Documents raise suspicions over ASHK’s registration of the flower bed and sidewalk in favor of Ajola and Valbona Xoxa

A complaint published by CNA was accompanied by the release of several documents, which claim that on “Muhamet Gjollesha” street, during 2016, the flower bed and sidewalk were privatized in favor of the joint-stock company “Botimet Enciklopedike,” owned by Ajola and Valbona Xoxa.

To deepen the verification of this issue, CNA has contacted ASHK with a request for official information regarding the case in which several co-owners of the same building are alleged to have been harmed.

According to the claims, the registration of the flower bed or the sidewalk as land serving the joint-stock company, in which Ajola and Valbona Xoxa hold the majority, blocks the exit and access of the unit connected to the area registered as property 5/360.

In essence, this registration is said to have infringed on the rights of other owners in the same building by restricting the use of entrances and exits onto the public sidewalk.

Likewise, according to the referenced materials, the other owners of the building were not part of the procedure that ended with the 2016 registration.

CNA has made public a series of documents, starting with the site plan showing the flower bed turned into land, the indicative registration map, the order for the division of the property, the certificate of mortgage documents, as well as the old site plan.

At the center of the suspicions is the technical document that determined the boundaries of the 415.88 m² area and whether this area matches what emerges from the historical documentation.

According to the data resulting from the documents and photographs, a flower bed is visible in the area, while the privatized surface is claimed to also include the sidewalk.

It is precisely because of this situation, which according to the reporting can also be seen on the ground, that suspicions have been raised of legal violations and abuses by ASHK.

Among the questions being raised is whether the actual condition of the land was verified at the time of the 2016 registration.

Another question mark concerns whether property 5/360 includes areas that in practice have been used as access or as a passageway.

According to CNA, the documentation analyzed so far raises many doubts about the way the 415.88 m² area was defined and registered under property no. 5/360.

The published materials, according to the same source, require further administrative verification and, if additional elements emerge, also an institutional investigation into the procedure followed, with the documents allegedly clearly showing that the joint-stock company “Botimet Enciklopedike” privatized the flower bed and the sidewalk.
