Tahiraj criticizes statement on the Special Court and seeks explanations from the LDK over Besian Mustafa

The Assembly of Kosovo approved, at its first plenary session, a statement concerning the verdict of the Special Court in The Hague against four former KLA leaders.

Through this document, the members of parliament described as unacceptable the conclusion that a common criminal purpose had existed among the four defendants.

Activist Saim Tahiraj called it paradoxical that the Assembly, which voted to establish the Special Court, is now opposing one of its decisions. In a statement to “Bota sot,” he raised concerns about respect for the separation of powers and the message that, in his view, this position conveys to the international community.

“The Assembly of Kosovo today approved a statement against the decision of the first-instance chamber of the Special Court in The Hague, which handed down sentences against four people accused of war crimes. Such an action constitutes an extraordinary paradox.

The same institution that, together with our international friends, voted to establish this court is now opposing one of its decisions. These friends helped us liberate our country and build our state.

Where is human morality in this case? It seems we cannot speak of political morality, since it disappeared long ago.

The situation becomes even more paradoxical when those who take such action repeat that the branches of power are separate and that justice must not be influenced by anyone.

What happened in the Assembly today, and what message was sent to the world? How can a political institution take a position against a judicial decision while claiming at the same time that it respects the separation of powers?

Undignified members of parliament may say that this does not constitute interference in justice, but citizens have the right to judge for themselves what happened,” Tahiraj said.

He also criticized the LDK for removing MP Besian Mustafa from the session and called for an explanation of what message this action conveyed.

According to Tahiraj, responsibility for the crimes must be determined individually, while Kosovo’s liberation war should not be defended through political interference by the Assembly, but through truth and justice.

“LDK MPs must also answer another question: Why was Besian Mustafa, the son of Xhemajl Mustafa, removed from the Assembly meeting? What message did this send, and why did he not remain in the hall? These are issues that require answers.

May shame cover you! With what face will you ask citizens for their votes tomorrow, when through your actions you are losing them today?

The greatest paradox lies in the fact that, while the Special Court is conducting proceedings to determine individual responsibility for the alleged crimes committed during the war, the people’s representatives are attempting to politically defend one side against a court decision.

The KLA and Kosovo’s liberation war do not need political protection from the Assembly. They require truth and justice.

Crime has a name, and responsibility must be individual, while the struggle for Kosovo’s liberation is an entirely different matter. Shame on you,” Tahiraj concluded.
