PDK Vows to Defend the Constitutional Order by All Means During the Formation of New Institutions

The Democratic Party of Kosovo (PDK) has expressed concern over the situation that has arisen during the process of constituting the Assembly, describing it as a violation of the constitutional order and the rules governing the functioning of institutions.

According to the party, the Assembly must complete its constitution within 30 days of the certification of the election results.

In a Facebook post, PDK stated that the Constitutional Court had clearly interpreted this deadline, specifying that it relates not only to the start of the procedures but also to the completion of the Assembly’s constitution within 30 days.

The party has also raised the issue of compliance with the Assembly’s Rules of Procedure. It emphasized that, until the constitutive session is concluded with the election of the speaker and deputy speakers, any adjournment of the session may not last longer than 48 hours.

The Constitution clearly stipulates that the constitution of the Assembly must be completed within 30 days of the certification of the election results.

The Constitutional Court has further clarified this obligation: the 30-day period is not intended solely for initiating the process; the constitution of the Assembly must be completed within that period.

The Assembly’s Rules of Procedure stipulate that, until the constitutive session is concluded with the election of the speaker and deputy speakers, its adjournments may not exceed 48 hours.

The 30-day deadline has expired without the Assembly being constituted, while now, according to PDK, the rule setting a 48-hour limit on adjournments is also being disregarded.

The Constitution is not advice, court judgments are not optional, and the rules must be followed by everyone, including those in power.

PDK described the situation as a suspension of and direct attack on the Republic’s constitutional order, declaring that it would defend it by all means.
