KEK clarifies: Agreement with JSC ESM concerns only the sale of coal

The Kosovo Energy Corporation (KEK) has rejected claims that the contract signed with JSC ESM for the sale of coal involves the concession of its coal, mines, assets or resources.

According to the corporation’s clarification, the agreement has a single purpose: the sale of coal. The agreed price is 24.4 euros per tonne, excluding VAT, while the contract is valid for 36 months and may reach a value of up to 73.2 million euros.

“The contract contains no provision for a concession over KEK’s coal, mines, assets or resources. Its purpose is clear: THE SALE OF COAL,” KEK said in its response.

The corporation announced that the contract, together with the tender dossier, has been published on the E-Procurement platform of the Public Procurement Regulatory Commission, where all interested parties can review and verify it.

KEK also clarified that the sale will be made directly to the end user, without the involvement of intermediaries.

Meanwhile, the corporation has not assumed responsibility for the excavation, transportation and logistical activities related to the removal of the coal.

“This separates the implementation of the contract from the corporation’s operational processes and ensures that the sale of this quantity of coal does not affect mining operations, the supply of coal to power plants or domestic electricity production,” the response further stated.

KEK stressed that supplying the power plants remains an “absolute priority.” In this context, it described presenting the agreement as a concession as unfounded and incompatible with the document’s actual content.

“Transparency is an obligation. The facts can be verified. The contract is public. There is no concession in the contract,” the response from the Kosovo Energy Corporation concluded.
