Constitutional Court responds to the Democratic Party: Claims may be examined after the reasoned decision

The Constitutional Court has responded to statements by the Democratic Party, which accused the institution of “distorting the facts and evidence” in its notice on the decision regarding the election of the Ombudsman.

According to the Court, press releases are published to ensure transparency and inform citizens until the final reasoned decision is announced. They are drafted in accessible language and do not contain a detailed account of the facts. They are prepared by the Court’s support structures, a practice also followed by other equivalent courts and the European Court of Human Rights.

Referring to the disputed wording, the Constitutional Court clarified that the phrase “the moment the candidates were verified by the Law Commission and referred for a vote in plenary session” relates to the deadline previously set by the commission for the submission of candidates’ support from 28 lawmakers.

The Court called on the parties to await publication of the full, reasoned decision. If they identify inaccuracies in the facts presented there, they may use the legal remedies provided for by the legislation.
