GLPS Seeks Disclosure of Documents on Ministers Elected as MPs, Files Complaint with AIP

The Group for Legal and Political Studies (GLPS) has raised concerns after the Office of the Prime Minister (OPM) failed to respond to its request for access to public documents concerning the resignations of members of the caretaker government who won seats in the Assembly of Kosovo.

The organization said that on August 6, 2026, it asked the OPM for a list of government members who had left office, the dates on which their resignations were submitted, and the decisions through which they were accepted.

GLPS cited the Law on Government as the basis for its request. The law stipulates that a member of the caretaker government, after being elected as an MP, must leave their ministerial post before the date on which the election results are certified. The organization also emphasized that Article 72 of the Constitution does not allow the positions of minister and MP to be held simultaneously.

In its statement, GLPS also cited Supreme Court ruling P.A. No. 09/2025, dated June 25, 2025. According to the organization, the ruling found that holding both positions simultaneously is contrary to the Constitution.

GLPS claims that the OPM failed to respond within the statutory seven-day deadline set by the Law on Access to Public Documents. The organization believes that, in addition to failing to comply with this deadline, such conduct also undermines institutional transparency and accountability.

Following the lack of a response, GLPS announced that it filed a complaint with the Information and Privacy Agency (AIP) on August 17. Through the complaint, the organization is seeking to compel the OPM to provide the requested data and documents.

At the same time, GLPS has called on the government to inform the public without delay and publish the documents related to the resignations of cabinet members elected as MPs.
