Kosovo Judicial Council schedules its 371st meeting for Thursday; issue of resignations by Serbian judges and staff returns to agenda

The Kosovo Judicial Council (KJC) will hold its 371st meeting on Thursday, following two previous meetings that were unsuccessful, scheduled for July 24 and August 7, 2026.

The agenda published for this meeting contains 35 items. They include the election of the deputy chairperson, consideration of the request from the Acting President, as well as notifications from judges and staff members from the Serbian community regarding the withdrawal of their resignations. A competition for the position of President of the Basic Court in Ferizaj is also expected to be opened, reports “Betimi për Drejtësi.”

On June 19, 2026, Acting President Albulena Haxhiu sent a letter to KJC Chairperson Rrustem Thaqi, requesting that the Council decide on the resignations submitted by judges and support staff from the Serbian community in Kosovo’s judicial system.

The letter emphasized that leaving these positions unfilled for such a long time undermines legal certainty, makes the full functioning of the justice system more difficult, and affects the efficiency of the responsible institutions.

Meanwhile, at its meeting on July 20, 2026, the Kosovo Prosecutorial Council rejected the withdrawal of the resignations of Serbian prosecutors and their support staff in the prosecutorial system. The KPC forwarded the cases to the Acting President for their dismissal from office.

One day later, on July 21, Haxhiu announced that she had signed the decrees dismissing seven Serbian prosecutors who had submitted their resignations in 2022.

The European Union has assessed that the actions of the KPC and Haxhiu are contrary to the law.

In its reaction, the EU expressed concern over the KPC’s decision to accept the resignations, even though they had been withdrawn, as well as over the decision of the Acting President to decree them. According to the EU, these actions appear not to comply with the law, due process, and the general requirements for the rule of law in Kosovo. The EU called on the relevant institutions to avoid actions that could hinder the reintegration of Kosovo’s Serbian judicial personnel.
