Fauci Invokes the Fifth Amendment and Refuses to Testify Before Senate on Pandemic Management

Wednesday’s hearing on the Covid-19 issue took an unexpected turn when Dr. Anthony Fauci, the former chief White House health adviser, declined to answer questions before the Senate Committee on Homeland Security and Governmental Affairs. He argued that his testimony could put him at risk of self-incrimination, invoking the protections afforded by the Fifth Amendment to the Constitution.

Just moments after the hearing began, convened at the initiative of Republican Senator Rand Paul, Fauci made his position clear. He said he had been summoned for the sole purpose of forcing him to say something that could be used to justify repeated threats that he would end up in prison.

The move marks a new precedent in Fauci’s long career. He has testified before Congress more than 250 times but had never previously chosen to remain silent by invoking the amendment.

The atmosphere in the room was tense. Republicans sought to confront him with tough questions about the origin of the virus, funding for research at the Wuhan laboratory, and how the National Institute of Allergy and Infectious Diseases, which he formerly led, handled the pandemic response.

In his opening statement, Senator Paul stressed that the preemptive pardon signed by former President Joe Biden does not erase the past or prevent Congress from investigating whether Fauci previously gave false testimony. According to Paul, the measure cannot rewrite history or eliminate documentary evidence, much less deny lawmakers the right to uncover the truth.

Similarly, Health Secretary Robert F. Kennedy Jr. had warned before the hearing began that if Fauci again contradicted the truth under oath, he could face legal consequences for perjury.

Tensions between Fauci and Senator Paul date back years and center on the debate over “gain-of-function” research at the Wuhan Institute of Virology. Paul has insisted that the National Institutes of Health financially supported experiments that increased the infectious capacity of coronaviruses, an allegation Fauci has repeatedly denied. He has explained that no NIH-funded project met the official criteria for this category of research.

Several days before the hearing, Paul released more than 1,100 pages from Fauci’s personal journal during the health crisis. The former official described the move as a tactic intended to humiliate and intimidate him.

At the end of his brief statement, Fauci said he had decided not to answer questions on the advice of his lawyers, although, as he noted, he still respects the institution of the U.S. Congress.

The hearing ended without any testimony from him, leaving the political clash over the management of the pandemic and the origins of Covid-19 as one of the most heated debates in the United States.
