<p>The draft law proposed by the government for amendments to the Criminal Procedure Code drastically restricts media reporting on investigative files, risking, according to experts, the establishment of a prior censorship regime in violation of the Constitution, striking at independent journalism and the public&#8217;s right to be informed.</p>
<p>After every sensational investigation by the Special Prosecution featuring senior officials of his government, Prime Minister Edi Rama has always found a way to accuse the media.</p>
<p>In February of this year, Rama came to the defense of the indicted former director of the National Agency for the Information Society, Mirlinda Karçanaj, describing media reporting on her criminal case as a &#8220;massacre with artisanal bombs, pot after pot.&#8221;</p>
<p>In early March, the scene repeated itself even more aggressively when the prime minister announced before the parliamentary group the majority&#8217;s decision against lifting the immunity of former deputy prime minister and former minister of Infrastructure and Energy, Belinda Balluku.</p>
<p>Faced with data from the investigative file published by the media on how tenders worth hundreds of millions of euros were dictated, Rama accused journalists of being used by the prosecution &#8220;as paramilitary forces for the incrimination and public annihilation of their subjects.&#8221;</p>
<p>The prime minister reduced the exposure of suspected corruption affairs to a noise that &#8220;boils ceaselessly in the 700 pots of our media and political bazaar&#8221; and to &#8220;perverse fantasies of social networks.&#8221;</p>
<p>At the end of September, the prime minister again criticized the leak to the media of fragments from the investigative file against the head of the secret service, Vlora Hyseni, who is accused of disclosing state secrets and supporting the perpetrator of a crime in favor of Ergys Agasi.</p>
<p>&#8220;It took the data from the investigative file to flood through social channels and media stalls before the court, like the basket after the harvest, ordered the restriction of their publication,&#8221; he said in a recorded message from &#8220;Mother Teresa&#8221; airport.</p>
<p>But now, the prime minister&#8217;s rhetoric against the publication of data from investigative files has been translated into a legal initiative as part of the proposed amendments to the Criminal Procedure Code.</p>
<p>Article 103 of the draft law provides for the prohibition of publishing court decisions on security measures as well as the prohibition of transmitting images of persons deprived of liberty while they are subject to physical restraint measures, without their express consent.</p>
<p>The same article also stipulates that the publication of phone interceptions is always prohibited, even partially, &#8220;with the exception of the portion of the transcript that is cited in the reasoning of a decision or that is used during the trial.&#8221;</p>
<p>The prohibition on reporting on acts of preliminary investigations is significantly expanded &#8220;up to one year after the decision to dismiss&#8221; or &#8220;until the beginning of the first hearing of the merits review.&#8221;</p>
<p>The accompanying report even states that &#8220;making public the very fact that a person is under investigation is also prohibited.&#8221;</p>
<p>In addition to these provisions, point 14 of the article establishes prior control over newsrooms, stipulating that for journalists and media that already possess materials referred to in this article, publication may only occur with the court&#8217;s permission.</p>
<p>&#8220;In any case, publication may not be carried out without judicial authorization,&#8221; the draft states.</p>
<p>These provisions are met with concern by freedom of expression experts, who told BIRN that if approved, the draft risks creating prior censorship in violation of Article 22 of the country&#8217;s Constitution, creating additional barriers for investigative journalism, and exposing journalists to lawsuits, even in cases where they refer to prosecution or court documents.</p>
<p>&#8220;Ultimately, it is a draft that promotes censorship and that particularly strikes at investigative journalism,&#8221; Koloreto Cukali, head of the Albanian Media Council, told BIRN.</p>
<p><strong>The judge, a preliminary editor of the news</strong></p>
<p>Current legislation protects preliminary investigations and balances the right to information with the protection of investigative secrecy. The Law &#8220;On the Right to Information&#8221; imposes restrictions on access to documents considered investigative secrets related to the preliminary phase of investigations.</p>
<p>Blerjana Bino, head of the Center for Science and Innovation for Development, SCiDEV, acknowledges that protecting investigative secrecy and the presumption of innocence are legitimate state interests.</p>
<p>However, Bino notes that the draft law crosses into an unconstitutional regime.</p>
<p>According to her, the main problem &#8220;is the shift from protecting secrecy within the justice system to prior control over what the media may publish,&#8221; a shift that requires serious constitutional review and in relation to Article 10 of the European Convention on Human Rights.</p>
<p>Bino emphasizes that point 14 of Article 103 turns the judge into a preliminary editor of the news.</p>
<p>&#8220;Here we do not simply have liability after publication; according to the draft, the judge&#8217;s permission becomes a condition for publishing. In practice, this can delay investigations, cause the news to lose its timeliness, and produce self-censorship in newsrooms. The Constitution expressly guarantees freedom of the press and prohibits prior censorship,&#8221; Bino told BIRN.</p>
<p>On the same line, Koloreto Cukali considers the requirement for judicial authorization, even when the documents do not constitute investigative secrecy, as a direct violation of Article 22, paragraph 3 of the Constitution, which prohibits prior censorship.</p>
<p>According to him, this procedure brings essential delays and serves as a tool &#8220;to prevent newsrooms from publishing information that is essential for the accountability of power,&#8221; turning into &#8220;a barrier for investigative journalism.&#8221;</p>
<p>The clash with constitutional pillars through which freedom of expression and media freedom are protected is also noted by jurists. Former Constitutional Court judge Përparim Kalo told BIRN that this concern about the draft law amending the Criminal Procedure Code stands.</p>
<p>&#8220;Although the provision is limited only to materials obtained within the investigative process, it can be said that it interferes to a certain extent in the realm of constitutional rights,&#8221; Kalo said.</p>
<p>Meanwhile, the draft also prohibits the distribution of materials or &#8220;acts of preliminary investigations that are no longer protected by investigative secrecy.&#8221; Article 308/a prohibits the proceeding body from publishing that a person is under investigation, without distinguishing between a citizen and a senior public official. The draft also bypasses the Commissioner for the Right to Information.</p>
<p>Cukali warns that blocking decisions and data until the matter goes to court or the case is dismissed creates a dangerous information blackout on abuses of power and completely undermines transparency.</p>
<p>&#8220;This is a long period of silence, a blackout,&#8221; Cukali says, adding that this situation deprives citizens of the opportunity to observe public interventions, &#8220;creates space for pressure&#8221; on the justice system, and removes the media&#8217;s ability to exert pressure for public accountability.</p>
<p>&#8220;Where does transparency remain here then?&#8221; he asks, emphasizing that for political figures and leaders, the moment they appear before the prosecution or SPAK &#8220;is vital information for the public.&#8221;</p>
<p>According to him, the reporting ban creates a shield where news emerges only when investigative institutions want it to, killing independent journalism.</p>
<p>Bino also expresses concern about the long-term blocking of information from investigations, which according to her strikes at the core of public oversight.</p>
<p>&#8220;Extending the prohibition even after investigative secrecy falls seriously affects the media&#8217;s watchdog function, especially in corruption cases and in files that are dismissed and never reach a public trial,&#8221; she assesses.</p>
<p><strong>The license trap and opening the doors to SLAPP lawsuits</strong></p>
<p>While the articles above provide for prohibitions, Article 104 reformulates who bears responsibility for publishing a secret by making the journalist co-responsible with the officials who administer the process and opening the doors for them to be sued for causing damage, even when they simply referred to court and prosecution documents.</p>
<p>The draft has provided for &#8220;civil liability for compensation of the damage caused,&#8221; &#8220;criminal liability of the person when the violation also constitutes a criminal offense,&#8221; and qualifies the action as &#8220;a disciplinary violation&#8221; when committed by a public official or &#8220;persons exercising a profession for which a license is required.&#8221;</p>
<p>The accompanying report of the draft law expressly clarifies that this provision extends liability beyond public officials.</p>
<p>&#8220;Recognizing that the violation may come equally from a journalist, lawyer, or other regulated professional,&#8221; the report states.</p>
<p>In point 2 of this article, the prosecutor&#8217;s monopoly on action in cases of breach of secrecy is removed and it stipulates that besides the prosecutor, &#8220;the accused, the victim, the complainant, or any party in the proceedings whose rights have been affected by the violation (publication) may notify the body exercising disciplinary proceedings, file a lawsuit for compensation of damages, or submit a criminal complaint when the act constitutes a criminal offense.&#8221;</p>
<p>For Blerjana Bino, this formulation in the report brings back attempts at state control over the profession, following the January 2026 debate on the Criminal Code, when the notion of the &#8220;registered/recognized&#8221; journalist was introduced.</p>
<p>&#8220;This is problematic because journalism in Albania is not currently a licensed profession within the meaning of the law on regulated professions,&#8221; Bino says, raising the questions of who will grant or revoke the license and what will happen to independent and investigative journalists.</p>
<p>She recalls that European standards link the protection of Article 10 to the function of journalism and not to &#8220;the possession of a license or status granted by the state,&#8221; warning that such an approach creates legal uncertainty and &#8220;an indirect risk for the regulation of the journalist profession by the state.&#8221;</p>
<p>On the other hand, Koloreto Cukali warns that arming persons under investigation with the right to sue journalists opens the doors to strategic lawsuits against public participation, known as SLAPP. In this case, creating lawsuits against them even for referring to or partially publishing materials or the content of materials produced by the court and prosecution.</p>
<p>&#8220;Businessmen and officials can use lawsuits to intimidate newsrooms, threatening them with substantial legal costs, not to mention stress in life and at work, even when journalists are right,&#8221; Cukali concluded./BIRN</p>

										<content:encoded><![CDATA[<p>Projektligji i propozuar nga qeveria për ndryshime në Kodin e Procedurës Penale, kufizon në mënyrë drastike raportimin mediatik mbi dosjet hetimore, duke rrezikuar sipas ekspertëve vendosjen e një regjimi censure paraprake në shkelje të Kushtetutës, duke goditur gazetarinë e pavarur dhe të drejtën e publikut për t’u informuar.</p>
<p>Pas çdo hetimi të bujshëm të Prokurorisë së Posaçme me protagonistë zyrtarët e lartë të qeverisë së tij, kryeministri Edi Rama, ka gjetur gjithmonë një shteg për të akuzuar median.</p>
<p>Në shkurt të këtij viti, Rama doli në mbrojtje të ish-drejtoreshës nën akuzë të Agjencisë Kombëtare të Shoqërisë së Informacionit, Mirlinda Karçanaj, duke e konsideruar raportimin mediatik për çështjen e saj penale si “<em>masakër me bomba artizanale, tenxhere më tenxhere”.</em></p>
<p>Në fillim të marsit, skena u përsërit në mënyrë edhe më agresive kur kryeministri njoftoi para grupit parlamentar vendimin e mazhorancës kundër heqjes së imunitetit të ish-zëvendëskryeministres dhe ish-ministres së Infrastrukturës dhe Energjisë, Belinda Balluku.</p>
<p>Përballë të dhënave nga dosja hetimore të publikuara nga mediat mbi mënyrën se si diktoheshin tendera me vlerë qindra milionë euro, Rama akuzoi gazetarët se përdoreshin prej akuzës “<em>si forca paramilitare të fajësimit dhe të asgjësimit publik të subjekteve të tyre”.</em></p>
<p>Kryeministri e reduktoi zbardhjen e aferave të dyshuara të korrupsionit në një zhurmë që <em>“zien pa pushim në 700 tenxheret e pazarit tonë mediatik e politik</em>” dhe në <em>“fantazi perverse të rrjeteve sociale”.</em></p>
<p>Në fund të shtatorit, kryeministri kritikoi sërish rrjedhjen në media të fragmenteve nga dosja hetimore ndaj shefes së shërbimit sekret, Vlora Hyseni, e cila akuzohet për nxjerrje të sekreteve shtetërore dhe përkrahjes së autorit të krimit në favor të Ergys Agasit.</p>
<p><em>“U desh që të dhënat e dosjes hetimore të vërshonin nëpër kanale sociale dhe tezga mediatike, përpara se sa gjykata të udhëronte si kofini pas të vjelit kufizimin e publikimit të tyre</em>”, tha ai në një mesazh të regjistruar nga aeroporti “Nënë Tereza”.</p>
<p>Por tashmë, retorika e kryeministrit kundër publikimit të të dhënave nga dosjet hetimore është përkthyer në një nismë ligjore si pjesë e ndryshimeve të propozuara në Kodin e Procedurës Penale.</p>
<p>Neni 103 i projektligjit parashikon ndalimin e publikimit të vendimeve gjyqësore për masat e sigurimit si dhe ndalimin e transmetimit të imazheve të personave të privuar nga liria, ndërkohë që janë subjekt i masave të shtrëngimit fizik, pa pëlqimin e tyre të shprehur.</p>
<p>I njëjti nen përcakton gjithashtu se publikimi i përgjimeve telefonike është gjithmonë i ndaluar, qoftë edhe i pjesshëm, <em>“me përjashtim të pjesës së transkriptimit që citohet në arsyetimin e një vendimi ose që përdoret gjatë gjykimit”.</em></p>
<p>Ndalimi i raportimit mbi aktet e hetimeve paraprake zgjerohet ndjeshëm “<em>deri në një vit pas vendimit të pushimi</em>t” ose “<em>deri në fillimin e seancës së parë të shqyrtimit gjyqësor të themelit”.</em></p>
<p>Në relacion madje thuhet se “<em>ndalohet edhe bërja publike e vetë faktit se një person është nën hetim”.</em></p>
<p>Përveç këtyre parashikimeve, në pikën 14 neni vendos kontroll paraprak mbi redaksitë, duke sanksionuar se për gazetarët dhe mediat që kanë tashmë në zotërim materiale që përmenden në këtë nen, publikimi bëhet vetëm me leje të gjykatës.</p>
<p><em>“Në çdo rast, publikimi nuk mund të kryhet pa autorizimin gjyqësor”,</em> thuhet në draft.</p>
<p>Këto parashikime priten me shqetësim nga ekspertët e lirisë së shprehjes, të cilët i thanë BIRN se nëse miratohet, drafti rrezikon të krijojë censurë paraprake në kundërshtim me nenin 22 të Kushtetutës së vendit, të krijojë barriera shtesë për gazetarinë hulumtuese si dhe t’i ekspozojë gazetarët ndaj padive, edhe në rastet kur referojnë dokumente të prokurorisë apo gjykatës.</p>
<p><em>“Përfundimisht, është një draft që promovon censurën, e që godet sidomos gazetarinë hulumtuese”</em>, i tha BIRN Koloreto Cukali, drejtues i Këshillit Shqiptar të Medias, KSHM.</p>
<p><strong>Gjyqtari, një redaktor paraprak i lajmit</strong></p>
<p>Legjislacioni aktual i mbron hetimet paraprake dhe vendos në ekuilibër të drejtën për informim dhe mbrojtjes së sekretit hetimor. Ligji <em>“Për të drejtën e informimit</em>” vendos kufizime për aksesin në dokumente që konsiderohen sekrete hetimore dhe lidhen me fazën paraprake të hetimeve.</p>
<p>Blerjana Bino, drejtuese e Qendrës për Shkencë dhe Inovacion për Zhvillim, SCiDEV, pranon se mbrojtja e sekretit hetimor dhe prezumimit të pafajësisë janë interesa legjitime të shtetit.</p>
<p>Megjithatë, Bino vëren se projektligji kapërcen në një regjim antikushtetues.</p>
<p>Sipas saj, problemi kryesor “<em>është kalimi nga mbrojtja e sekretit brenda sistemit të drejtësisë te kontrolli paraprak mbi atë që mund të publikojë media”</em>, një zhvendosje që kërkon rishikim serioz kushtetues dhe në raport me nenin 10 të Konventës Europiane për të Drejtat e Njeriut.</p>
<p>Bino thekson se pika 14 e nenit 103 e kthen gjyqtarin në redaktor paraprak të lajmit.</p>
<p><em>“Këtu nuk kemi thjesht përgjegjësi pas publikimit, sipas draftit leja e gjyqtarit bëhet kusht për të publikuar. Praktikisht kjo mund të vonojë investigimet, të humbasë aktualitetin e lajmit dhe të prodhojë vetëcensurë në redaksi. Kushtetuta garanton shprehimisht lirinë e shtypit dhe ndalon censurën paraprake”</em>, tha Bino për BIRN.</p>
<p>Në të njëjtën linjë, Koloreto Cukali, e konsideron kërkesën për autorizim gjyqësor, edhe kur dokumentet nuk përbëjnë sekret hetimor, si shkelje të drejtpërdrejtë të nenit 22, pika 3 të Kushtetutës, i cili ndalon censurën paraprake.</p>
<p>Sipas tij, kjo procedurë sjell vonesa thelbësore dhe shërben si mjet “<em>për t’i parandaluar redaksitë nga publikimi i informacioneve që janë esenciale për llogaridhënien e pushtetit”</em>, duke u kthyer në “një barrierë për gazetarinë investigative”.</p>
<p>Përplasjen me shtyllat kushtetuese përmes së cilave mbrohet liria e shprehjes dhe ajo e medias e vërejnë edhe juristët. Ish-gjyqtari i Gjykatës Kushtetuese Përparim Kalo, i tha BIRN se ky shqetësim për draftin ligjor të ndryshimeve në Kodin e Procedurës Penale qëndronte.</p>
<p><em>“Edhe pse dispozita kufizohet vetëm në lidhje me materialet e përftuara në kuadër të procesit hetimor, mund të thuhet që ndërhyn në njëfarë mase në lëmin e të drejtave kushtetuese”</em>, tha Kalo.</p>
<p>Ndërkohë, drafti ndalon edhe shpërndarjen e materialeve apo e <em>“akteve të hetimeve paraprake, që nuk janë më të mbrojtura nga sekreti hetimor”.</em> Neni 308/a ndalon organin procedues të publikojë se një person është nën hetim, pa bërë dallim mes një qytetari dhe një funksionari të lartë publik. Drafti po ashtu shmang Komisionerin për të Drejtën e Informimit.</p>
<p>Cukali paralajmëron se bllokimi i vendimeve dhe të dhënave deri në kalimin në gjykatë apo pushimin e çështjes krijon një terr të rrezikshëm informativ mbi abuzimet me pushtetin si dhe cënon totalisht transparencën.</p>
<p><em>“Bëhet fjalë për një periudhë të gjatë heshtjeje, black-out-i”,</em> thotë Cukali, duke shtuar se kjo situatë u heq qytetarëve mundësinë të vëzhgojnë ndërhyrjet publike, “<em>krijon hapësira për presione</em>” ndaj drejtësisë, dhe heq mundësinë e medias për të ushtruar presion për llogaridhënie publike.</p>
<p><em>“Po ku mbetet transparenca këtu pastaj”</em>?- pyet ai, duke theksuar se për figurat politike dhe drejtuese, momenti kur paraqiten në prokurori apo në SPAK <em>“është informacion vital për publikun”.</em></p>
<p>Sipas tij, ndalimi i raportimit krijon një mburojë ku lajmet dalin vetëm kur duan institucionet hetuese, duke e vrarë gazetarinë e pavarur.</p>
<p>Edhe Bino, shpreh shqetësimin për bllokimin afatgjatë të informacionit nga hetimet, që sipas saj e godet thelbin e mbikëqyrjes publike.</p>
<p><em>“Zgjatja e ndalimit edhe pasi bie sekreti hetimor prek seriozisht funksionin ‘ëatchdog’ të medias, veçanërisht në çështje korrupsioni dhe në dosje që pushohen dhe nuk arrijnë kurrë në një gjykim publik”,</em> vlerëson ajo.</p>
<p><strong>Kurthi i licencës dhe hapja e dyerve për padi SLAPP</strong></p>
<p>Ndërsa nenet më sipër parashikojnë ndalimet, neni 104 riformulon se kush mban përgjegjësi për publikimin e një sekreti duke e bërë gazetarin bashkëpërgjegjës me zyrtarët që e administrojnë procesin dhe duke hapur dyert që ai të paditet për shkaktim dëmi, edhe kur thjesht u është referuar dokumenteve të gjykatës dhe prokurorisë.</p>
<p>Drafti ka parashikuar <em>“përgjegjësi civile për shpërblimin e dëmit të shkaktuar”,</em> “<em>përgjegjësinë penale të personit kur shkelja përbën edhe vepër penale”</em>, si dhe e cilëson veprimin “<em>një shkelje disiplinore”</em> kur kryhet nga një nëpunës publik ose <em>“persona që ushtrojnë një profesion për të cilin kërkohet licencë”.</em></p>
<p>Në relacionin shoqërues të projektligjit sqarohet shprehimisht se kjo dispozitë e shtrin përgjegjësinë përtej nëpunësve publikë.</p>
<p>“<em>Duke njohur se shkelja mund të vijë njësoj nga një gazetar, avokat apo profesionist tjetër i rregulluar</em>”, thuhet në relacion.</p>
<p>Në pikën 2 të këtij neni i hiqet monopoli i veprimit prokurorit në rastet e cenimit të sekretit dhe përcakton se përveç tij <em>“i akuzuari, viktima, ankuesi ose çdo palë në procedim, të drejtat e së cilës janë prekur nga shkelja (publikimi), mund të njoftojë organin që ushtron procedimin disiplinor, të ngrejë padi për shpërblimin e dëmit ose të paraqesë kallëzim penal kur fakti përbën vepër penale”.</em></p>
<p>Për Blerjana Binon, ky formulim në relacion rikthen tentativat për kontroll shtetëror mbi profesionin, në vijim të debatit të janarit 2026 për Kodin Penal, kur u fut nocioni i gazetarit <em>“të regjistruar/të njohur”.</em></p>
<p><em>“Kjo është problematike sepse gazetaria në Shqipëri nuk është sot një profesion i licencuar në kuptimin e ligjit për profesionet e rregulluara”</em>, thotë Bino, duke ngritur pyetjet se kush do ta japë apo heqë licencën dhe çfarë do të ndodhë me gazetarët e pavarur dhe investigativë.</p>
<p>Ajo kujton se standardet europiane e lidhin mbrojtjen e nenit 10 me funksionin e gazetarisë dhe jo me<em> “posedimin e një licence apo statusi të dhënë nga shteti”,</em> duke paralajmëruar se një qasje e tillë krijon pasiguri juridike dhe “<em>rrezik të tërthortë për rregullimin e profesionit të gazetarit nga shteti”.</em></p>
<p>Nga ana tjetër, Koloreto Cukali paralajmëron se armatosja e personave nën hetim me të drejtën e padive ndaj gazetarëve hap dyert për padi strategjike kundër pjesëmarrjes publike, të njohura si SLAPP. Duke krijuar në këtë rast padi ndaj tyre edhe për referim apo publikim të pjesshëm të materialeve apo përmbajtjes së materialeve të prodhuara nga gjykata e prokuroria.</p>
<p><em>“Biznesmenët dhe zyrtarët mund t’i përdorin paditë për të ushtruar frikë te redaksitë, duke i kërcënuar ata me kosto thelbësore ligjore, pa folur për stresin në jetë e në punë, edhe kur gazetarët kanë të drejtë”,</em> përfundoi Cukali./BIRN</p>

<p>The government has proposed restrictions on arrest measures and investigative techniques in the draft Code of Criminal Procedure which, according to civil society representatives, are limiting SPAK’s room for maneuver at a time when corruption investigations are reaching the highest levels of power.</p>
<p>The Albanian government presented a 106-article bill in Tirana on Wednesday that revises around one-fifth of the Code of Criminal Procedure, a move that took the justice system by surprise.</p>
<p>The bill excludes criminal offenses carrying a maximum sentence of up to five years from arrest measures, introduces new filters on prosecutors’ conduct of investigations and requests for evidence, and strengthens the regime of investigative secrecy to the point of prohibiting the public disclosure that a person is under investigation.</p>
<p>Prime Minister Edi Rama promoted the draft as the “Procedural Guarantees Package” and said that, 10 years after politics handed the judiciary “the sword of punishment,” it was necessary to correct “failures and distortions that cannot be hidden behind the results.”</p>
<p>Civil society representatives, however, view it as a project intended to protect senior officials from justice by undermining the foundations of justice reform.</p>
<p><em>“Rama’s main concern in recent months or in the coming months is his relationship with power and with the post-power period, and this means that he has neither reform of the justice system, nor the need to strengthen the rule of law, nor public accountability and transparency as his project,”</em> said Afrim Krasniqi, director of the Institute for Political Studies.</p>
<p><em>“The latest effort is to create protective mechanisms in the event of an investigation against him and his associates, especially during the period when he will no longer be prime minister,”</em> Krasniqi added.</p>
<p>The amendments to the Code of Criminal Procedure have been proposed at a time when Prime Minister Edi Rama’s government has been shaken by new corruption scandals involving former Deputy Prime Minister Belinda Balluku, former head of the Intelligence Service Vlora Hyseni and other senior officials.</p>
<p>According to Krasniqi, these developments have influenced Prime Minister Rama to consider additional mechanisms in relation to the justice system, while publicly describing it as successful.</p>
<p>Zef Preçi, director of the Albanian Center for Economic Research, has also raised concerns that the new provisions could affect the work of justice institutions, although in principle he views the package’s focus on limiting pretrial detention and strengthening alternatives to it positively.</p>
<p>He says that the effectiveness of the new reform will depend on how the new provisions are implemented and on the consistency of the courts in their decision-making. He also suggests that the government should stipulate in the package that sentences be calculated for each repeated episode of a criminal offense, arguing that treating several violations as a single case could create problems in the fight against corruption.</p>
<p>Otherwise, Preçi warns, <em>“the proposed amendments to the Code of Criminal Procedure will be nothing more than a Machiavellian political mechanism to restrain SPAK, keeping the ranks of government officials and politicians from the majority led by Mr. Rama tightly closed, as they are de facto candidates for future investigation by SPAK.”</em></p>
<p>For Migen Qiraxhi of Qendresa Qytetare, it is the recent scandals that have prompted the government to amend the Code of Criminal Procedure, changes which, he says, target SPAK’s work.</p>
<p><em>“There is a paradox: the more results SPAK achieves and the more it strikes at the highest levels of politics, the more we see political initiatives affecting SPAK’s activity,”</em> Qiraxhi said, adding that the amendments are being introduced precisely when the institution has gained a considerable level of public legitimacy.</p>
<p><strong>Changes that threaten justice reform</strong></p>
<p>The justice reform, approved in 2016 following constitutional amendments and supported by the EU and the United States, aimed to strengthen the independence of institutions, particularly those specializing in combating corruption and organized crime, and to reorganize the system based on the vetting of judges and prosecutors.</p>
<p>A decade later, civil society experts view the government’s newly proposed amendments to the Code of Criminal Procedure as a threat to this reform, even though they are presented as corrections intended to protect human rights, particularly in cases involving pretrial detention measures.</p>
<p>According to them, the main problem is the lack of genuine consultation with justice-sector actors and with the international institutions that supported the reform 10 years ago.</p>
<p>Krasniqi calls the initiative “a personal political move” and, to some extent, “<em>one of the commissioned laws on the government’s legislative agenda.”</em></p>
<p>He considers it absurd that initiatives affecting the core of the justice system come solely from the Socialist majority, disregarding the parliamentary opposition and justice institutions. In his view, this shows that “<em>the concept of the party-state remains dominant and the personalization of power is the prevailing logic.”</em></p>
<p>He says these attempts also contrast with the integration process, in which the only positive development in the justice and anti-corruption chapter is considered to be the work of SPAK and the Special Court against Corruption and Organized Crime.</p>
<p>Migen Qiraxhi does not consider the government’s initiative surprising, but links it to ongoing attempts to affect SPAK’s powers or room for maneuver through initiatives presented as anti-corruption reforms.</p>
<p><em>“If this is a government initiative today, there is a risk that a common interest among parts of the old political establishment, on the left and the right, will gradually be formalized to regain control or narrow the space of a justice system that, for the first time, is genuinely striking at the highest levels,”</em> he said, insisting that this is the fundamental conflict.</p>
<p>In this context, Qiraxhi believes that the debate should focus on SPAK’s legitimacy rather than on the technical content of the proposals.</p>
<p>Meanwhile, Zef Preçi says that, despite the risk the package poses to the independence of the justice system, in principle it appears to address some of the most criticized problems in Albania’s criminal justice system concerning pretrial detention measures.</p>
<p>But he says that serious questions remain, mainly because the full text was not publicly available when it was presented and because of how it will be implemented in practice by the courts./BIRN</p>

										<content:encoded><![CDATA[<p>Qeveria propozon kufizime për masat e arrestit dhe teknikat e hetimit në draftin e Kodit të Procedurës Penale, që sipas përfaqësuesve të shoqërisë civile, po prekin hapësirën e veprimit të SPAK-ut në një kohë kur hetimet për korrupsion po ngjiten në nivelet më të larta të pushtetit.</p>
<p>Qeveria shqiptare prezantoi të mërkurën në Tiranë, një projektligj prej 106 nenesh që rishikon rreth një të pestën e Kodit të Procedurës Penale, një lëvizje që zuri në befasi sistemin e drejtësisë.</p>
<p>Projektligji përjashton nga masat e arrestit veprat penale ku maksimumi i dënimit është deri në pesë vite, vendos filtra të rinj në kryerjen e hetimeve dhe kërkimin e provave nga prokurorët si dhe forcon regjimin e sekretit hetimor, deri në atë pikë sa ndalon bërjen publike të faktit se një person është nën hetim.</p>
<p>Kryeministri Edi Rama e promovoi draftin si “Paketa e Garancive Procedurale” dhe tha se 10 vite pasi politika i dorëzoi gjyqësorit “shpatën e ndëshkimit”, nevojitet të korrigjohen “edhe dështime e deformime që nuk mund të fshihen pas rezultateve”.</p>
<p>Në të kundërt, përfaqësues të shoqërisë civile e shohin këtë si projekt që synon të mbrojë zyrtarët e lartë nga drejtësia përmes cënimit të themeleve të reformës në drejtësi.</p>
<p><em>“Shqetësimi kryesor i Ramës muajt e fundit apo në muajt e ardhshëm është raporti i tij me pushtetin dhe post-pushtetin dhe kjo do të thotë që ai nuk e ka projekt reformën në drejtësi, as nevojën e forcimit të shtetit të së drejtës dhe as llogaridhënien e transparencën publike”,</em> tha Afrim Krasniqi, drejtor i Institutit të Studimeve Politike.</p>
<p><em>“Përpjekja e fundit është për të krijuar mekanizma mbrojtës në një rast hetimi ndaj tij dhe ndaj bashkëpunëtorëve të tij dhe sidomos në periudhën kur ai s’do jetë kryeministër”</em>, shtoi Krasniqi.</p>
<p>Ndryshimet e Kodit të Procedurës Penale propozohen në një kohë kur qeveria e kryeministrit Edi Rama është tronditur nga skandale të reja korrupsioni, të cilat përfshijnë ish.zv.kreyeministren Belinda Balluku, ish-kryetaren e Shërbimit Informativ, Vlora Hyseni dhe drejtues të tjerë të lartë.</p>
<p>Këto përvoja, sipas Krasniqit, kanë ndikuar që kryeministri Rama të mendojë për mekanizma shtesë në raport me drejtësinë, ndërkohë që publikisht e konsideron atë të suksesshme.</p>
<p>Rrezikun që dispozitat e reja të ndikojnë në punën e institucioneve të drejtësisë e ngre edhe Zef Preçi, drejtor i Qendrës Shqiptare për Kërkime Ekonomike, ndonëse në parim ai vlerëson orientimin e paketës drejt kufizimit të paraburgimit dhe forcimit të alternativave ndaj tij.</p>
<p>Ai thotë se efektiviteti i reformës së re do të varet nga mënyra se si do të zbatohen dispozitat e reja dhe nga konsistenca e gjykatave në vendimmarrje, ndërsa sugjeron që qeveria të sanksionojë në këtë paketë që dënimet të llogariten për çdo episod të përsëritur të një vepre penale, duke argumentuar se trajtimi i disa shkeljeve si një rast i vetëm mund të krijojë probleme në luftën kundër korrupsionit.</p>
<p>Në të kundërt, paralajmëron Preçi, <em>“amendimet e propozuara në Kodin e Procedurës Penale nuk do të jenë gjë tjetër veçse një mekanizëm makiavelist politik për të frenuar SPAK-un, duke mbajtur të shtrënguara radhët e funksionarëve të qeverisë dhe politikanëve të mazhorancës së drejtuar nga z.Rama, që de facto janë kandidatë për t’u hetuar në vijim nga SPAK-u”.</em></p>
<p>Për Migen Qiraxhi nga “Qendresa Qytetare”, janë skandalet e fundit ato që e kanë nxitur qeverinë të bëjë ndryshime në Kodin e Procedurës Penale, ndryshime që sipas tij kanë si target punën e SPAK.</p>
<p><em>“Ka një paradoks: sa më shumë SPAK ka rezultate dhe godet nivele të larta të politikës, aq më shumë shohim iniciativa politike që prekin aktivitetin e SPAK</em>”, tha Qiraxhi, duke shtuar se ndryshimet vijnë pikërisht atëherë kur ky institucion ka fituar një nivel të konsiderueshëm legjitimiteti publik.</p>
<p><strong>Ndryshime që rrezikojnë reformën në drejtësi</strong></p>
<p>Reforma në drejtësi, e miratuar në vitin 2016 pas ndryshimeve kushtetuese dhe e mbështetur nga BE-ja dhe SHBA-ja, kishte si qëllim forcimin e pavarësisë së institucioneve kryesisht atyre të posaçme kundër korrupsionit dhe krimi të organizuar dhe një riorganizim të bazuar mbi vetingun e gjyqtarëve dhe prokurorisë.</p>
<p>Një dekadë më pas, ekspertët e shoqërisë civile i vlerësojnë ndryshimet e reja të propozuara nga qeveria në Kodin e Procedurës Penale si rrezik për këtë reformë, pavarësisht se ato paraqiten si korrigjime për mbrojtjen e të drejtave të njeriut, sidomos në çështjet e masave të paraburgimit.</p>
<p>Problematika kryesore, sipas tyre, është mungesa e një konsultimi real me aktorët e drejtësisë dhe me institucionet ndërkombëtare që mbështetën këtë reformë 10 vite më parë.</p>
<p>Krasniqi e quan këtë nismë “një lëvizje politike personale” dhe deri diku si “<em>një nga ligjet e porositura në axhendën ligjore të qeverisë”.</em></p>
<p>Ai e konsideron absurd faktin që nismat që prekin thelbin e drejtësisë vijnë vetëm nga mazhoranca socialiste, duke shpërfillur opozitën parlamentare dhe institucionet e drejtësisë, gjë që sipas tij tregon se, “<em>koncepti i partisë-shtet vijon të jetë dominues dhe personalizimi i pushtetit logjikë dominuese”.</em></p>
<p>Sipas tij këto tentativa bien në kontrast dhe me procesin e integrimit ku i vetmi evolucion pozitiv në kapitullin e drejtësisë dhe luftës anti-korrupsion konsiderohet puna që bën SPAK dhe GJKKO.</p>
<p>Migen Qiraxhi nuk e konsideron suprizë këtë nismë të qeverisë, por e lidh atë me tentativa të vazhdueshme për të prekur kompetencat apo hapësirën e veprimit të SPAK me nisma që paraqiten si reforma kundër korrupsionit.</p>
<p><em>“Nese kjo sot është një nisme e qeverisë, ekziston rreziku që gradualisht të formalizohet një interes i përbashkët i pjesëve të politikës së vjetër, majtas dhe djathtas, për të rimarrë kontroll ose për të ngushtuar hapësirën e një drejtësie që për herë të parë po godet realisht në nivelet e larta”</em>, thotë ai, duke këmbëngulur se ky është konflikti themelor.</p>
<p>Në këtë kontekst, Qiraxhi beson se debati duhet të fokusohet tek legjitimiteti I SPAK dhe jo tek përmbajtja teknike e propozimeve.</p>
<p>Ndërkohë, Zef Preçi vlerëson se pavarësisht rrezikut që paketa mbart ndaj pavarësisë së drejtësisë, në planin parimor ajo duket se adreson disa nga problemet më të kritikuara të sistemit penal shqiptar lidhur me masat e paraburgimit.</p>

<p>The new judicial map from three years ago has worsened the situation in several courts in the country, which carry out their work in dilapidated buildings flooded with court files, while requests for solutions fall on deaf ears.</p>
<p>On Monday morning, the lobby of the Court of Appeal of General Jurisdiction in Tirana is overcrowded with people waiting for court proceedings. Defendants, family members and lawyers first pass through security screening, then pack into the waiting room from which the start of hearings is announced.</p>
<p>Built in 1957 to serve as a police precinct, the old three-story building of the Court of Appeal extended its jurisdiction across all of Albania after the approval of the new judicial map of 2023.</p>
<p>But instead of resolving backlogged cases, the situation at the Court of Appeal is today on the verge of impossibility due to the lack of premises for the doubled staff and case files gathered from the whole country.</p>
<p>The narrow corridors of this court have already turned into labyrinths filled with case files, which can be found stacked in cupboards, on shelves and on chairs. The air reeks of mold and dampness.</p>
<p>Due to the lack of space, all deliberation rooms where judges withdraw to discuss and make decisions have been turned into &#8216;temporary archives&#8217; for cases awaiting trial. Over the past three years, the stock of case files has grown from 33,000 to 48,000.</p>
<p>The need for space has forced the administration to find temporary solutions; for example, partitioning a courtroom with cardboard panels to create a windowless space as a deliberation room. But a new problem has now emerged.</p>
<p>“When we enter the deliberation room, we take the parties out of the courtroom so they do not hear what we discuss,” says a judge on condition of anonymity.</p>
<p>“There is no security measure at all. No matter how good a judge you are, you cannot work here. They should stay here with us to understand,” she added.</p>
<p>The lack of space and the degradation of buildings is not an isolated problem only for the Court of Appeal of General Jurisdiction. According to data that BIRN obtained through right-to-information requests and conversations with the heads of several courts, the lack of premises has become an obstacle to performing their work in other courts throughout the country.</p>
<p>According to them, this is not only an infrastructure problem, but a matter of the administration of justice, improving the quality of judicial services and respecting the standards of an efficient and safe system at the service of citizens.</p>
<p>Faced with this emergency situation, the government offers promises as a solution.</p>

<p>Prime Minister Edi Rama presented on February 12 a program for the international competition for the Justice Center – a complex for the justice system that, even according to the most optimistic forecasts, is expected to be completed in 2031.</p>
<p>The High Judicial Council (KLGJ) and the Ministry of Justice had not responded to BIRN&#8217;s questions by the publication of this article.</p>
<p><strong>Requests fall on deaf ears</strong></p>

<p>BIRN learned that the miserable conditions at the Court of Appeal of General Jurisdiction are repeated almost identically at the Administrative Court of Appeal in Tirana, the Tirana Court, as well as courts in several districts.</p>
<p>The Administrative Court of Appeal currently has over 24,000 cases under adjudication, of which about 17,000 are carried over from previous years. To reduce the case file backlog, 25 legal assistants have recently been hired, but there is no space to accommodate them.</p>
<p>The High Judicial Council rejected in July of this year a lease contract of 11,000 euros per month between the Administrative Court of Appeal and the company “Gener 2” for renting a space to accommodate case files and legal assistants.</p>
<p>After this decision, the Administrative Court of Appeal again submitted a request to the High Judicial Council, the Ministry of Finance, the Ministry of Justice and the Ministry of Economy and Innovation, seeking a solution to put an end to the case file backlog.</p>
<p>The Administrative Court of Appeal told BIRN that the only response had come from the Ministry of Economy and Innovation, which indicated that it did not have free and suitable premises for this purpose.</p>
<p>Left without a solution, the Administrative Court of Appeal has sought the support of the European Union Delegation in Tirana, considering the situation unacceptable. It also asked that the High Judicial Council and the responsible government structures be urged to act.</p>
<p>The First Instance Court in Tirana is also in the same conditions. The repeated and ongoing requests for additional premises addressed to the High Judicial Council have not produced a solution.</p>
<p>Likewise, the Ministry of Justice has been asked to make available the building of the Probation Service, which is located near the building of the Criminal Chamber. Meetings have also been held with diplomats from a partner country and with a group of lawmakers from the committee on citizens&#8217; initiatives, but without a concrete result.</p>
<p>The repeated requests of the courts of Lezha, Fier and Saranda have also remained unresolved.</p>
<p>The head of the Lezha Court, Lirim Bulica, told BIRN that their building has only three proper courtrooms, while two others have been improvised in the basement and have only an audio system. He adds that judges&#8217; offices have minimal surface area, while those of the administrative staff are in miserable conditions.</p>
<p>“The basements served as archives, but after a courtroom was set up in the basement, the case files were transferred to the premises of the Kurbin Court. But even those premises will soon be exhausted,” says Bulica.</p>
<p>He stresses that he had sought solutions from the High Judicial Council and the Ministry of Justice, but without any result. Moreover, Bulica says that despite his requests, the Ministry of Justice informed him that it wanted two offices in Kurbin, which would worsen the situation.</p>
<p>The head of the Fier Court, Noel Veizi, also told BIRN that there is an urgent need for a building. His requests to move to the premises of the former UFO university, a building confiscated by the state, have been refused.</p>
<p>The head of the Saranda Court, Entiljano Spahiu, also said that the building&#8217;s current capacities are insufficient for the normal functioning of the court and for providing an adequate service to the public.</p>
<p>“A particular problem is the lack of dedicated premises for the public and lawyers. The building does not have waiting areas or places to stay for citizens who appear for court hearings or to receive administrative services,” said Spahiu.</p>
<p>Unlike other courts, the Court of Appeal of General Jurisdiction received a response from the Council of Ministers, which in March 2025 transferred to it the building of the Large Taxpayers Directorate.</p>
<p>However, there is a problem: the building is unusable due to the damage caused by the 2019 earthquake and is undergoing reconstruction, which is expected to be completed next year.</p>

<p>Such delays can be dangerous for the fate of thousands of case files.</p>
<p>“The accumulation of case files, in addition to difficulties in managing them, increases the risk of damage to documentation and affects the efficiency of handling cases. Furthermore, the circumstances also create security problems, including the risk of fire and obstruction of movement within the institution&#8217;s premises,” the Court of Appeal said in a written response.</p>

<p>The problems with premises also leave the question of security open.</p>
<p>On October 16 last year, Appeal Court judge Astrit Kalaja was shot dead in the courtroom – an unprecedented event that was accompanied by shock and concerns over the security of the judicial system.</p>
<p>A year later, the lack of special passageways for detainees at the Court of Appeal of General Jurisdiction means that the same corridors are used by them, judges and administrative staff.</p>
<p>Security concerns are also raised at the Fier and Saranda courts.</p>
<p>“There is no room in the corridor, and judges, citizens and detainees pass through together. In most cases, when detainees who pose a high social risk have to pass, citizens are taken outside, because the security elements leave much to be desired due to the building&#8217;s premises,” the head of the Fier Court, Noel Veizi, told BIRN.</p>
<p>“Security conditions are at zero level. Not without reason, two attempted murders have been carried out inside the court premises, one targeting a female judge,” he added.</p>

<p>The head of the Saranda Court, Entiljano Spahiu, also complained about the security conditions.</p>
<p>“Its positioning directly exposes the court to the road and public space, while the existing configuration does not allow the creation of the necessary security perimeters and zones,” said Spahiu.</p>
<p>“Likewise, the necessary space is lacking at the entrance for the installation and operation of security control equipment, including the scanner,” he concluded.</p>

										<content:encoded><![CDATA[<p>Harta e re gjyqësore e tre viteve më parë ka përkeqësuar situatën në disa gjykata të vendit, të cilat e kryejnë funksionin në godina të amortizuara dhe të përmbytura nga dosjet gjyqësore, ndërkohë që kërkesat për zgjidhje bien në vesh të shurdhër.</p>
<p>Mëngjesin e së hënës, holli i Gjykatës së Apelit të Juridiksionit të Përgjithshëm në Tiranë është i tejmbushur me njerëz në pritje të proceseve gjyqësore. Të pandehur, familjarë dhe avokatë kalojnë fillimisht përmes kontrollit, për t’u paketuar më pas në sallën e pritjes prej nga njoftohet fillimi i seancave.</p>
<p>E ndërtuar në vitin 1957 për të qenë një rajon policie, godina e vjetër trekatëshe e Gjykatës së Apelit e ka shtrirë juridiksionin e saj në të gjithë Shqipërinë pas miratimit të hartës së re gjyqësore të vitit 2023.</p>
<p>Por në vend që t’u jepte zgjidhje çështjeve të prapambetura, situata në Gjykatën e Apelit është sot në kufijtë e së pamundurës për shkak të mungesës së ambienteve për stafin e dyfishuar dhe dosjet e grumbulluara nga i gjithë vendi.</p>
<p>Korridoret e ngushta të kësaj gjykate janë shndërruar tashmë në labirinthe të mbushura me dosje, të cilat i gjen të stivosura në dollapë, rafte dhe karrige. Në ajër kutërbon aroma e mykut dhe e lagështirës.</p>
<p>Për arsye të mungesës së hapësirave, të gjitha dhomat e këshillimit ku gjyqtarët tërhiqen për të diskutuar dhe marrë vendime janë kthyer në ‘arkiva të përkohshme’ për çështjet në pritje të gjykimit. Gjatë tre viteve të fundit, stoku i dosjeve është rritur nga 33 mijë në 48 mijë.</p>
<p>Nevoja për hapësira e ka detyruar administratën që të gjejë zgjidhje rrethanore; si për shembull ndarjen me kartonxhes të një salle gjykimi, për të krijuar një hapësirë pa dritare si dhomë këshillimi. Por tashmë është krijuar një problem i ri.</p>
<p><em>“Kur futemi në dhomë këshillimi, i nxjerrim jashtë sallës palët që të mos dëgjojnë çfarë diskutojmë</em>”, thotë një gjyqtare në kushtet e anonimatit.</p>
<p>“Nuk ka asnjë masë sigurie. Sado gjyqtar i mirë të jesh, këtu nuk punohet. Duhet të rrinë këtu me ne që ta kuptojnë,” shtoi ajo.</p>
<p>Mungesa e hapësira dhe degradimi i godinave nuk është një problem i izoluar vetëm për Gjykatën e Apelit të Juridiksionit të Përgjithshëm. Sipas të dhënave që BIRN siguroi përmes kërkesave për të drejtë informimi dhe bisedave me drejtues të disa gjykatave, mungesa e ambjenteve është kthyer në pengesë për ushtrimin e funksionit edhe në gjykata të tjera në gjithë vendin.</p>
<p>Sipas tyre, ky nuk është vetëm një problem infrastrukture, por një çështje e administrimit të drejtësisë, rritjes së cilësisë së shërbimeve gjyqësore dhe respektimit të standardeve të një sistemi efikas, të sigurt dhe në shërbim të qytetarëve.</p>
<p>Përballë kësaj situate emergjente, qeveria ofron si zgjidhje premtimet.</p>
<p>Kryeministri Edi Rama prezantoi më 12 shkurt një program për konkursin ndërkombëtar të Qendrës së Drejtësisë – një kompleks për sistemin e drejtësisë, që edhe sipas parashikimeve më optimiste pritet të përfundojë në vitin 2031.</p>
<p>KLGJ dhe Ministria e Drejtësisë nuk iu përgjigj deri në publikimin e këtij shkrimi pyetjeve të BIRN.</p>

<strong>Korridoret e Gjykatës së Apelit janë të bllokuara nga raftet e mbushura me dosje</strong></p>
<p>BIRN mësoi se gjendja e mjerueshme në Gjykatën e Apelit të Juridiksionit të Përgjithshëm përsëritet pothuajse njësoj edhe në Gjykatën Administrative të Apelit Tiranë, Gjykatën e Tiranës si dhe gjykatat e disa rretheve.</p>
<p>Gjykata e Apelit Administrativ ka aktualisht në gjykim mbi 24 mijë çështje, nga të cilat rreth 17 mijë i përkasin atyre të mbartura nga vitet e kaluara. Për uljen e stokut të dosjeve janë punësuar së fundmi 25 ndihmës ligjorë, por nuk ka hapësira për akomodimin e tyre.</p>
<p>Këshilli i Lartë Gjyqësor rrëzoi në korrik të këtij viti një kontratë qiraje prej 11 mijë eurosh në muaj mes Gjykatës Administrative të Apelit dhe kompanisë “Gener 2” për marrjen me qira të një hapësire për akomodimin e dosjeve dhe ndihmësve ligjorë.</p>
<p>Pas këtij vendimi, Gjykata Administrative e Apelit ju drejtua sërish me kërkesë KLGJ-së, Ministrisë së Financave, Ministrisë së Drejtësisë dhe Ministrisë së Ekonomisë e Inovacionit, duke kërkuar një zgjidhje, me qëllim që t’i jepet fund stokut të dosjeve.</p>
<p>Gjykata Administrative e Apelit i tha BIRN se përgjigja e vetme i kishte mbërritur nga Ministria e Ekonomisë dhe Inovacionit, e cila bëri me dije se nuk dispononte ambiente të lira dhe të përshtatshme për këtë qëllim.</p>
<p>E mbetur pa zgjidhje, Gjykata Administrative e Apelit ka kërkuar mbështetjen e Delegacionit të Bashkimit Europian në Tiranë, duke e konsideruar situatën të papranueshme. Ajo kërkoi gjithashtu që të nxiten KLGJ dhe strukturat përgjegjëse të qeverisë për të vepruar.</p>
<p>Edhe Gjykata e Shkallës së Parë në Tiranë gjendet në kushte të njëjta. Kërkesat e herëpashershme e të vazhdueshme për ambjente shtesë, drejtuar KLGJ-së, nuk kanë dhënë zgjidhje.</p>
<p>Po ashtu, i është kërkuar Ministrisë së Drejtësisë që të mundësojë vendosjen në dispozicion të godinës së Shërbimit të Provës, që gjendet pranë godinës së Dhomës Penale. Po ashtu, është zhvilluar takim dhe me diplomatë të një vendi partner, si dhe me një grup deputetësh të komisionit për nisma qytetar, por pa një rezultat konkret.</p>
<p>Pa zgjidhje kanë mbetur edhe kërkesat e përsëritura të gjykatave të Lezhës, Fierit dhe Sarandës.</p>
<p>Kryetari i Gjykatës së Lezhës, Lirim Bulica i tha BIRN se godina e tyre ka vetëm tre salla gjykimi të mirëfillta, ndërkohë që dy të tjera janë sajuar në bodrum dhe disponojnë vetëm sistemin audio. Ai shton se zyrat e gjyqtarëve janë me sipërfaqe minimale, ndërsa ato të stafit administrativ janë me kushte mizerabël.</p>
<p>“Për arkivat kanë shërbyer bodrumet, por pasi u bë një sallë gjyqi në bodrum, u transferuan dosjet në ambjentet e Gjykatës së Kurbinit. Por edhe ambjentet atje do të ezaurohen së shpejti”, thotë Bulica.</p>
<p>Ai thekson se kishte kërkuar zgjidhje në KLGJ dhe në Ministrinë e Drejtësisë, por pa asnjë rezultat. Madje, Bulica thotë se pavarësisht kërkesave të tij, Ministria e Drejtësisë i ka komunikuar se donte dy zyra në Kurbin, ç’ka do ta përkeqësonte gjendjen.</p>
<p>Edhe kreu i Gjykatës së Fierit, Noel Veizi, i tha BIRN se ka nevojë urgjente për një godinë. Kërkesat e tij për t’u transferuar në ambjentet e ish-universitetit UFO, një godinë e konfiskuar nga shteti, janë refuzuar.</p>
<p>Kryetari i Gjykatës së Sarandës, Entiljano Spahiu tha gjithashtu se kapacitetet aktuale të godinës janë të pamjaftueshme për nevojat e funksionimit normal të gjykatës dhe për ofrimin e një shërbimi të përshtatshëm për publikun.</p>
<p>“Një problematikë e veçantë paraqet mungesa e ambienteve të dedikuara për publikun dhe avokatët. Godina nuk disponon ambiente pritjeje apo qëndrimi për qytetarët që paraqiten për seanca gjyqësore ose për marrjen e shërbimeve administrative”, tha Spahiu.</p>
<p>Ndryshe nga gjykatat e tjera, Gjykata e Apelit të Juridiksionit të Përgjithshëm mori një përgjigje nga Këshilli i Ministrave, i cili në mars të vitit 2025 i transferoi asaj godinën e drejtorisë së Tatimpaguesve të Mëdhenj.</p>
<p>Megjithatë, ka një problem; godina është e papërdorshme për shkak të dëmeve të shkaktuara nga tërmeti i vitit 2019 dhe po i nënshtrohet një rikonstruksioni, që pritet të përfundojë vitin e ardhshëm.</p>
<p>Vonesa të tilla mund të jenë të rrezikshme për fatin e mijëra dosjeve.</p>
<p>“Grumbullimi i dosjeve, përveç vështirësive në administrimin e tyre, rrit rrezikun për dëmtimin e dokumentacionit dhe ndikon në efikasitetin e trajtimit të çështjeve. Po ashtu, rrethanat krijojnë edhe problematika të sigurisë, duke përfshirë rrezikun nga zjarri dhe pengimin e lëvizjes në ambientet e institucionit,” tha Gjykata e Apelit në një përgjigje me shkrim.</p>

<strong>Policia shoqëron të pandehurit në Gjykatën e Apelit</strong></p>
<p>Problemet me ambientet lënë gjithashtu të hapur çështjen e sigurisë.</p>
<p>Më 16 tetor të vitit të kaluar, gjyqtari i Apelit, Astrit Kalaja u qëllua për vdekje në sallën e gjyqit – një ngjarje e paprecedentë që u shoqërua me tronditje dhe shqetësime për sigurinë e sistemit gjyqësor.</p>
<p>Një vit më pas, mungesa e kalimeve të posaçme për të paraburgosurit në Gjykatën e Apelit të Juridiksionit të Përgjithshëm bën që të njëjtat korridore të përdoren prej tyre, gjyqtarëve dhe punonjësve të administratës.</p>
<p>Edhe në Gjykatat e Fierit dhe Sarandës ngrihen shqetësime për sigurinë.</p>
<p>“Në korridor nuk ka vend dhe kalojnë gjyqtarët, qytetarët dhe të paraburgosurit së bashku. Në shumicën e rasteve, kur duhet të kalojnë të paraburgosur me rrezikshmëri të lartë shoqërore, qytetarët nxirren jashtë, pasi elementët e sigurisë lënë shumë për të dëshiruar për shkak të ambjenteve të godinës”, tha për BIRN kreu i Gjykatës së Fierit, Noel Veizi.</p>
<p>“Kushtet e sigurisë janë në nivel zero. Jo pa arsye, brenda ambjenteve të gjykatës, janë kryer dy tentativa vrasje, një rast ndaj një gjyqtareje”, shtoi ai.</p>
<p>Edhe kreu i Gjykatës së Sarandës, Entiljano Spahiu u ankua për kushtet e sigurisë.</p>
<p>“Pozicionimi i saj e ekspozon drejtpërdrejt gjykatën ndaj rrugës dhe hapësirës publike, ndërkohë që konfigurimi ekzistues nuk mundëson krijimin e perimetrave dhe zonave të nevojshme të sigurisë”, tha Spahiu.</p>
<p>“Po ashtu, mungon hapësira e nevojshme në hyrje për instalimin dhe funksionimin e pajisjeve të kontrollit të sigurisë, përfshirë skanerin”, përfundoi ai.</p>

<p>On the morning of September 22, the State Police conducted a search of a complex of fortified villas on the outskirts of Durrës, suspected to have served as Ergys Agasi’s hideout while he was on the run.</p>
<p>SPAK said the operation was carried out on the basis of a decision by the Special Court and was part of a broader investigation into several senior officials suspected of communicating with Agasi or helping him evade arrest.</p>
<p>Those included in the decision on security measures or searches are the head of the State Intelligence Service, Vlora Hyseni; former State Police Director Ilir Proda; and Fatjon Kalluçi, an official at the Institute of Forensic Police.</p>
<p>The complex is located near the intersection with “Durrësi në Shekuj” Street, in the Shkozet area. It consists of several buildings surrounded by high concrete walls, sealed windows and climbing vegetation extending up to the upper floors.</p>
<p>Two people familiar with the investigation told BIRN, on condition of anonymity, that the villas where Agasi is suspected of having stayed, equipped with extensive security measures, are controlled by the “Troplini” clan, regardless of the names under which the properties are registered.</p>
<p>The Special Prosecution Office describes the “Troplini” group as one of the most dangerous organized crime organizations in Albania. According to this assessment, its activities also extend to Italy, Germany, the Netherlands and countries in Latin America.</p>
<p>On May 21, 2025, SPAK announced that it had dismantled an international drug-trafficking organization based in Durrës. One of its leaders was Elvis Doçi, who evaded arrest and was declared wanted.</p>
<p>Doçi, known as “Visi i Pojës,” has family ties to Xhevdet Troplini. The latter was investigated by Italian justice authorities in the mid-2000s for suspected involvement in drug trafficking, while no charges have been brought against him in Albania.</p>
<p>Ergys Agasi, 39, was declared wanted in December last year on suspicion of involvement in organized crime in the scandal surrounding the National Agency of Information Society, AKSHI. He was arrested eight months later, on August 26, in the Plepat area of Durrës, while returning from Elbasan, where he had stayed for several hours.</p>
<p>Evidence gathered during the investigation shows that, during the months he was on the run, Agasi moved freely from his hiding place and continued contacts with people from the world of organized crime and state officials, mainly in Durrës, Tirana and Elbasan.</p>
<p>Sources familiar with the case told BIRN that although the authorities frequently received information about Agasi’s whereabouts, the operation to arrest him began only after a series of changes in the police leadership, which followed Ilir Proda’s removal as State Police director.</p>
<p>Suspicions regarding secret service chief Vlora Hyseni’s involvement in protecting Agasi during his stay at the Troplini group’s complex have expanded the scale of the scandal.</p>
<p>The case has raised serious questions about the functioning of one of the country’s main security institutions and the relationships between senior officials and people linked to organized crime.</p>
<p>Information from the investigative file published in the media shows that, from June to August of this year, more than 500 phone calls, audio and video recordings, and messages were recorded between Hyseni and Agasi.</p>
<p>In these communications, she is suspected of being directly involved in supporting Agasi’s interests before the justice institutions investigating him.</p>
<p>Hyseni is suspected not only of being willing to help Agasi, but also of placing her official status and the capacities of the institution she headed at his disposal.</p>
<p>Messages published in the media suggest that Hyseni, in a serious breach of duty, informed Agasi about her meetings with Prime Minister Rama, senior state officials and foreign counterparts.</p>
<p>Meanwhile, nine large printouts containing diagrams and data similar to materials produced by the State Intelligence Service were found in a vehicle belonging to Agasi that was seized in July. These documents are still being verified.</p>
<p>During her testimony before the Prosecutor’s Office, Hyseni stated that she had communicated with Agasi after he presented himself as a “collaborator.” SPAK has disputed this version.</p>
<p>SPAK’s investigation into Ergys Agasi suggests that he exerted influence over several senior officials in key institutions. Former Deputy Prime Minister Arben Ahmetaj, who is on the run, has publicly accused Agasi of acting as “a coordinator” between the world of organized crime and the government led by Prime Minister Edi Rama.</p>

<p>Dy persona të njohur me hetimin i thanë BIRN, në kushte anonimiteti, se vilat ku dyshohet se qëndronte Agasi, të pajisura me masa të forta sigurie, kontrollohen nga klani “Troplini”, pavarësisht emrave në të cilët janë regjistruar pronat.</p>
<p>Prokuroria e Posaçme e cilëson grupin “Troplini” si një nga organizatat më të rrezikshme të krimit të organizuar në Shqipëri. Sipas këtij vlerësimi, veprimtaria e tij shtrihet edhe në Itali, Gjermani, Holandë dhe në vendet e Amerikës Latine.</p>
<p>Më 21 maj 2025, SPAK njoftoi se kishte goditur një organizatë ndërkombëtare të trafikut të drogës me bazë në Durrës. Një prej drejtuesve të saj ishte Elvis Doçi, i cili i shpëtoi arrestimit dhe u shpall në kërkim.</p>
<p>Doçi, i njohur si “Visi i Pojës”, ka lidhje familjare me Xhevdet Troplinin. Ky i fundit ishte hetuar nga drejtësia italiane në mesin e viteve 2000 për përfshirje të dyshuar në trafikun e drogës, ndërsa në Shqipëri nuk është ngritur asnjë akuzë ndaj tij.</p>
<p>Ergys Agasi, 39 vjeç, u shpall në kërkim në dhjetor të vitit të kaluar për dyshime mbi përfshirjen në krim të organizuar në skandalin e Agjencisë Kombëtare të Shoqërisë së Informacionit, AKSHI. Arrestimi i tij u krye tetë muaj më vonë, më 26 gusht, në zonën e Plepatit në Durrës, kur po kthehej nga Elbasani, ku kishte qëndruar për disa orë.</p>
<p>Provat e mbledhura gjatë hetimit tregojnë se, në muajt e arratisë, Agasi kishte lëvizur lirshëm nga vendi ku fshihej dhe kishte vijuar kontaktet me persona të botës së krimit të organizuar dhe funksionarë shtetërorë, kryesisht në Durrës, Tiranë dhe Elbasan.</p>
<p>Burime të informuara mbi çështjen thanë për BIRN se, edhe pse autoritetet merrnin shpesh të dhëna për vendndodhjen e Agasit, aksioni për arrestimin e tij nisi vetëm pas një sërë ndryshimesh në drejtimin e policisë, të cilat pasuan largimin e Ilir Prodës nga posti i drejtorit të Policisë së Shtetit.</p>
<p>Dyshimet për përfshirjen e shefes së shërbimit sekret, Vlora Hyseni, në mbrojtjen e Agasit gjatë qëndrimit të tij në kompleksin e grupit Troplini e kanë zgjeruar përmasën e skandalit.</p>
<p>Rasti ka ngritur pikëpyetje të forta mbi funksionimin e një prej institucioneve kryesore të sigurisë në vend dhe marrëdhëniet mes zyrtarëve të lartë dhe personave të lidhur me krimin e organizuar.</p>
<p>Të dhënat e dosjes hetimore të publikuara në media tregojnë se nga qershori deri në gusht të këtij viti, mes Hysenit dhe Agasit janë regjistruar mbi 500 komunikime telefonike, audio, video dhe mesazhe.</p>
<p>Në këto komunikime, ajo dyshohet se shfaqet drejtpërdrejt e angazhuar në mbështetje të interesave të Agasit përballë institucioneve të drejtësisë që po e hetonin.</p>
<p>Hyseni dyshohet jo vetëm se ishte e gatshme ta ndihmonte Agasin, por edhe se i vuri në dispozicion atij statusin e saj zyrtar dhe kapacitetet e institucionit që drejtonte.</p>
<p>Mesazhet e publikuara në media lënë të kuptohet se Hyseni, në shkelje të rëndë të detyrës, e njoftonte Agasin për takimet e saj me kryeministrin Rama, zyrtarë të lartë të shtetit dhe homologë të huaj.</p>
<p>Ndërkohë, në një automjet të Agasit të sekuestruar në korrik u gjetën nëntë printime të mëdha me diagrame dhe të dhëna të ngjashme me materialet që prodhohen nga Shërbimi Informativ i Shtetit. Këto dokumente janë ende në proces verifikimi.</p>
<p>Gjatë dëshmisë së saj në Prokurori, Hyseni ka deklaruar se kishte komunikuar me Agasin pasi ai ishte paraqitur si “bashkëpunëtor”. SPAK e ka kundërshtuar këtë version.</p>
<p>Hetimi i SPAK ndaj Ergys Agasit sugjeron se ai ushtronte ndikim te disa zyrtarë të lartë të institucioneve kyçe. Ish-zv.kryeministri Arben Ahmetaj, i cili është në arrati, e ka akuzuar publikisht Agasin se vepronte si “një koordinatori” mes botës së krimit të organizuar dhe qeverisë së drejtuar nga kryeministri Edi Rama.</p>

<p>Three years ago, Prime Minister Edi Rama dismissed the questions raised by the opposition about the appointment of Vlora Hyseni as head of SHISH. After she was placed under house arrest at SPAK’s request, he insists that the responsibility is individual.</p>
<p>From New York, where he was attending the UN General Assembly, Prime Minister Edi Rama reacted to the house arrest measure against SHISH director Vlora Hyseni, emphasizing that her case is individual and must be left to justice.</p>
<p>He reiterated the principle of presumption of innocence, refused to comment on the merits of the investigation, and announced Hyseni’s immediate release from duty.</p>
<p>Rama also criticized what he described as the way such cases turn into public trials by the media before there is a court ruling.</p>
<p><em>“It seems inevitable that every investigation or measure taken by the justice system against public figures becomes a pretext for tearing human flesh apart in the political and media square and for calling for the ‘noose’ as in medieval execution grounds, long before the court has its say,”</em> he wrote on the social media platform ‘X’.</p>
<p>But beyond Hyseni’s criminal responsibility, which remains to be determined by the justice system, Rama’s reaction left another issue unaddressed: his own political responsibility for selecting and proposing her.</p>
<p>In 2023, the prime minister presented Hyseni’s experience and reputation as a “full guarantee” for leading SHISH, while labeling the questions raised by the opposition about her professional past as “the gossip of our political and media village.”</p>
<p>The director of the State Intelligence Service, Vlora Hyseni, was suspended from duty by order of the Special Court against Corruption and Organized Crime and placed under “house arrest” on Tuesday, triggering one of the gravest crises in the national security sector in recent decades.</p>
<p>Hyseni is accused by the Special Prosecution Office of the criminal offenses of supporting the perpetrator of a crime and disclosing state or service secrets.</p>
<p>The security measures against the SHISH director stem from the investigation that the Special Prosecution Office is conducting into Ergys Agasi, a former official at the Ministry of Environment, accused of forming a structured criminal group to manipulate tenders of the National Agency for Information Society, AKSHI.</p>
<p>Article 92, point f, of the Constitution clearly stipulates that the proposal for appointing the SHISH Director is made by the Prime Minister, while the appointment is formalized by decree of the President of the Republic.</p>
<p><em>“In this sense, the political responsibility for selecting and proposing Hyseni undoubtedly belongs to the Prime Minister,”</em> says lawyer and civil society activist Gentian Serjani.</p>
<p>According to him, before the proposal Rama should have carried out the necessary verifications even regarding the earlier circumstances of Hyseni’s career in Kosovo and assessed whether there were elements requiring additional clarification.</p>
<p>Serjani argues that Rama’s claim that Hyseni’s criminal responsibility is personal does not close the debate on the political responsibility for the choice.</p>
<p><em>“A official’s personal responsibility for his or her actions does not exclude the political responsibility of the authority that selected and proposed that official for a high state office,”</em> he said.</p>
<p>Illustrating the case through a sporting analogy, Serjani said it is as if <em>“a player plays badly, even sells the match, and the coach refuses to take him out of the game and justifies himself with the reasoning that only the player bears the responsibility for the loss.”</em></p>
<p>Sociologist and political analyst Ergys Mërtiri links Rama’s responsibility not only to the choice of Hyseni, but also to the way control and verification mechanisms work for heads of security institutions.</p>
<p><em>“The head of the secret services is not just any position, as it is linked to national security and here people with a high level of reliability must be chosen,”</em> he said.</p>
<p>But, according to Mërtiri, the problem is not just the wrong choice.</p>
<p><em>“The case also tells us about the state of the institutions that guarantee security in the country, for which the Prime Minister is certainly the chief responsible,”</em> he said.</p>
<p><em>“If the head of this institution turns out to be in such a close and obvious connection with exponents of organized crime and no one in this state knows anything or reports anything, that shows the state as a whole is in a catastrophic condition,”</em> Mërtiri added.</p>
<p>According to Mërtiri, the stance that responsibilities are individual and that the Prime Minister has no responsibility for those who commit criminal acts behind his back, now turned into a refrain for dozens upon dozens of cases of senior officials under investigation for criminal acts, is “utterly banal.”</p>
<p><em>“He is totally politically responsible for the fact that he chooses so many corrupt people and that he has seen nothing of their wrongdoings, even though they were so visible and flagrant,”</em> he said.</p>
<p><em>“In this specific case, Edi Rama is certainly politically responsible for endangering the country’s national security by putting at the head of the intelligence service a person so irresponsible that she places SHISH at the service of the head of a criminal group,”</em> Mërtiri emphasized.</p>
<p>Journalist and political analyst Lutfi Dervishi formulates Rama’s political responsibility through three questions: what did the prime minister know, what should he have known, and what did he do when the signals appeared.</p>
<p>According to him, the Hyseni case goes beyond individual criminal responsibility, because for the first time the sitting head of the State Intelligence Service is placed under house arrest and suspended/dismissed from duty, on suspicion of disclosing state secrets and supporting the perpetrator of a crime.</p>
<p><em>“The head of SHISH does not fall from the sky,”</em> Dervishi said. <em>“The prime minister has the political obligation to explain not what Hyseni did or did not do criminally, but how the political control and oversight of the most sensitive institution of national security has functioned.”</em></p>
<p>For Dervishi, the way Hyseni came to head SHISH raises questions, because she was not elevated through a career within the Albanian service, but came from the Kosovo Intelligence Agency, where she had served as deputy director and acting head.</p>
<p><em>“When the signals existed, who verified them and what measures were taken?”</em> – he asks, noting that SHISH had also functioned without a deputy director – an important link in the institution’s hierarchy.</p>
<p><em>“Political responsibility begins precisely with the obligation to explain the choice, the oversight, the reaction to signals, and the guarantees that such a situation has not jeopardized national security,”</em> Dervishi concluded./BIRN</p>

<p>Nga Nju Jorku, ku ndodhej për Asamblenë e Përgjithshme të OKB-së, kryeministri Edi Rama reagoi ndaj masës së arrestit shtëpiak për drejtoreshën e SHISH-it, Vlora Hyseni, duke theksuar se çështja e saj është individuale dhe duhet t’i lihet drejtësisë.</p>
<p>Ai përsëriti parimin e prezumimit të pafajësisë, refuzoi të komentonte mbi meritën e hetimit dhe njoftoi lirimin e menjëhershëm të Hysenit nga detyra.</p>
<p>Rama kritikoi gjithashtu mënyrën se si raste të tilla, sipas tij, shndërrohen në gjykime publike nga media, përpara se të ketë një vendim gjykate.</p>
<p><em>“Është e pashmangshme mesa duket, që çdo hetim apo masë e marrë nga drejtësia në adresë të personave publikë, të kthehet në një motivim për të grirë mish njeriu në mexhelisin politik e mediatik dhe për të thirrur ‘litarin’ si në sheshet e ekzekutimit mesjetar, kohë përpara sesa gjykata të thotë fjalën e saj”</em>, deklaroi në rrjetin social ‘X’.</p>
<p>Por, përtej përgjegjësisë penale të Hysenit, e cila mbetet për t’u përcaktuar nga drejtësia, reagimi i Ramës la pa adresuar një çështje tjetër: përgjegjësinë e tij politike për përzgjedhjen dhe propozimin e saj.</p>
<p>Në vitin 2023, kryeministri e paraqiti eksperiencën dhe reputacionin e Hysenit si një “garanci të plotë” për drejtimin e SHISH-it, ndërsa pikëpyetjet e ngritura nga opozita për të kaluarën e saj profesionale i cilësoi si “thashethemet e katundit tonë politik dhe mediatik”.</p>
<p>Drejtoresha e Shërbimit Informativ të Shtetit, Vlora Hyseni, u pezullua nga detyra me vendim të Gjykatës së Posaçme kundër Korrupsionit dhe Krimit të Organizuar dhe u vendos nën masën e “arrestit në shtëpi” të martën, duke shkaktuar një nga krizat më të rënda të sektorit të sigurisë kombëtare në dekadat e fundit.</p>
<p>Hyseni akuzohet nga Prokuroria e Posaçme për veprat penale të përkrahjes së autorit të krimit dhe nxjerrjes së sekretit shtetëror ose të shërbimit.</p>
<p>Masat e sigurisë ndaj drejtoreshës së SHISH-it burojnë nga hetimi që Prokuroria e Posaçme po zhvillon ndaj Ergys Agasit, një ish-zyrtar i Ministrisë së Mjedisit, i akuzuar për krijimin e një grupi të strukturuar kriminal me qëllim manipulimin e tenderëve të Agjencisë Kombëtare të Shoqërisë së Informacionit, AKSHI.</p>
<p>Neni 92, pika f, i Kushtetutës përcakton qartë se propozimi për emërimin e Drejtorit të SHISH-it bëhet nga Kryeministri, ndërsa emërimi formalizohet me dekretimin nga Presidenti i Republikës.</p>
<p><em>“Në këtë kuptim, përgjegjësia politike për përzgjedhjen dhe propozimin e Hysenit padyshim që i takon Kryeministrit”</em>, shprehet avokati dhe aktivisti i shoqërisë civile Gentian Serjani.</p>
<p>Sipas tij, përpara propozimit, Rama duhej të kishte kryer verifikimet e nevojshme edhe mbi rrethanat e mëparshme të karrierës së Hysenit në Kosovë dhe të vlerësonte nëse kishte elementë që kërkonin sqarime shtesë.</p>
<p>Serjani argumenton se pohimi i Ramës se, përgjegjësia penale e Hysenit është personale nuk e mbyll debatin mbi përgjegjësinë politike për zgjedhjen.</p>
<p><em>“Përgjegjësia personale e një zyrtari për veprimet e tij nuk e përjashton përgjegjësinë politike të autoritetit që e ka përzgjedhur dhe propozuar atë për një detyrë të lartë shtetërore”,</em> tha ai.</p>
<p>Duke ilustruar rastin përmes një analogjie sportive, Serjani tha se është njësoj sikur <em>“një lojtar të luajë keq, madje edhe të shesë ndeshjen, dhe trajneri të refuzojë ta nxjerrë nga loja dhe të justifikohet me arsyetimin se përgjegjësinë për humbjen e mban vetëm lojtari”.</em></p>
<p>Sociologu dhe analisti politik Ergys Mërtiri e lidh përgjegjësinë e Ramës jo vetëm me zgjedhjen e Hysenit, por edhe me mënyrën se si funksionojnë mekanizmat e kontrollit dhe verifikimit për drejtuesit e institucioneve të sigurisë.</p>
<p><em>“Kreu i shërbimeve sekrete nuk është një pozicion çfarëdo, pasi lidhet me sigurinë kombëtare dhe këtu do të duhet të zgjidhen njerëz me nivel të lartë besueshmërie”</em>, tha ai.</p>
<p>Por, sipas Mërtirit, problemi nuk qëndron vetëm te zgjedhja e gabuar.</p>
<p><em>“Rasti na flet gjithashtu edhe për gjendjen e institucioneve që garantojnhë sigurinë në vend, për çfarë gjithashtu Kryeministri është patjetër përgjegjësi kryesor”</em>, tha ai.</p>
<p><em>“Në se kreu i këtij institucioni rezulton në një lidhje kaq të ngushtë dhe kaq të dukshme me eksponentë të krimit të organizuar dhe askush në këtë shtet nuk di dhe nuk raporton gjë, kjo tregon se shteti në tërësi është në gjendje katastrofike”,</em> shtoi Mërtiri.</p>
<p>Sipas Mërtirit, qëndrimi se përgjegjësitë janë individuale dhe se Kryeministri nuk ka përgjegjësi për ata që kryejnë vepra penale pas shpinës së tij, i shndërruar tashmë në refren për dhjetëra e dhjetëra raste funksionarësh të lartë në hetim për vepra kriminale, është “krejtësisht banal”.</p>
<p><em>“Ai është totalisht përgjegjës politikisht për faktin se zgjedh kaq shumë njerëz të korruptuar dhe se nuk ka parë asgjë nga zullumet e tyre, megjithëse kanë qenë kaq të dukshme dhe flagrante</em>”, tha ai.</p>
<p><em>“Në rastin konkret, Edi Rama është patjetër përgjegjës politikisht për faktin se ka kërcënuar sigurinë kombëtare të vendit duke vendosur në krye të shërbimit informativ një person kaq të papërgjegjshëm sa vendos SHISH-in në shërbim të kreut të një grupi kriminal</em>”, theksoi Mërtiri.</p>
<p>Gazetari dhe analisti politik Lutfi Dervishi, e formulon përgjegjësinë politike të Ramës përmes tri pyetjeve: çfarë dinte kryeministri, çfarë duhej të dinte dhe çfarë bëri kur u shfaqën sinjalet.</p>
<p>Sipas tij, rasti i Hysenit shkon përtej përgjegjësisë penale individuale, pasi për herë të parë drejtuesja e Shërbimit Informativ të Shtetit në detyrë vendoset nën masën e arrestit në shtëpi dhe pezullohet/shkarkohet nga detyra, me dyshimin për nxjerrjen e sekretit shtetëror dhe përkrahjen e autorit të një krimi.</p>
<p><em>“Drejtuesi i SHISH-it nuk vjen nga qielli”,</em> tha Dervishi.<em> “Kryeministri ka detyrimin politik të shpjegojë jo çfarë ka bërë apo nuk ka bërë penalisht Hyseni, por si ka funksionuar kontrolli dhe mbikëqyrja politike e institucionit më sensitiv të sigurisë kombëtare”.</em></p>
<p>Për Dervishin, mënyra se si Hyseni erdhi në krye të SHISH-it ngre pikëpyetje, pasi ajo nuk u ngrit përmes një karriere brenda shërbimit shqiptar, por erdhi nga Agjencia Kosovare e Inteligjencës, ku kishte shërbyer si zëvendësdrejtore dhe drejtuese e përkohshme.</p>
<p><em>“Kur sinjalet ekzistonin, kush i verifikoi dhe çfarë masash u morën”</em>? &#8211; pyet ai, duke vënë në dukje se SHISH-i kishte funksionuar gjithashtu pa një zëvendësdrejtor – një hallkë e rëndësishme në hierarkinë e institucionit.</p>
