Jens Spahn resigns after debate over surrogacy, CDU seeks new successor

Jens Spahn, a representative of the Christian Democratic Union (CDU), has resigned from his post as head of the parliamentary group of the ruling coalition. This decision came after a wave of sharp criticism regarding the fact that he and his husband became parents with the help of a surrogate mother abroad, specifically in the United States.

The most problematic point remained his previous stance, where he had strongly opposed the practice of surrogacy. This contrast between his publicly expressed beliefs and personal actions raised accusations of hypocrisy and double standards.

In his official explanation, Spahn admitted that he had clearly realized that the personal joy of building a family with his partner and the reality of being a father do not align with the responsibilities he held as a high-ranking political figure. He described this effort to balance private life with public duty as far more complex than he had initially anticipated.

Chancellor Friedrich Merz commented on the resignation, calling it a ‘right’ and ‘inevitable’ step, recalling that in politics, credibility is the foundation upon which everything is built. Merz also announced that steps are being taken to find his replacement.

The political storm erupted when the 46-year-old politician announced earlier this week that he and Daniel Funke had welcomed their child. The use of a surrogate mother in another country sparked sharp reactions from members of various political forces, including voices within his own party, the CDU.

Beyond that, he said that the growing severity of the public debate had led him to serious reflection. Despite the strong contradictions, he called on his interlocutors that the exchange of ideas should always preserve dignity and human respect.

According to local media reports, until a permanent successor is appointed, the managerial duties will be temporarily covered by Alexander Hoffmann, who leads the Christian Social Union group. Hoffmann publicly respected his colleague’s decision, seeing it as an act stemming from responsibility.

As recently as February, the CDU had reaffirmed its commitment to maintaining the complete ban on surrogacy. During his tenure as Health Minister in 2020, Spahn had opposed any attempt to soften this law, while five years earlier, in 2015, he had publicly expressed difficulty in accepting the idea of ‘surrogate motherhood’ due to his identity as a homosexual and Christian man.

German legislation strictly prohibits surrogacy, and anyone who violates this law within German territory risks penalties of up to three years in prison or heavy fines. However, raising a child born through this practice in a foreign country is not considered a criminal offense, a legal loophole that drives many German couples to seek this alternative in countries where the practice is allowed.
