Kosovo Assembly gives Vlora Spanca another term as auditor general

Vlora Spanca has been re-elected by the Kosovo Assembly as Kosovo’s auditor general, receiving a new five-year mandate.

The proposal was approved with 62 votes from majority lawmakers, while the manner in which she was nominated was challenged by Alliance MP Burim Ramadani.

Ramadani said that appointing Spanca without holding a competitive process constituted a violation of the law.

According to him, legal provisions stipulate that the president must submit the nomination only after the completion of a competitive process. He also warned that he would file a criminal complaint, as he considers the case to constitute a violation of official duty by Haxhiu as well.

“The main problem concerns the legal requirement to hold a competitive process. The Law on the Auditor General and the NAO clearly and mandatorily stipulates that the president’s proposal must be made following an open, transparent and competitive procedure administered by a non-political commission. The documentation submitted to Parliament shows that this procedure was not followed. I also checked the Presidency’s website and found no notice of a competition. This requirement of the law is neither optional nor advisory; it is mandatory. Consequently, proposing an auditor general without a competition constitutes a clear legal violation,” Ramadani said.

Haxhiu said that the nomination would not be withdrawn and asked Ramadani to refer the matter to the Special Prosecution if he had allegations of violations.

“The proposal remains in force, and the final decision rests with the Assembly of the Republic of Kosovo. Before the matter came before the Assembly, you should have filed the criminal complaint with the Special Prosecution. If you have not yet done so, I encourage you to take this step. As for the legal aspect, I assume responsibility,” Haxhiu declared.
