SPAK closes investigations / Trial begins for Ervis Martinaj and nine others for murder and structured criminal group

The Special Anti-Corruption and Organized Crime Structures have closed the investigation phase for criminal proceedings number 9/2 of 2023. The file, which contains serious charges, has been sent to the court for review, indicting ten citizens.

The defendants sent for trial are: Ervis Martinaj, Denis Brajović, Klaodor Hakaj, Prekë Kodra, Aleks Ndreka, Nuredin Dumani, Eljon Hato, Arsad Bashli, Bardhyl Mavraj and another person. For each of them, the Prosecution has raised detailed charges related to crimes committed as part of a criminal organization.

Ervis Martinaj faces a series of serious offenses. First, he is accused of the premeditated murder of citizen Gjin Ndoj (Borici), which was carried out on August 9, 2020 in Shkodër, an event committed in the form of special cooperation within a structured criminal group. Also, he is charged with providing the conditions and material means to take the life of Kleant Musabelliu, a crime conceived as part of the same group. In addition, Martinaj is also accused of production and illegal possession of weapons, always within the framework of the criminal formation. The criminal offenses are provided for by articles 78/2, 28/4, 333/a/1, 334, 80 and 278/1 of the Criminal Code.

Denis Brajović holds the same responsibilities for the murder of Gjin Ndoj, for which he is investigated as a participant in the group that carried it out on August 9, 2020 in Shkodër. He is also accused of attempting to kill Dorian Duli and Ibrahim Lici, by securing the conditions and means for this act, always in cooperation with the criminal structure. He also faces charges for illegal weapons possession and production within the context of the group. The criminal offenses for him are listed under articles 78/2, 28/4, 333/a, 334, 80 and 278 of the Criminal Code.

Klaodor Hakaj is accused of involvement in the preparation of the murder of Kleant Musabelliu, an offense committed in the form of special cooperation and participation in a criminal group, provided for by articles 80, 28/4, 333/a/1 and 334 of the Criminal Code.

For the same offense, i.e. securing the conditions for the murder of Dorian Duli and Ibrahim Lici within the framework of the structured group, three other persons are also accused: Prekë Kodra, Aleks Ndreka and Nuredin Dumani. All three face charges provided for by articles 80, 28/4, 333/a/1 and 334 of the Criminal Code.

A separate file consists of charges against Eljon Hato and Arsad Bashli. Both are investigated for the attempted premeditated murder of citizen Tauland Pepa, an event that occurred on February 21, 2021 in Shkodër and committed in cooperation. Simultaneously, they are accused of illegal possession and production of weapons and ammunition, as well as active corruption towards judges, prosecutors and other justice officials. These offenses are provided for by articles 78, 22, 25, 278, 319 and 25 of the Criminal Code.

Finally, Bardhyl Mavraj is also accused of active corruption towards justice officials in cooperation, as well as providing material conditions to take the lives of Dorian Duli and Ibrahim Lici, as part of the structured criminal group. Articles 319, 25, 80, 28/4, 333/a and 334 of the Criminal Code apply to him.

The official announcement emphasizes that during the investigative actions, other possible collaborators and persons implicated in criminal activities have emerged. For this part, the prosecution has decided to separate the case, which is currently in the preliminary investigation phase.
