Restraining Order Imposed on Parents of Murdered 14-Year-Old, Barring Contact With Suspect’s Family

Marcello Carbonaro and Enza Cossentino, the parents of Martina Carbonaro, the 14-year-old who was murdered in May 2025 in Afragola, Naples, have been barred from approaching the family of the person suspected of killing their daughter.

In addition to the restraining order, the couple have also been ordered to wear electronic monitoring bracelets.

Italian authorities said the measure followed allegations of threats against relatives of Alessio Tucci, Martina’s former boyfriend, who has admitted to carrying out the murder. Tucci is suspected of killing the 14-year-old by striking her with rocks in May 2025.

Through this decision, the court aims to prevent any contact or encounters between the victim’s parents and the relatives of the alleged perpetrator.

Sergio Pisani, the Carbonaro family’s lawyer, said he respected the measure but disagreed with it.

“I respect the measure, but I cannot agree with this decision,” Pisani said, arguing that the actions cited in the case do not constitute a genuine criminal threat.

According to the lawyer, the words included in the investigation documents should be interpreted as the painful and desperate reaction of a father who had lost his daughter.

“These were the words of a father devastated by his daughter’s murder, spoken in a state of despair and profound emotional shock,” he said.

Pisani also stressed that, according to the case law of Italy’s Court of Cassation, a threat must have the concrete capacity to frighten the person at whom it is directed. He said this element was absent in this case.

“I am convinced that the Review Court will restore the proper application of legal principles, distinguishing between an outburst of despair and a genuine threat of criminal significance,” Pisani concluded.
