Appeal in preparation, Gotovina case fuels defense hopes

The trial of the former leaders of the Kosovo Liberation Army has now moved to the second-instance proceedings at the Specialist Chambers. The defense is drafting arguments aimed at overturning the first-instance judgment, while international legal experts claim that the Court exceeded its jurisdiction by treating the means used in the fight for statehood as criminal.

The debate remains focused on the possibility that the decision could be changed on appeal, as well as the defense teams’ experience in similar cases previously heard before the Hague Tribunal.

Luka Mishetiq, an international lawyer and member of the defense teams in these proceedings, has strongly challenged the way the judgment against the former leaders of Kosovo’s war has been interpreted.

Responding publicly to Marko Prelec of the International Crisis Group, Mishetiq stressed that the Court did not have jurisdiction to examine Kosovo’s right to independence, yet nevertheless sought to portray the means used to liberate the country as criminal.

In his response on the X platform, Mishetiq described the Court’s approach as an unprecedented legal overreach. According to him, the Trial Panel concluded that part of the objective of the members of the Joint Criminal Enterprise and other individuals in the KLA leadership was to achieve Kosovo’s independence through war crimes, even though the Prosecution itself had not gone that far.

The first-instance assessment is regarded as an unfounded blow that strikes at the very heart of Kosovo’s liberation cause. However, the situation is not seen as irreversible for the four former leaders of the Kosovo Liberation Army being held in The Hague. Local legal experts believe that the defense teams’ professional preparation and international experience could bring about a fundamental change on appeal.

Hopes are also tied to precedents set by the Hague Tribunal for the former Yugoslavia, particularly the case of Croatian General Ante Gotovina. Lawyer Florim Shefqeti recalled that Gotovina was convicted at first instance but was later acquitted on appeal. He expressed hope that Kosovo’s leaders would share the same fate, especially since the defense is being led by the same lawyer, Luka Misetiq.

For the defense and legal experts, the Gotovina case has become the main point of reference. They expect the next stage of the proceedings to free the judgment from political considerations.

Attention is now focused on the Court of Appeals. New arguments in defense of the four former KLA leaders are expected to be presented after the formal notice of appeal is filed, which will also mark the official start of proceedings aimed at overturning the first-instance decision.
