurti. The PDK, LDK and the Alliance did not take part in the meeting, while only lawmakers from Kurti’s Vetëvendosje Movement and representatives of non-majority communities were present.

The PDK, which did not attend the constitutive session, had earlier withdrawn Vlora Çitaku’s candidacy for the post of deputy speaker of the Assembly after the LVV did not support her during the September 11 session. The LVV later said it would vote for Çitaku, but the PDK did not attend the session.

On September 11, the Assembly’s deputy speaker from the LVV was also elected, while Albulena Haxhiu had been voted in as head of the Assembly during the previous session, held on September 9.

Following these developments, the PDK petitioned the Constitutional Court, seeking the imposition of an interim measure against the new Assembly. The party asked for the measure to remain in force until the compliance of the constitution process with the Constitution has been reviewed.

The European Commission also confirmed that the EU is aware of this request and reiterated that it is up to the Constitutional Court to decide on it.

The appeal was submitted on Monday morning by PDK lawmakers Arian Tahiri and Përparim Gruda, together with lawyer Faton Fetahu, on behalf of the party.

After submitting the request, Tahiri told the media that an interim measure should first be approved “so that damage and more serious situations in legal and institutional terms are not caused.”

PDK representatives claim that the ruling Vetëvendosje Movement violated the constitutional 30-day deadline for constituting the Assembly, as well as the rule requiring a session to be convened every 48 hours until the process is completed.

Under a Constitutional Court ruling issued last year, the Assembly must be constituted within 30 days of the certification of the results. This deadline expired on August 7, 2026. /RFE
