<p>When Jovan Radan received a seven-year prison sentence in mid-June for raping a woman in Vukovar, criticism focused not only on the leniency of the sentence, which barely exceeded the minimum prescribed by law.</p>
<p>Radan, a former member of the Serbian Territorial Defense, raped the victim three times inside a house in Vukovar where she had found temporary shelter.</p>
<p>However, what stands out in the reasoning behind the Belgrade High Court’s ruling is that one of the elements used to prove that the crime had indeed occurred in 1991 was the fact that the survivor had not sought any form of compensation from her rapist.</p>
<p>The first-instance judgment by the War Crimes Department states that her testimony was impartial and was not motivated by revenge or by the intention to obtain material or any other kind of benefit, citing the injured party’s statement that she had no property claim.</p>

<p>In this trial, which took place a full 34 years after the event, the victim’s statement was deemed sincere, convincing and corroborated by evidence, including the testimony of several other women.</p>
<p>One of them is Snjezhana Malak, who remembers 1991 in detail. She says the sentence is extremely lenient compared with what the woman endured.</p>

<p>Malak herself was also raped in Vukovar that same year, when she was 22. She recounts how three men confronted her and she was forced to choose which one of them would rape her. One of those three men was Jovan Radan.</p>
<p>The man who committed the crime against her told her that Radan was doing the same thing to another woman, whispering that she was not the only one going through that horror.</p>
<p>The siege of Vukovar lasted three months. The city was bombarded relentlessly by the air force, tanks and infantry of the Yugoslav People’s Army, together with volunteer paramilitary units from Serbia and Croatian Serbs, and was almost completely destroyed.</p>
<p>Croatian statistics indicate that around 2,700 defenders and civilians were killed during the siege, while the search continues for approximately 300 missing people.</p>
<p>Years later, Malak testified in support of the woman raped by Radan. The two women still meet in Vukovar today. Malak says that a few days ago, the victim informed her that she had received notice of the possibility of filing a compensation claim. However, she refuses to go to Serbia, a necessary step for submitting the claim.</p>
<p>The Difficult Path to Compensation for Victims</p>
<p>Judicial practice in Serbia directs victims to initiate civil proceedings to seek compensation after the conclusion of criminal proceedings. Jovana Kollariq, a researcher at the Humanitarian Law Center in Serbia, considers this practice troubling for several reasons.</p>
<p>First, victims face another legal battle. Second, once civil proceedings are initiated, they lose their protected-witness status. This makes victims of sexual violence in particular, who often testify under protective measures, reluctant to take this path because of the deep stigma attached to this crime, Kollariq explained to Radio Free Europe.</p>
<p>To date, only 13 criminal proceedings involving wartime sexual violence have been conducted in Serbia, and in five of them the charges related exclusively to that offense. No compensation claim filed during criminal proceedings for war crimes has ever been granted, Kollariq noted.</p>
<p>The case of Jovan Radan marks the first time a direct link has been made between a victim’s right to seek compensation in criminal proceedings and the assessment of the credibility of her testimony. Although seeking compensation is a constitutional right, courts often view consideration of such claims as an unnecessary delay to criminal proceedings.</p>
<p>According to Kollariq, there have been cases in which it was openly stated during a trial that the court traditionally did not rule on such claims. Now, she adds, the court itself is endorsing the waiver of this right by linking the victim’s credibility to whether or not she exercised it. This is particularly harmful to victims of sexual violence, who already face prejudice and questions about their long silence. The court is now reinforcing these stereotypes by suggesting that testimony is credible only if the victim waives the right to compensation.</p>

<p>The Belgrade High Court did not respond to Radio Free Europe’s questions seeking further clarification of this reasoning.</p>
<p>The right to seek compensation is enshrined in the legislation of Serbia and other Western Balkan countries and is also consistent with international standards for prosecuting cases of sexual violence.</p>
<p>In Bosnia and Herzegovina, the practice of awarding compensation directly in criminal proceedings has developed significantly, explained Ajna Mahmiq, legal coordinator at TRIAL International BiH. After a decade of evolving judicial practice, the rule is that victims should exercise their right to compensation within the same proceedings, sparing them a new burden and the additional trauma of separate civil proceedings.</p>
<p>What a Compensation Claim Represents</p>
<p>In Kosovo, four judgments have so far been issued for wartime sexual violence, and only one of them is final. In none of these criminal proceedings was compensation awarded to the victim.</p>
<p>According to many survivors of wartime sexual violence, the fundamental problem with this reasoning is that justice means much more than a criminal sentence. Feride Rushiti, director of the Kosovo Rehabilitation Centre for Torture Victims, stresses that justice also includes access to reintegration, fair compensation, rehabilitation and recognition of the harm suffered.</p>
<p>Rehabilitation support, compensation and guarantees that the crime will not be repeated are the cornerstones of reintegration programs. However, victims often spend years navigating the labyrinth of the courts before securing some measure of justice and support.</p>
<p>Many organizations consider it wrong for a court ruling to make the credibility of a victim’s testimony conditional on the exercise of a legal right. The Rosa Center says this does not send victims a positive or fair message.</p>
<p>Similarly, the Humanitarian Law Center argues that the credibility of a victim’s statement cannot depend on her decision whether or not to seek compensation. Meanwhile, the Association of Women Victims of War in Sarajevo, which has spent decades collecting testimonies from women raped during the war in Bosnia and Herzegovina, warns that every ruling and the reasoning behind it sends a powerful message.</p>
<p>According to the association, using this fundamental right as a criterion for credibility creates the impression that victims must give up their rights in order to be believed. Such an approach risks further discouraging people who are considering reporting crimes and pursuing justice. International estimates indicate that between 20,000 and 50,000 women were raped during the war in Bosnia and Herzegovina from 1992 to 1995, including members of this association.</p>
<p>The Case of Ms. A and the Regional Experience</p>
<p>The Association of Women Victims of War in Sarajevo regularly cooperates with judicial authorities in Bosnia and Herzegovina. In a previous interview with Radio Free Europe, its president, Bakira Haseçiq, described how the association had served as the right hand of the Hague Tribunal from its earliest days, providing statements or witnesses as needed.</p>
<p>The International Criminal Tribunal for the former Yugoslavia, or ICTY, was the first international court to hand down convictions for rape as a form of torture and for sexual slavery as a crime against humanity. Fewer than 40 people were convicted by the court of wartime sexual violence. Since the Hague Tribunal closed, domestic courts in the region have issued around 96 judgments for such offenses.</p>
<p>In Kosovo, around one hundred cases of wartime sexual violence are under investigation, but only four have resulted in judgments, just one of which is final, while those convicted have received a combined total of 72 years in prison, according to data from the Kosovo Rehabilitation Centre for Torture Victims. Rushiti adds that in every case that went to court, the victims simultaneously received psychological and legal support, because the path to justice is often as challenging as the crime itself and, without support, trauma prevents many survivors from coming forward.</p>
<p>The Association of Women Victims of War in Sarajevo stresses that speaking about sexual violence remains extremely difficult. Many women remain silent for years or decades because of trauma, fear, stigma and distrust of institutions. When they finally decide to testify, they do so primarily to establish the truth about the crimes and to see the perpetrators brought to justice. It is therefore essential that the justice system, through its rulings, inspire trust and respect victims’ rights, including the right to compensation.</p>
<p>In the final judgment against Jovan Radan, the War Crimes Department of the Belgrade High Court emphasized that the decision was based primarily on the victim’s statement, which was the most significant piece of evidence in the case, and that the sentence was imposed in line with judicial practice.</p>
<p>However, Veselinka Kastratoviq, a researcher at the Documenta organization in Croatia, believes that these lenient sentences are precisely one of the reasons victims are unable to feel that justice has been served and many of them give up on reporting crimes. Every testimony hearing takes them back to the place and moment of the crime, making the reliving of such a traumatic experience extremely difficult and stressful.</p>
<p>All five cases tried in Belgrade for wartime sexual violence have resulted in convictions, but, as Kollariq points out, the sentences imposed have always been very close to the statutory minimum of five years in prison.</p>
<p>How Much Compensation Victims Receive and How It Is Awarded</p>
<p>A decade after she was raped in Vukovar, Snjezhana Malak reported the crime. But the perpetrators were never brought to justice. They were sentenced in absentia to six years in prison and, apart from the time they spent in pretrial detention, never served their sentences because they died while remaining free pending trial.</p>
<p>Despite this, Malak urges women not to be afraid to speak about their experiences, because the truth kept inside eats away at the soul, causes illness and destroys families.</p>
<p>Estimates indicate that for every reported rape, another 10 to 20 remain unreported. Fear, social stigma and a lack of trust in institutions lead the vast majority of victims of sexual violence not to report the crime. Even decades after the conflicts in the region, many are still waiting for justice, while the perpetrators remain free.</p>

<p>Kur Jovan Radan mori një dënim prej shtatë vjetësh burg në mes të qershorit për përdhunimin e një gruaje në Vukovar, kritikat nuk u përqendruan vetëm te masa e ulët e dënimit, i cili mezi e kalonte minimumin e parashikuar me ligj.</p>
<p>Radan, një ish-anëtar i Mbrojtjes Territoriale Serbe, e kishte dhunuar tri herë viktimën brenda një shtëpie në Vukovar ku ajo kishte gjetur strehë të përkohshme.</p>
<p>Sidoqoftë, ajo që bie në sy në arsyetimin e vendimit të Gjykatës së Lartë në Beograd është se një nga elementet që provon se ky krim ka ndodhur vërtet në vitin 1991 ishte fakti që e mbijetuara nuk kishte kërkuar asnjë lloj kompensimi nga dhunuesi.</p>
<p>Aktgjykimi i shkallës së parë nga Departamenti për Krime Lufte specifikon se dëshmia e saj është e paanshme dhe nuk motivohet nga hakmarrja apo synimi për të nxjerrë përfitime materiale ose të çfarëdo natyre tjetër, duke u mbështetur në deklaratën e të dëmtuarës se ajo nuk kishte asnjë pretendim pasuror.</p>

<p>Në këtë gjykim, që u zhvillua plot 34 vite pas ngjarjes, deklarata e viktimës u konsiderua e sinqertë, bindëse dhe e përforcuar nga provat, përfshirë dëshmitë e disa grave të tjera.</p>
<p>Një ndër to është Snjezhana Malak, e cila kujton me hollësi vitin 1991. Ajo thotë se dënimi është tejet i ulët në krahasim me atë që pësoi zonja në fjalë.</p>
<p>Edhe vetë Malak ishte viktimë e përdhunimit në Vukovar gjatë po atij viti, kur ishte 22 vjeçe. Ajo rrëfen se si tre burra i dolën përpara dhe ajo u detyrua të zgjidhte se cili prej tyre do ta dhunonte. Një nga ata tre ishte pikërisht Jovan Radan.</p>

<p>Autori i krimit ndaj saj i kishte thënë se Radan po bënte të njëjtën gjë me një grua tjetër, duke i pëshpëritur se nuk ishte e vetmja që po kalonte atë tmerr.</p>
<p>Rrethimi i Vukovarit zgjati tre muaj. Qyteti u bombardua pa pushim nga forcat ajrore, tanket dhe këmbësoria e Ushtrisë Popullore Jugosllave, së bashku me njësi paraushtarake vullnetare nga Serbia dhe serbët e Kroacisë, duke u shkatërruar pothuajse në tërësi.</p>
<p>Statistikat kroate flasin për rreth 2.700 të vrarë mes mbrojtësish dhe civilësh gjatë rrethimit, ndërsa vazhdon ende kërkimi për afërsisht 300 persona të zhdukur.</p>
<p>Malak dëshmoi vite më pas në mbështetje të gruas që ishte dhunuar nga Radan. Edhe sot, ato vijojnë të takohen në Vukovar. Ajo tregon se para pak ditësh, viktima e kishte njoftuar se kishte marrë një njoftim për mundësinë e depozitimit të një kërkese për dëmshpërblim. Mirëpo, ajo nuk pranon të shkojë në Serbi, hap i domosdoshëm për të paraqitur kërkesën.</p>
<p><strong>Rruga e vështirë e viktimave drejt kompensimit</strong></p>
<p>Tradita gjyqësore në Serbi i orienton viktimat që, pas mbylljes së procesit penal, të nisin një padi civile për të kërkuar zhdëmtim. Jovana Kollariq, hulumtuese në Fondin për të Drejtën Humanitare në Serbi, e sheh këtë praktikë si shqetësuese për disa arsye.</p>
<p>Së pari, viktimat përballen me një tjetër betejë gjyqësore. Së dyti, me nisjen e procedurës civile, ato humbasin statusin e dëshmitarit të mbrojtur. Kjo bën që veçanërisht viktimat e dhunës seksuale, të cilat shpesh dëshmojnë me masa mbrojtjeje, të hezitojnë të hyjnë në këtë rrugë, për shkak të stigmës së thellë që mbart ky krim, shpjegon Kollariq për Radion Evropa e Lirë.</p>
<p>Deri tani, në Serbi janë zhvilluar vetëm 13 procese penale për dhunë seksuale në kohë lufte, dhe në pesë prej tyre akuzat ishin ekskluzivisht për këtë vepër. Asnjë kërkesë për zhdëmtim e paraqitur gjatë një procesi penal për krime lufte nuk është pranuar ndonjëherë, thekson Kollariq.</p>
<p>Rasti i Jovan Radanit shënon herën e parë që vendoset një lidhje e drejtpërdrejtë midis të drejtës së viktimës për të kërkuar kompensim në procesin penal dhe vlerësimit të besueshmërisë së dëshmisë së saj. Megjithëse kërkesa për dëmshpërblim është një e drejtë kushtetuese, gjykatat shpesh e konsiderojnë shqyrtimin e saj si një vonesë të panevojshme për procesin penal.</p>
<p>Sipas Kollariq, ka patur raste kur gjatë gjykimit është deklaruar hapur se gjykata ka si traditë të mos vendosë mbi këto kërkesa. Tani, ajo shton, është vetë gjykata që e miraton heqjen dorë nga kjo e drejtë, duke e lidhur besueshmërinë e viktimës me faktin nëse ajo e ushtroi apo jo këtë të drejtë. Kjo është veçanërisht e dëmshme për viktimat e dhunës seksuale, të cilat tashmë ndeshen me paragjykime dhe pyetje rreth heshtjes së tyre të gjatë. Tani gjykata po i përforcon këto stereotipa, duke sugjeruar se dëshmia është e besueshme vetëm nëse heq dorë nga e drejta për zhdëmtim.</p>
<p>Gjykata e Lartë në Beograd nuk iu përgjigj pyetjeve të Radios Evropa e Lirë për të sqaruar më tej këtë arsyetim.</p>

<p>E drejta për të kërkuar zhdëmtim është e mishëruar në legjislacionin e Serbisë dhe të vendeve të tjera të Ballkanit Perëndimor, si dhe përputhet me standardet ndërkombëtare për ndjekjen e rasteve të dhunës seksuale.</p>
<p>Në Bosnje dhe Hercegovinë, praktika e dhënies së kompensimit direkt në procesin penal është zhvilluar ndjeshëm, shpjegon Ajna Mahmiq, koordinatore ligjore në organizatën TRIAL International BeH. Pas një dekade evoluimi të praktikës gjyqësore, rregulli është që viktimat të realizojnë të drejtën e tyre për dëmshpërblim brenda të njëjtit proces, për t’iu kursyer atyre një barrë të re dhe trauma shtesë nga një proces i veçantë civil.</p>
<p><strong>Çfarë përfaqëson kërkesa për dëmshpërblim</strong></p>
<p>Në Kosovë, deri më tani janë dhënë katër vendime për dhunë seksuale gjatë luftës, dhe vetëm njëri prej tyre është i formës së prerë. Në asnjërin prej këtyre proceseve penale nuk është vendosur dëmshpërblim për viktimën.</p>
<p>Problemi thelbësor i këtij arsyetimi, sipas shumë të mbijetuarve të dhunës seksuale në kohë lufte, është se drejtësia nënkupton shumë më tepër se një dënim penal. Feride Rushiti, drejtoreshë e Qendrës Kosovare për Rehabilitimin e të Mbijetuarve të Torturës, thekson se drejtësia përfshin gjithashtu qasjen në riintegrim, një kompensim të drejtë, rehabilitim dhe njohjen e dëmit të pësuar.</p>
<p>Mbështetja për rehabilitimin, zhdëmtimi dhe siguria se krimi nuk do të përsëritet janë gurët e themelit të programeve të riintegrimit. Megjithatë, viktimat shpesh enden nëpër labirintet e gjykatave për vite të tëra para se të sigurojnë një farë drejtësie dhe përkrahjeje.</p>
<p>Shumë organizata e konsiderojnë të gabuar që në një vendim gjyqësor, besueshmëria e dëshmisë së një viktime të kushtëzohet nga ushtrimi i një të drejte ligjore. Nga Qendra “Rosa” thonë se kjo nuk u dërgon një sinjal të mirë e të drejtë viktimave.</p>
<p>Në të njëjtën linjë, edhe Fondi për të Drejtën Humanitare argumenton se nuk mund të varet besueshmëria e deklaratës së një viktime nga vendimi i saj për të kërkuar apo jo dëmshpërblim. Ndërsa Shoqata e Grave Viktima të Luftës në Sarajevë, e cila prej dekadash mbledh dëshmi grave të përdhunuara gjatë luftës në Bosnje dhe Hercegovinë, paralajmëron se çdo vendim dhe arsyetim i tij përcjell një mesazh të fuqishëm.</p>
<p>Sipas tyre, përdorimi i kësaj të drejte themelore si kriter për besueshmërinë krijon idenë se viktimat duhet të heqin dorë nga të drejtat e tyre që t’u besohet më shumë. Një qasje e tillë rrezikon të dekurajojë edhe më shumë personat që mendojnë të raportojnë krimet dhe të ndjekin rrugën e drejtësisë. Vlerësimet ndërkombëtare flasin për një numër prej 20.000 deri në 50.000 grash të përdhunuara gjatë luftës në Bosnje e Hercegovinë (1992-1995), përfshirë edhe anëtare të kësaj shoqate.</p>
<p><strong>Rasti i zonjës A dhe përvoja rajonale</strong></p>
<p>Shoqata e Grave Viktima të Luftës nga Sarajeva bashkëpunon rregullisht me organet e drejtësisë në Bosnje e Hercegovinë. Në një intervistë të mëparshme për Radion Evropa e Lirë, kryetarja Bakira Haseçiq tregoi se si ishin krah i djathtë i Tribunalit të Hagës që në ditët e para, duke u siguruar deklarata apo dëshmitarë sipas nevojës.</p>
<p>Gjykata Penale Ndërkombëtare për ish-Jugosllavinë (ICTY) ishte instanca e parë ndërkombëtare që dha vendime fajësie për përdhunimin si formë torture dhe për skllavërinë seksuale si krim kundër njerëzimit. Para kësaj gjykate u dënuan më pak se 40 persona për dhunë seksuale në kohë lufte. Pas mbylljes së Tribunalit të Hagës, gjykatat vendore në rajon kanë dhënë rreth 96 aktgjykime për vepra të tilla.</p>
<p>Në Kosovë, janë nën hetim rreth njëqind raste të dhunës seksuale gjatë luftës, por vetëm katër kanë përfunduar me aktgjykim, ku vetëm një është i plotfuqishëm dhe të dënuarit kanë marrë gjithsej 72 vjet burg, sipas të dhënave të QKRMT-së. Rushiti shton se në çdo rast që shkoi në gjykatë, viktimat morën paralelisht përkrahje psikologjike dhe juridike, pasi rruga drejt drejtësisë është shpeshherë po aq sfiduese sa vetë krimi dhe pa mbështetje, trauma i frenon shumë të mbijetuar.</p>
<p>Nga Shoqata e Grave Viktima të Luftës në Sarajevë theksojnë se të flasësh për dhunën seksuale të përjetuar mbetet jashtëzakonisht i vështirë. Shumë gra heshtin për vite apo dekada për shkak të traumës, frikës, stigmës dhe mosbesimit në institucione. Kur më në fund vendosin të dëshmojnë, e bëjnë kryesisht për të vërtetuar të vërtetën mbi krimet dhe për të parë autorët përpara drejtësisë. Andaj është thelbësore që sistemi i drejtësisë, nëpërmjet vendimeve të tij, të frymëzojë besim dhe të respektojë të drejtat e viktimave, përfshirë atë për zhdëmtim.</p>
<p>Në vendimin përfundimtar kundër Jovan Radanit, Departamenti për Krime Lufte i Gjykatës së Lartë në Beograd nënvizon se vendimi u mbështet kryesisht në deklaratën e viktimës, e cila ishte prova më me peshë në këtë rast, dhe se dënimi u caktua në përputhje me praktikën gjyqësore.</p>
<p>Megjithatë, Veselinka Kastratoviq, hulumtuese në organizatën Documenta në Kroaci, është e mendimit se pikërisht këto dënime të ulëta janë një nga arsyet që viktimat nuk arrijnë të ndiejnë se drejtësia është vendosur dhe shumë prej tyre heqin dorë nga raportimi i krimeve. Çdo seancë dëshmie i kthen ato në vendin dhe momentin e krimit, duke e bërë ripërjetimin e një eksperience kaq traumatike tejet të rëndë dhe stresues.</p>
<p>Të gjitha pesë rastet e gjykuara në Beograd për dhunë seksuale në kohë lufte kanë përfunduar me dënime, por, siç nënvizon Kollariq, dënimet e shqiptuara gjithmonë kanë qenë fare pranë minimumit ligjor prej pesë vjetësh burg.</p>
<p><strong>Sa dhe si kompensohen viktimat</strong></p>
<p>Një dekadë pasi u përdhunua në Vukovar, Snjezhana Malak denoncoi krimin. Por autorët e saj nuk u përballën asnjëherë me drejtësinë. Ata u dënuan me gjashtë vjet burg në mungesë dhe, me përjashtim të periudhës së paraburgimit, nuk e vuajtën asnjëherë dënimin, sepse vdiqën ndërkohë që mbroheshin në liri.</p>
<p>Pavarësisht kësaj, Malak u bën thirrje grave të mos kenë frikë të flasin për përvojat e tyre, sepse e vërteta e mbajtur brenda gërryen shpirtin, sjell sëmundje dhe shkatërron familje.</p>
<p>Vlerësimet tregojnë se për çdo rast të raportuar përdhunimi, mbeten 10 deri në 20 të tjerë në heshtje. Frika, stigma shoqërore dhe mungesa e besimit ndaj institucioneve shtyjnë shumicën dërrmuese të viktimave të dhunës seksuale të mos e denoncojnë krimin. Edhe dekada pas konflikteve në rajon, shumë prej tyre ende presin drejtësi, ndërsa autorët e krimeve mbeten të lirë.</p>
