Magistrates’ pay deadlock, Constitutional Court responds: Our ruling must be implemented

In a statement, the Constitutional Court responded to the freezing of magistrates’ salaries and the dispute between institutions. The Court said its ruling, dated February 17, is final and binding on the responsible authorities.

It also clarified that the method used to calculate salaries within its internal administration and the budget funds available do not affect the legal consequences and obligations arising from the ruling.

“The Court reiterates that its rulings are final and binding. Respecting and implementing them is a direct requirement of the constitutional order and is closely linked to the principles of the rule of law and legal certainty,” the Constitutional Court stated.

CONSTITUTIONAL COURT’S RESPONSE:

Regarding the public discussions about magistrates’ salaries, the Constitutional Court considers it necessary to clarify that it has already ruled on this matter in Decision No. 15, dated February 17, 2026.

Through this ruling, the Constitutional Court established the applicable constitutional standard, while also identifying the obligations arising from it for the responsible authorities. The reasoning and operative part of the ruling constitute the Court’s official position on the matter under review and must therefore be read and implemented in their entirety, in accordance with the constitutional principles set out therein.

The Court reiterates that its rulings are final and binding. Respecting and implementing them is a direct requirement of the constitutional order and is closely linked to the principles of the rule of law and legal certainty.

In this regard, the Court clarifies that the method used to calculate and disburse salaries within its internal administration, depending on the budget funds available, cannot be interpreted as determining the legal effects of Decision No. 15, dated February 17, 2026, or the obligations that this ruling imposes on the authorities responsible for its implementation.
