Hyseni: The Constitution creates no uncertainty over the continuation of the Assembly session

Law professor Flamur Hyseni said that the continuation of the constitutive session of the Assembly of Kosovo, scheduled to be held tomorrow, faces no constitutional problem.

Discussing the deadlines set out in the Constitution and the decision of the Constitutional Court, Hyseni explained that Article 66 does not set a mandatory timeframe within which the constitutive session must be concluded.

“There are no, there are no constitutional dilemmas. There is no constitutional dilemma whatsoever because Article 66 of the Constitution is very clear. That is, the article is very clear; it does not set deadlines and does not foresee consequences,” Hyseni said on RTK Prime.

According to the professor, the 30-day deadline mentioned in the Constitutional Court’s judgment refers to a specific case from last year and cannot be applied directly to the current circumstances, which he considers different.

“The judgment refers to a specific case from last year… We are not in that circumstance now. We are now at the first stage; only the first step has been completed, that of taking the oath,” he said.

Hyseni stressed that the decisions of the Constitutional Court are mandatory to implement, but emphasized that last year’s decision cannot automatically be taken as a reference for the current situation.
