Prosecutors’ association: Salary blockage stems not from privilege demands, but from violation of constitutional ruling

The Association of Prosecutors of the Republic of Albania has officially reacted to the unusual situation surrounding the execution of salaries for judges and prosecutors. In a public statement, it clarifies that the existing blockage is not related to new demands for raises or special treatment, but to the failure of state institutions to implement a binding ruling of the Constitutional Court.

As the Association explains, the Assembly of Albania failed to adopt the legal amendments within the set deadline of July 31. Consequently, from August 1, 2026, the mechanism foreseen by the Constitutional Court itself in Ruling no. 35/2022 automatically entered into force. On this basis, the High Judicial Council, with decision no. 435/2026, and the High Prosecutorial Council, with decision no. 144/2026, approved the reference salary and instructed the relevant structures to begin payments. According to the Association, the formula followed is not a product of the HJC or the HPC, but a direct legal consequence of the constitutional ruling.

The main issue currently is not related to the calculation of salaries, but to their execution. Although the salaries have been calculated and the payment orders have been issued regularly, they have remained blocked at the administrative level at Treasury branches. The Association emphasizes that in districts such as Kukës and Dibra, salaries under the new framework have already been executed, which demonstrates that the implementation of the decisions is fully feasible both administratively and financially.

According to the Association, while judges and prosecutors continue to perform their duties without receiving their mandatory salaries, the matter goes beyond personal financial interest. The central question remains whether state institutions will respect the final rulings of the Constitutional Court. If any institution has legal claims or objections against the decisions of the HJC or HPC, it should pursue judicial channels and not undertake administrative blockages of salaries.
