J.R. Remanded in Custody for One Month on Suspicion of War Crimes

The Basic Court in Pristina, specifically its Special Department, has approved the request of the Special Prosecution Office of the Republic of Kosovo to remand the defendant, J.R., in custody.

He is reasonably suspected of committing the criminal offense of war crimes against the civilian population, as stipulated in Article 142 in conjunction with Article 22 of the former Criminal Code of the former SFRY.

Following the hearing, the pretrial judge ordered J.R. to remain in custody for 1 (one) month.

According to the Basic Court in Pristina, this measure was deemed appropriate because of the genuine risk that the defendant, if released, could flee to evade criminal responsibility. The court also noted that J.R. is a citizen of Serbia, increasing the possibility that he could easily leave and place himself beyond the reach of the judicial authorities, making it impossible to secure his presence and obstructing the normal conduct of the criminal proceedings.

Another reason cited by the court concerns the risk that, if released, the defendant could interfere with evidence and witnesses. The court therefore found that, at this stage, remand in custody is the only measure that guarantees the unhindered continuation of the criminal proceedings in this case.

The parties may appeal the ruling to the Court of Appeals through the Basic Court in Pristina.
