William Schabas, a professor of international criminal law, has said that although the Kosovo Specialist Chambers may have formal jurisdiction to investigate new discoveries of mass graves, primary responsibility for prosecuting crimes committed by Serbian forces lies with the domestic judiciary.

In an interview with the newspaper “Bota sot,” Schabas discussed the possibility of these serious crimes, which may constitute violations of international humanitarian law, being addressed by the Specialist Chambers, as well as the legal avenues available to victims’ families who are still awaiting justice.

He explained that, from a legal perspective, there is a theoretical possibility that the Specialist Chambers could exercise jurisdiction, but stressed that the court’s original mission was entirely different.

“In principle, the Specialist Chambers can prosecute crimes committed by nationals of Kosovo or the Federal Republic of Yugoslavia, or crimes in which the victims were nationals of Kosovo or the FRY, provided that they occurred between January 1998 and December 2000. In theory, therefore, they may have jurisdiction,” Schabas was quoted as saying.

However, he stressed that the Specialist Chambers were established specifically to address allegations of crimes linked to leaders of the Kosovo Liberation Army, who later became involved in government.

“This court was established because of crimes allegedly committed by KLA leaders, who were already part of Kosovo’s institutions and whose cases had not been addressed by the International Criminal Tribunal for the former Yugoslavia. The assessment was that the domestic justice system would never investigate these cases,” the professor explained.

When it comes to suspected perpetrators who are members of the Serbian forces, Schabas believes the situation is different and does not involve the same political obstacles that justified the creation of this mechanism.

“If the crimes are suspected of having been committed by Serbs, then the situation is different. In this case, Kosovo’s legal system is capable of prosecuting these crimes. The political obstacles that existed in cases related to the KLA are not present. Therefore, the rights of victims should be upheld through Kosovo’s domestic judicial system,” Schabas said.

Finally, he expressed strong doubts that the mandate of the Specialist Chambers would be expanded, highlighting the high cost as a key obstacle.

“The Specialist Chambers represent a very costly alternative, and I do not believe that their funders, essentially the European Union, will be willing to make further investments to expand their mandate,” he concluded.

William Schabas, profesor i së drejtës penale ndërkombëtare, ka deklaruar se megjithëse Dhomat e Specializuara të Kosovës mund të kenë kompetencë formale për të hetuar zbulimet e reja të varrezave masive, përgjegjësia kryesore për ndjekjen e krimeve të kryera nga forcat serbe i takon gjyqësorit vendor.

Në një intervistë për gazetën “Bota sot”, Schabas u ndal te mundësia që këto krime të rënda, të cilat mund të përbëjnë shkelje të së drejtës ndërkombëtare humanitare, të adresohen nga Dhomat e Specializuara dhe cilat rrugë ligjore kanë familjarët e viktimave që presin ende drejtësi.

Ai sqaroi se nga një këndvështrim juridik, ekziston mundësia teorike e ushtrimit të juridiksionit nga Dhomat e Specializuara, por theksoi se misioni origjinal i kësaj gjykate ishte krejtësisht i ndryshëm.

“Në parim, Dhomat e Specializuara mund të ndjekin penalisht krimet e kryera nga shtetas të Kosovës ose të Republikës Federale të Jugosllavisë, apo krimet ku viktimat ishin shtetas të Kosovës ose RFJ-së, me kusht që ato të kenë ndodhur ndërmjet janarit 1998 dhe dhjetorit 2000. Në teori, pra, ato mund të kenë juridiksion”, citohet Schabas.

Megjithatë, ai theksoi se Dhomat e Specializuara u krijuan pikërisht për të trajtuar pretendimet për krime që lidheshin me udhëheqësit e Ushtrisë Çlirimtare të Kosovës, të cilët më vonë u përfshinë në qeverisje.

“Kjo gjykatë u themelua për shkak të krimeve që dyshohej se ishin kryer nga drejtues të UÇK-së, të cilët tashmë ishin pjesë e institucioneve të Kosovës dhe që Tribunali Ndërkombëtar Penal për ish-Jugosllavinë nuk i kishte trajtuar. Vlerësimi ishte se sistemi i drejtësisë vendase nuk do t’i hetonte kurrë këto raste”, shpjegoi profesori.

Kur bëhet fjalë për autorë të dyshuar që janë pjesëtarë të forcave serbe, Schabas vlerëson se situata është e ndryshme dhe nuk ka të njëjtat pengesa politike që justifikuan krijimin e këtij mekanizmi.

“Nëse dyshohet se krimet janë kryer nga serbët, atëherë situata është ndryshe. Në këtë rast, sistemi ligjor i Kosovës është në gjendje të ndjekë penalisht këto krime. Pengesat politike që ekzistonin në rastet që lidhen me UÇK-në nuk janë të pranishme. Prandaj, e drejta e viktimave duhet të realizohet përmes sistemit gjyqësor vendor të Kosovës”, ka deklaruar Schabas.

Në fund, ai shprehu dyshime të forta se mandati i Dhomave të Specializuara do të zgjerohet, duke theksuar koston e lartë si një faktor pengues kryesor.

“Dhomat e Specializuara përfaqësojnë një alternativë shumë të kushtueshme dhe nuk besoj se financuesit e tyre, në thelb Bashkimi Evropian, do të jenë të gatshëm të bëjnë investime të tjera për zgjerimin e mandatit të tyre”, përfundoi ai.

Për këtë arsye, sipas tij, juridiksioni i tyre është teorikisht i mundshëm.

Profesori shpjegoi se gjykata u krijua për të shqyrtuar pretendimet për krime të kryera nga udhëheqës të Ushtrisë Çlirimtare të Kosovës, të cilët më vonë morën poste në institucionet e vendit.

Ai tha se Dhomat e Specializuara kishin për synim trajtimin e krimeve që dyshohej se ishin kryer nga drejtues të UÇK-së, të cilët më pas u përfshinë në qeverinë e Kosovës, ndërsa këto raste nuk ishin shqyrtuar nga Tribunali Ndërkombëtar Penal për ish-Jugosllavinë. Sipas Schabas, vlerësimi i atëhershëm ishte se drejtësia vendore nuk do t’i hetonte kurrë ato çështje.

Kur të dyshuarit për krimet janë pjesëtarë të forcave serbe, sipas tij, rrethanat juridike ndryshojnë. Schabas vlerësoi se në këto raste nuk paraqiten të njëjtat barriera politike që çuan në krijimin e Dhomave të Specializuara.

Nëse ekziston dyshimi se veprat janë kryer nga serbët, sistemi ligjor i Kosovës ka mundësi t’i ndjekë penalisht, deklaroi ai. Profesori theksoi se pengesat politike të pranishme në çështjet e lidhura me UÇK-në nuk ekzistojnë në këtë situatë, ndaj e drejta e viktimave duhet të realizohet përmes sistemit gjyqësor vendor të Kosovës.

Në përfundim, Schabas u shpreh skeptik se Dhomat e Specializuara mund ta shtrijnë veprimtarinë e tyre edhe në këtë drejtim. Si një nga arsyet, ai përmendi shpenzimet e mëdha që kërkon funksionimi i këtij mekanizmi.

Sipas tij, Dhomat e Specializuara janë një alternativë jashtëzakonisht e kushtueshme. Schabas tha se nuk beson që financuesit e tyre, në thelb Bashkimi Evropian, do të tregohen të gatshëm të investojnë më tej për zgjerimin e mandatit të këtij institucioni.
