Lawyer Gent Gjini calls for prosecution and an international arrest warrant for Ivica Dačić

Prizren lawyer Gent Gjini has drafted a criminal complaint against Serbian Deputy Prime Minister Ivica Dačić over his statements about reoccupying Kosovo and raising the Serbian flag in Prizren. The submission to the Special Prosecution of the Republic of Kosovo also calls for an international arrest warrant to be issued for the politician.

The document, dated October 12, 2026, and obtained by kp, says Gjini alleges that Dačić’s words constitute a direct threat to Kosovo’s security and constitutional order.

The complaint cites Dačić’s statements that Serbia will reoccupy Kosovo and that its flag will one day fly in Prizren. According to the lawyer, these comments, made at an election rally in Serbia, have alarmed Kosovo’s citizens and reflect Belgrade’s territorial claims.

The document also says Dačić declared that it was their duty to respect everything former Serbian President Slobodan Milošević had done. Gjini says such positions could incite hatred and endanger security in Kosovo.

“The extreme, radical nationalist statements of this deputy prime minister undoubtedly incite the cleansing of the Albanian people and ‘reiterate what Serbia has never abandoned: its project of ethnic cleansing of Albanians,’” the complaint says.

Gjini is calling for criminal proceedings against Dačić, arguing that his statements contain elements of the criminal offense of inciting division and intolerance. The submission cites Article 141 of Kosovo’s Criminal Code, which addresses this offense.

In addition to prosecution, the lawyer is calling for INTERPOL mechanisms and cooperation with the authorities of friendly countries to be used to issue an international arrest warrant for Dačić.

According to Gjini, the authorities should take into account the Serbian politician’s official position and the possibility that he could travel to various countries in Europe. In his reasoning, the lawyer describes Dačić as a potential threat to the security of the Republic of Kosovo and urges the justice institutions to respond to rhetoric he characterizes as chauvinistic and threatening.

The complaint also refers to a response by Michael Roth, a former German minister for Europe, who criticized Dačić’s comments about the Serbian flag in Prizren.

“Poor Serbia! Ivica Dačić wants the Serbian flag to fly over Prizren. Territorial claims against a neighbor leave me speechless,” Roth was quoted as writing. He said such positions are moving Serbia further away from European integration.

The document was signed by lawyer Gent Gjini and is dated October 12, 2026. However, the material obtained does not confirm whether the complaint was officially submitted and registered with the Special Prosecution, or whether the prosecution has taken any action on the request.
