The Kosovo Democratic Institute (KDI) has asked the Constitutional Court to impose an interim measure concerning the constitution of Parliament and the formation of a new government, following two requests submitted by the PDK.

According to Vullnet Bugaqku of the KDI, the measure is necessary because of uncertainties over compliance with the Constitution during the constitution of Parliament.

At a press conference held on Tuesday, KDI representatives also asked the Constitutional Court to determine the legal consequences arising from Parliament not being constituted within the 30-day deadline following the certification of the elections.

Instituti Demokratik i Kosovës (KDI) i është drejtuar Gjykatës Kushtetuese me kërkesë për vendosjen e një mase të përkohshme lidhur me konstituimin e Kuvendit dhe krijimin e qeverisë së re, pas dy kërkesave të paraqitura nga PDK-ja.

Sipas Vullnet Bugaqkut nga KDI, kjo masë është e nevojshme për shkak të paqartësive rreth respektimit të Kushtetutës gjatë konstituimit të Kuvendit.

Gjatë konferencës për media të mbajtur të martën, përfaqësuesit e KDI-së i kërkuan gjithashtu Gjykatës Kushtetuese të përcaktojë pasojat juridike që rrjedhin nga moskonstituimi i Kuvendit brenda afatit 30-ditor pas certifikimit të zgjedhjeve.

From the Democratic Institute of Kosovo, Vullnet Bugaqku emphasizes that Haxhiu faces no legal obstacles to finalize this decree. He adds that Gashi’s appointment would simply be a formalization of the procedure without any constitutional or legal issues.

Bugaqku clarified that past practice and the rulings of the Constitutional Court have made it clear that even the acting president has all the authorizations to perform such functions. He called on institutions not to further drag out the process, stressing that Kosovo has long been functioning with an acting official in this key position.

The monitor from the Kosovo Law Institute, Flamur Kabashi, confirmed that the evaluation phase by the Prosecutorial Council concluded fully respecting the standards and regulations in force. He noted that compared to previous attempts, where the process was compromised and did not produce a suitable candidacy, this time a completely different approach was observed.

According to Kabashi, elements of transparency, objectivity, confidentiality, and equality among contenders were present at every stage of the process. He underlined the urgent need for the state to be equipped with a Chief Prosecutor with full competencies, recalling that this vacuum has lasted for nearly five years.

Bugaqku from KDI also praised the highly transparent approach of the KPK throughout the selection mechanism. According to him, no sign of favoritism or any tailoring of questions and procedures during the interviews that could have served any of the candidates was identified.

Kabashi stressed that filling this post with a person who holds full authority is vital for the proper functioning of the prosecutorial system and for a more efficient fight against crime. He recalled that this call has also come from international reports, including the Progress Report, which have insisted on a transparent and fair process for all candidates.

Zejnullah Gashi ka marrë besimin e Këshillit Prokurorial të Kosovës për të udhëhequr Prokurorinë e Shtetit, pasi u përzgjodh me pesë vota pro nga gjashtë anëtarë të pranishëm. Tani fati i emërimit të tij qëndron në duart e Albulena Haxhiut, e cila mban postin e ushtrueses së detyrës së presidentes.

Nga Instituti Demokratik i Kosovës, Vullnet Bugaqku thekson se Haxhiu nuk përballet me asnjë pengesë të karakterit ligjor për të finalizuar këtë dekretim. Ai shton se emërimi i Gashit do të ishte thjesht një formalizim i procedurës pa asnjë problematikë kushtetuese apo ligjore.

Bugaqku sqaroi se praktika e deritanishme dhe aktgjykimet e Gjykatës Kushtetuese e kanë bërë të qartë që edhe ushtruesi i detyrës së presidentit i ka të gjitha autorizimet për të kryer funksione të tilla. Ai i bëri thirrje institucioneve që të mos e zvarrisin më tej procesin, duke theksuar se Kosova ka mjaft kohë që funksionon me një ushtrues detyre në këtë pozicion kyç.

Monitoruesi i Institutit të Kosovës për Drejtësi, Flamur Kabashi, konfirmoi se faza e vlerësimit nga Këshilli Prokurorial përfundoi duke respektuar plotësisht standardet dhe rregulloret në fuqi. Ai vuri në dukje se krahasuar me përpjekjet e mëparshme, ku procesi ishte kompromentuar dhe nuk kishte prodhuar një kandidaturë të përshtatshme, kësaj radhe u vu re një qasje krejtësisht e ndryshme.

Sipas Kabashit, elementët e transparencës, objektivitetit, konfidencialitetit dhe barazisë mes garuesve ishin të pranishëm në çdo etapë të procesit. Ai nënvizoi nevojën urgjente që shteti të pajiset me një Kryeprokuror me kompetenca të plota, duke kujtuar se ky vakum ka zgjatur për gati pesë vjet.

Bugaqku nga KDI vlerësoi gjithashtu qasjen tejet transparente të KPK-së gjatë gjithë mekanizmit të përzgjedhjes. Sipas tij, nuk u identifikua asnjë shenjë favorizimi apo e ndonjë përshtatjeje të pyetjeve dhe procedurave gjatë intervistave që mund t’i shërbente ndonjërit prej kandidatëve.

Kabashi theksoi se plotësimi i këtij posti me një person që zotëron autoritetin e plotë është jetik për funksionimin e duhur të sistemit prokurorial dhe për një luftë më efikase kundër kriminalitetit. Ai kujtoi se kjo thirrje ka ardhur edhe nga raportet ndërkombëtare, përfshirë Raportin e Progresit, të cilat kanë insistuar në një proces transparent dhe të drejtë për të gjithë kandidatët.
