The Special Prosecution Office of the Republic of Kosovo has filed an indictment against 35 defendants and requested that the trial be conducted in absentia. They are suspected of the criminal offense of “war crimes against the civilian population.”

The accused, identified by the initials J.S., V.D., S.L., G.R., M.U., Z.T., Z.S., S.V., B.C., Z.M., R.S., V.T., B.P., R.M., M.S., S.I., N.S., B.F., Z.B., C.B., Z.R., D.I., S.M., V.J., M.L., R.C., S.P., N.M., V.R., D.Z., O.S., B.D., L.C., I.T. and M.B., are suspected of having been commanders of the Serbian Police Special Units.

According to the indictment, in this role they organized, coordinated and led an armed operation against the Jasharaj neighborhood in Lower Prekaz.

The Special Prosecution Office alleges that the attack was carried out with heavy artillery, tanks and other military vehicles, even though many civilians were present in the area.

The indictment states that civilians were killed during the operation, including women, children and elderly people. Civilians were also allegedly taken hostage and subjected to mistreatment and torture, while civilian buildings and infrastructure were damaged and destroyed.

Around 23 police units took part in the operation. Among them was the Special Operations Unit, commanded by M.U., known by the nickname “Legia.”

The indictment document states that the Jasharaj neighborhood was kept under constant surveillance and control from the beginning of January 1998 until the operation ended after March 7, 1998.

Blerim Isufaj, chief prosecutor of the Special Prosecution Office, said the indictment was built on a careful, professional and evidence-based process.

Isufaj stressed that the indictment demonstrates the continued commitment to addressing war crimes and holding those responsible criminally accountable, regardless of the complexity of the cases and the years that have passed since they were committed.

Prosecutor Valdet Gashi described the case as one of the most complex and challenging investigations.

He said the intensive work of the Special Prosecution Office staff, together with close cooperation with the Kosovo Police and other institutions in the country, made it possible to reach the stage of filing the indictment.

The case file has now been forwarded for review to the Basic Court in Pristina, specifically its Special Department.

Të akuzuarit, të identifikuar me inicialet J.S., V.D., S.L., G.R., M.U., Z.T., Z.S., S.V., B.C., Z.M., R.S., V.T., B.P., R.M., M.S., S.I., N.S., B.F., Z.B., C.B., Z.R., D.I., S.M., V.J., M.L., R.C., S.P., N.M., V.R., D.Z., O.S., B.D., L.C., I.T. dhe M.B., dyshohet se ishin drejtues të Njësive Speciale të Policisë Serbe.

Sipas aktakuzës, në këtë rol ata kishin organizuar, bashkërenduar dhe udhëhequr një aksion të armatosur kundër lagjes Jasharaj në Prekaz të Poshtëm.

Prokuroria Speciale pretendon se sulmi u krye me artileri të rëndë, tanke dhe mjete të tjera luftarake, edhe pse në atë zonë ndodheshin shumë civilë.

Aktakuza përshkruan se gjatë operacionit u vranë civilë, mes tyre gra, fëmijë dhe të moshuar. Gjithashtu, civilë dyshohet se u morën peng, iu nënshtruan maltretimit dhe torturës, ndërsa u dëmtuan e u shkatërruan objekte dhe infrastrukturë civile.

Në aksion morën pjesë rreth 23 njësi policore. Në mesin e tyre ishte edhe Njësia për Operacione Speciale, e drejtuar nga M.U., i njohur me nofkën “Legia”.

Dokumenti i akuzës thotë se lagjja Jasharaj ishte mbajtur nën mbikëqyrje dhe kontroll të vazhdueshëm që nga fillimi i janarit të vitit 1998, deri në përfundimin e sulmit pas 7 marsit 1998.

Kryeprokurori i Prokurorisë Speciale, Blerim Isufaj, deklaroi se aktakuza është ndërtuar mbi një proces pune të kujdesshëm, profesional dhe të mbështetur në prova.

Isufaj theksoi se kjo aktakuzë dëshmon përkushtimin e vazhdueshëm për trajtimin e krimeve të luftës dhe vendosjen para përgjegjësisë penale të personave përgjegjës, pavarësisht ndërlikueshmërisë së rasteve dhe viteve të kaluara nga kryerja e tyre.

Prokurori i çështjes, Valdet Gashi, e përshkroi rastin si një prej hetimeve më komplekse dhe sfiduese.

Ai tha se puna intensive e stafit të Prokurorisë Speciale, së bashku me bashkëpunimin e ngushtë me Policinë e Kosovës dhe institucionet e tjera të vendit, bëri të mundur arritjen deri në ngritjen e aktakuzës.

Valdet Gashi, a prosecutor with the Kosovo Special Prosecution Office, has provided details from the indictment in absentia against 35 defendants for war crimes in Lower Prekaz. He said the most difficult issue during the investigation was determining which Serbian units were involved in these actions.

According to Gashi, the Serbian Public Security Department, the Ministry of Internal Affairs, the Serbian State Security Department and, within the latter, Serbia’s Special Unit took part in the operations during which the crimes in Lower Prekaz were committed.

He said other units were also involved in the operation, including the Special Police Unit, the Special Anti-Terrorist Unit and departments within Serbia’s Ministry of Internal Affairs.

Meanwhile, “Legija” was tasked, at his special request, with directly attacking the home of Shaban Jasharaj’s family.

The prosecutor emphasized that the individuals named in the indictment held managerial positions in the units in which they served.

“The most important point is identifying these units, and this was precisely the biggest problem,” Gashi said.

He clarified that the indictment against the 35 defendants is not limited to crimes committed against Shaban Jasharaj’s immediate family. According to him, the case covers the victims and attacks throughout the Jasharaj neighborhood in the village of Lower Prekaz.

Based on the evidence collected, the number of victims is 26, Gashi said.

The prosecutor also stated that, according to the information available so far, all 35 defendants charged with war crimes in Lower Prekaz are alive.

“If, after the names are published, information emerges that an individual is not alive, then, of course, under the law, we can remove them from the indictment. However, based on the information we have, all of these individuals are alive,” he said.

The indictment was filed in absentia after the Special Prosecution Office determined that all options for securing the defendants and bringing them into criminal proceedings had been exhausted.

Prokurori i Prokurorisë Speciale të Kosovës, Valdet Gashi, ka dhënë detaje nga aktakuza në mungesë ndaj 35 të pandehurve për krime lufte në Prekaz të Poshtëm. Ai tha se çështja më e vështirë gjatë hetimeve ka qenë përcaktimi i njësive serbe të përfshira në këto veprime.

Sipas Gashit, në aksionet ku janë kryer krimet në Prekaz të Poshtëm kanë marrë pjesë Departamenti i Sigurisë Publike të Serbisë, Ministria e Punëve të Brendshme, Departamenti i Sigurisë Shtetërore të Serbisë dhe, në kuadër të këtij të fundit, edhe Njësia Speciale e Serbisë.

Ai bëri të ditur se në operacion ka pasur edhe njësi të tjera, përfshirë Njësinë e Posaçme Policore, Njësinë Speciale Antiterroriste dhe departamente në kuadër të Ministrisë së Brendshme të Serbisë.

Ndërkohë, ‘Legija’ e kishte për detyrë, me kërkesën e tij speciale, që ta sulmonte drejtpërdrejt shtëpinë e familjes së Shaban Jasharajt.

Prokurori theksoi se personat e përfshirë në aktakuzë kanë pasur pozita menaxhuese në njësitë ku kanë vepruar.

“Pika më e rëndësishme është identifikimi i këtyre njësive, ndërsa pikërisht ky ka qenë edhe problemi më i madh”, tha Gashi.

Ai sqaroi se aktakuza ndaj 35 të pandehurve nuk lidhet vetëm me krimet e kryera ndaj familjes së ngushtë të Shaban Jasharajt. Sipas tij, rasti përfshin viktimat dhe sulmet e ndodhura në të gjithë lagjen Jasharaj, në fshatin Prekaz i Poshtëm.

Në bazë të provave të mbledhura, numri i viktimave është 26 persona, tha Gashi.

Prokurori deklaroi gjithashtu se, sipas informacioneve të deritanishme, të 35 të pandehurit për krime lufte në Prekaz të Poshtëm janë gjallë.

“Nëse pas publikimit të emrave vjen ndonjë informacion se një person nuk është gjallë, natyrisht që, sipas ligjit, kemi mundësi ta tërheqim nga aktakuza. Megjithatë, bazuar në informacionet që kemi, të gjithë këta persona janë gjallë”, tha ai.

Aktakuza është ngritur në mungesë, pasi Prokuroria Speciale ka vlerësuar se janë shterur mundësitë për sigurimin e të pandehurve dhe sjelljen e tyre në procedurë penale.
