A fire has engulfed the mountainous area of Bërnjak, in the northern part of Kosovo.

A photograph obtained by KosovaPress shows that the fire is located near Lake Ujman.

There is still no information on whether firefighting teams have arrived at the scene to intervene in the area.

In July of this year, 17 unauthorized buildings erected on land owned by the “Ibër-Lepenc” Public Hydro-Economic Enterprise near Ujman Lake were demolished.

The operation to remove the structures was carried out by the Inspectorate of the Ministry of Environment, Spatial Planning and Infrastructure.

Following several lawsuits filed against the “Ibër-Lepenc” enterprise, a court hearing was scheduled for August 12. A day later, court teams went to the area to conduct an on-site inspection.

Hateme Haxhaj, spokesperson for the Basic Court of Mitrovica, confirmed the court’s site visit to KosovaPress.

“The court conducted an on-site inspection today at the location where the buildings were demolished,” Haxhaj said briefly.

Meanwhile, several Serbian media outlets, including RTS, have reported that the Ministry of Agriculture, Forestry and Rural Development today asked the owners of several other buildings near Ujman Lake to vacate the property within ten days.

According to these reports, the buildings are suspected of having been constructed without permits in the area known as “Međedi Potok.”

Serbian President Aleksandar Vučić’s warnings regarding Kosovo’s waters and the possibility of intervening in river flows have been analyzed by hydrotechnical engineer Mumin Morina.

Morina explained that, from a technical standpoint, a state may build hydrotechnical structures within its territory that affect the flow of a river. However, he said that under present circumstances, such an action would be difficult and unacceptable because of international conventions and norms.

“From an engineering and technical standpoint, such an intervention is possible. Hydrotechnical structures serving various purposes can be built within a riverbed and on a state’s territory. However, given the current situation, it is unthinkable that this could happen,” Morina said.

He emphasized that the use and management of transboundary waters are now regulated by numerous international conventions.

According to Morina, rivers have their sources and flow according to gravity, so they cannot be arbitrarily restricted. Any intervention through hydrotechnical structures, he said, must be carried out with due consideration for the consequences it may cause.

Referring to Lake Ujman, the engineer recalled that the reservoir project was designed during the former Yugoslavia, while its construction was preceded by numerous technical analyses.

“Many analyses were conducted for the construction of Ujman. The project originated during the Yugoslav period and was not intended to be used in such a way or to cause consequences for another state,” Morina said.

He stressed that any project that could change the direction of water flows or endanger the flow of water toward a neighboring state must comply with international conventions and also receive the neighboring country’s approval.

“Any structure that diverts or endangers the flow of water toward a neighboring state must comply with international conventions, but it also requires the neighboring state’s permission,” he said.

Morina added that implementing such an initiative cannot be based solely on a feasibility study. According to him, other assessments are also essential, including environmental impact studies.

“A feasibility study alone is not enough if there are no environmental impact studies. These matters are subject to restrictions, regardless of the power a state may wield,” Morina concluded.

Paralajmërimet e presidentit serb, Aleksandar Vuçiq, për ujërat e Kosovës dhe mundësinë e ndërhyrjes në rrjedhat e lumenjve janë analizuar nga inxhinieri hidroteknik Mumin Morina.

Morina ka shpjeguar se, në aspektin teknik, një shtet mund të ndërtojë brenda territorit të tij vepra hidroteknike që ndikojnë në rrjedhën e një lumi. Megjithatë, ai ka vlerësuar se në rrethanat e sotme një veprim i tillë do të ishte i vështirë dhe i papranueshëm, për shkak të konventave dhe normave ndërkombëtare.

“Nga pikëpamja inxhinierike dhe teknike, një ndërhyrje e tillë është e mundur. Brenda shtratit të një lumi dhe në territorin e një shteti mund të ndërtohen vepra hidroteknike për qëllime të ndryshme. Por, duke pasur parasysh situatën aktuale, është e paimagjinueshme që kjo të ndodhë”, ka deklaruar Morina.

Ai ka nënvizuar se përdorimi dhe administrimi i ujërave ndërkufitare rregullohet sot nga një numër i madh konventash ndërkombëtare.

Sipas Morinës, lumenjtë kanë burimin e tyre dhe rrjedhin në bazë të gravitetit, ndaj nuk mund të kufizohen në mënyrë arbitrare. Çdo ndërhyrje nëpërmjet veprave hidroteknike, ka thënë ai, duhet të kryhet duke marrë në konsideratë pasojat që mund të shkaktojë.

Duke iu referuar liqenit të Ujmanit, inxhinieri ka kujtuar se projekti i këtij akumulacioni është hartuar në kohën e ish-Jugosllavisë, ndërsa ndërtimit i kanë paraprirë analiza të shumta teknike.

“Për ndërtimin e Ujmanit janë kryer shumë analiza. Projekti e ka origjinën në periudhën e Jugosllavisë dhe nuk është menduar të shërbejë në një mënyrë të tillë apo të shkaktojë pasoja ndaj një shteti tjetër”, ka thënë Morina.

Ai ka theksuar se çdo projekt që mund të ndryshojë drejtimin ose të rrezikojë prurjet e ujit drejt një shteti fqinj duhet të jetë në përputhje me konventat ndërkombëtare dhe të marrë edhe miratimin e vendit fqinj.

“Çdo vepër që devijon ose rrezikon prurjen e ujit drejt shtetit fqinj duhet t’i respektojë konventat ndërkombëtare, por për të nevojitet edhe leja e shtetit fqinj”, është shprehur ai.

Morina ka shtuar se realizimi i një nisme të tillë nuk mund të mbështetet vetëm te një studim fizibiliteti. Sipas tij, janë të domosdoshme edhe vlerësime të tjera, mes tyre studimet për ndikimin në mjedis.

“Nuk mund të mjaftohemi me një studim fizibiliteti nëse nuk ekzistojnë edhe studimet për ndikimin në mjedis. Këto janë çështje të kufizuara, pavarësisht fuqisë që mund të ketë një shtet”, ka përfunduar Morina.

“Na vjen keq për rrënimin e shtëpive, sidomos duke pasur parasysh se pretendimet mbi pronësinë vazhdojnë të jenë objekt i shqyrtimit gjyqësor”, deklaroi Hipper, transmeton KosovaPress.

Ajo theksoi se BE-ja u kërkon institucioneve kosovare të mos kryejnë rrënime të tjera dhe të bashkëpunojnë me banorët e prekur dhe autoritetet lokale për të arritur zgjidhje të qëndrueshme dhe në përputhje me ligjin.

Aleksandar Jakšić from Zubin Potok and Branimir Mihajlović, originally from Vushtrri and currently living in North Mitrovica, say they lost the buildings near Ujman Lake in which they had invested for years within just a few hours. Both are convinced that the properties belonged to them.

They say they carried out the construction based on documentation they hold within Serbia’s legal system. Kosovo’s institutions, meanwhile, regard the buildings as unauthorized structures on land managed by the publicly owned company Ibër-Lepenc.

Following the demolitions, Jakšić and Mihajlović also sought justice through Kosovo’s institutions. According to them, they were not told on what legal basis the removal of the buildings had begun. They also say there was no court ruling, even though they had already initiated proceedings to establish ownership.

For Jakšić, the demolition of the Jezero Hotel at Ujman represents far more than the loss of a building. He says that, in just a few hours, what his family had built over nearly 20 years was destroyed.

In a statement to Radio Free Europe, he said that he, his sister and other family members had given up many things to build the hotel. According to him, the family had invested everything there, while his parents had put all their savings and effort into the property.

Criticism from the international community

The demolition of buildings near Ujman Lake prompted critical reactions from the international community, which called on the Kosovo authorities to halt the operation immediately. The main criticism concerned the fact that the owners had initiated court proceedings after being notified to vacate the properties. For this reason, it was argued that the conclusion of the court proceedings should have been awaited.

Faruk Mujka, director of the Ibër-Lepenc company, has presented a different position. He said the institution he heads is legally obligated to protect the property under its administration. According to Mujka, the information gathered indicates that most of the buildings were constructed during 2019 and 2020.

He argued that these buildings could not be legalized under the Law on the Treatment of Unauthorized Construction because the law had entered into force in September 2018.

The owners dispute this version, insisting that their buildings were erected nearly 20 years ago and, consequently, before the law entered into force.

A third loss for Branimir Mihajlović

Branimir Mihajlović describes the demolition as the third time he has been left without everything he had built over the years.

He was born in Vushtrri but left after the 1999 war. He then settled in the village of Frashër, near Mitrovica, where his family home was located. According to him, that house was burned down during the unrest of March 2004.

Mihajlović currently lives in an apartment provided for his use by the Municipality of North Mitrovica. For this reason, the holiday home near Ujman held value for him that went beyond its function as a place to relax.

He says he had gradually invested in it for 19 years, even cutting back on food to complete the construction.

Dispute over land ownership

Aleksandar Jakšić insists that the plot on which the Jezero Hotel stood belongs to his family and that the building was erected in the early 2000s.

He claims that documents proving ownership exist within the Serbian legal system. Based on them, Jakšić has initiated a court dispute before Kosovo’s institutions, with the first hearing scheduled for August 12.

According to him, he learned only in recent days that the Kosovo authorities had changed the designated use of the land on which the hotel stood as early as 2018. Jakšić says this change now prevents him from obtaining the relevant documents within Kosovo’s system.

He disputes the claim that his family had usurped the property, asking why the authorities had not acted throughout all those years. Jakšić says they would not have begun construction if the land had not belonged to them and if they had not possessed documentation.

According to him, the family was never notified of the change in the plot’s designated use. They claim they learned of the decision only after they began receiving demolition orders for buildings around the lake.

Branimir Mihajlović, on the other hand, says he was granted the right to use the land for 99 years in 2006 by the Serbian public company Srbijašume, officially the Serbian Public Enterprise for State Forest Management. He says he regularly paid rent to the company.

During 2024, when Kosovo began closing institutions operating within Serbia’s system on the grounds that they were parallel and illegal structures, Mihajlović attempted to regularize the property’s status within Kosovo’s legal system.

Last year, he submitted an application to legalize the building. According to Mihajlović, he was prepared to pay rent to Kosovo’s institutions in the future.

Despite this, the holiday home was demolished on July 21. Meanwhile, he also received a fine of 2,000 euros for unauthorized construction.

Mihajlović wants to know why Kosovo’s institutions chose to begin their operation against unauthorized buildings specifically in the north of the country, an area where Serbs make up the majority of the population.

Following international reactions to the demolitions at Ujman, the Ministry of Environment, Spatial Planning and Infrastructure said the operation was part of a broader plan to protect water resources. The ministry warned that the removal of unauthorized buildings would continue throughout Kosovo.

Acting Minister Fitore Pacolli announced that 17 buildings have so far been removed from the area near Ujman Lake.

What does the law stipulate on demolition?

Property law expert Korab Dibra previously explained to Radio Free Europe that Article 23 of the Law on Public Property clearly establishes that public property cannot be acquired through long-term possession or by constructing a building in violation of the rules governing construction rights.

According to Dibra, this provision excludes the acquisition of ownership over public property when construction was carried out without a permit, even if an application for legalization has been submitted.

He added that the law grants Ibër-Lepenc both the right and the obligation to protect the property it manages from any unauthorized interference by third parties.

However, Dibra emphasized that the responsible authority cannot enforce a demolition order while an appeal or legalization application remains under review.

He also clarified that the law does not give Ibër-Lepenc, or any other publicly owned company, the authority to demolish buildings itself. According to him, that responsibility lies with the relevant institutions: the municipality for first- and second-category buildings, and the relevant ministry for third-category buildings.

Because houses and villas are classified as first-category buildings, Dibra says only the municipality can issue building permits and make decisions on their demolition.

Zubin Potok Mayor Miloš Perović previously said that the municipal authorities had not approved the demolition of houses and holiday homes at Ujman. He called for the issue to be resolved through compromise.

Although he acknowledges that he has little hope for the outcome of the court proceedings to establish ownership, Aleksandar Jakšić says he will continue the fight. He says the building will be rebuilt, even more beautiful and better than before.

Aleksandar Jakshiq nga Zubin Potoku dhe Branimir Mihajlloviq, me origjinë nga Vushtrria e me banim aktual në Mitrovicën e Veriut, thonë se brenda pak orësh humbën objektet pranë liqenit të Ujmanit, në të cilat kishin investuar për vite. Të dy janë të bindur se pronat u përkisnin atyre.

Ata deklarojnë se ndërtimet i kishin realizuar duke u mbështetur në dokumentacionin që posedojnë në sistemin juridik të Serbisë. Institucionet e Kosovës, ndërkaq, i trajtojnë objektet si ndërtime pa leje mbi tokën që menaxhohet nga ndërmarrja publike “Ibër-Lepenci”.

Pas rrënimeve, Jakshiqi dhe Mihajlloviqi kërkuan drejtësi edhe pranë institucioneve të Kosovës. Sipas tyre, nuk u është sqaruar se mbi cilën bazë ligjore kishte filluar largimi i objekteve. Ata thonë gjithashtu se nuk kishte vendim gjyqësor, ndonëse tashmë kishin nisur procedurën për përcaktimin e pronësisë.

Për Jakshiqin, shembja e hotelit “Jezero” në Ujman përfaqëson shumë më tepër sesa humbjen e një ndërtese. Ai thotë se, për vetëm disa orë, u shkatërrua ajo që familja e tij kishte krijuar gjatë pothuajse 20 vjetëve.

Në një deklaratë për Radion Evropa e Lirë, ai tha se së bashku me motrën dhe pjesëtarët e tjerë të familjes kishin hequr dorë nga shumë gjëra për ta ngritur hotelin. Sipas tij, familja kishte investuar gjithçka aty, ndërsa prindërit kishin vënë në atë objekt gjithë kursimet dhe mundin e tyre.

Kritikat e bashkësisë ndërkombëtare

Rrënimi i ndërtimeve në afërsi të liqenit të Ujmanit nxiti reagime kritike nga bashkësia ndërkombëtare, e cila u kërkoi autoriteteve kosovare ta ndalnin menjëherë aksionin. Kritika kryesore lidhej me faktin se pronarët, pasi ishin njoftuar të largoheshin nga pronat, kishin hapur procese gjyqësore. Për këtë arsye, u vlerësua se duhej pritur përfundimi i procedurave në gjykatë.

Drejtori i ndërmarrjes “Ibër-Lepenci”, Faruk Mujka, ka paraqitur një qëndrim tjetër. Ai tha se institucioni që drejton është i detyruar me ligj ta ruajë pronën nën administrimin e tij. Sipas Mujkës, informacionet e grumbulluara tregojnë se pjesa më e madhe e objekteve ishte ndërtuar gjatë viteve 2019 dhe 2020.

Ai argumentoi se këto ndërtime nuk mund të legalizoheshin nëpërmjet Ligjit për trajtimin e ndërtimeve pa leje, pasi ky ligj kishte hyrë në fuqi në shtator të vitit 2018.

Pronarët e kundërshtojnë këtë version, duke këmbëngulur se objektet e tyre ishin ngritur afro 20 vjet më parë dhe, rrjedhimisht, përpara hyrjes në fuqi të ligjit.

Humbja e tretë për Branimir Mihajlloviqin

Branimir Mihajlloviqi e përshkruan rrënimin si herën e tretë që mbetet pa gjithçka që kishte krijuar përgjatë viteve.

Ai ka lindur në Vushtrri, por u largua prej andej pas luftës së vitit 1999. Më pas u vendos në fshatin Frashër, afër Mitrovicës, ku kishte shtëpinë e familjes. Sipas tij, ajo shtëpi u dogj gjatë trazirave të marsit 2004.

Aktualisht, Mihajlloviqi banon në një apartament që i është dhënë për shfrytëzim nga Komuna e Mitrovicës së Veriut. Për këtë arsye, vikendica në afërsi të Ujmanit kishte për të një vlerë që shkonte përtej funksionit të një vendi për pushime.

Ai thotë se për 19 vjet kishte investuar gradualisht në të, duke kursyer edhe nga ushqimi për ta përfunduar ndërtimin.

Përplasja rreth pronësisë së tokës

Aleksandar Jakshiq këmbëngul se parcela ku ndodhej hoteli “Jezero” i takon familjes së tij dhe se objekti ishte ngritur në fillim të viteve 2000.

Ai pretendon se dokumentet që vërtetojnë pronësinë gjenden në sistemin juridik serb. Duke u bazuar në to, Jakshiqi ka hapur një kontest gjyqësor pranë institucioneve të Kosovës, ndërsa seanca e parë është planifikuar të mbahet më 12 gusht.

Sipas tij, vetëm gjatë ditëve të fundit kishte kuptuar se autoritetet e Kosovës ia kishin ndryshuar destinimin tokës ku ishte hoteli që në vitin 2018. Jakshiqi thotë se ky ndryshim tani e pengon të pajiset me dokumentet përkatëse në sistemin kosovar.

Ai kundërshton pretendimin se familja e tij e kishte uzurpuar pronën, duke pyetur se përse autoritetet nuk kishin vepruar gjatë gjithë këtyre viteve. Jakshiqi thotë se nuk do ta kishin nisur ndërtimin nëse toka nuk do të ishte e tyre dhe nëse nuk do të kishin pasur dokumentacion.

Sipas tij, familja nuk kishte marrë asnjëherë njoftim për ndryshimin e destinimit të parcelës. Ata pretendojnë se për këtë vendim mësuan vetëm pasi nisën të merrnin aktvendimet për rrënimin e objekteve përreth liqenit.

Branimir Mihajlloviqi, nga ana tjetër, deklaron se tokën e kishte marrë në shfrytëzim për 99 vjet në vitin 2006 nga ndërmarrja publike serbe “Srbijashume”, përkatësisht Ndërmarrja Publike e Serbisë për Menaxhimin e Pyjeve Shtetërore. Ai thotë se qiranë ia kishte paguar rregullisht kësaj ndërmarrjeje.

Gjatë vitit 2024, kur Kosova nisi mbylljen e institucioneve që vepronin brenda sistemit të Serbisë, me arsyetimin se ishin struktura paralele dhe të paligjshme, Mihajlloviqi u përpoq ta rregullonte statusin e pronës në sistemin juridik të Kosovës.

Vitin e kaluar ai dorëzoi kërkesë për legalizimin e objektit. Sipas Mihajlloviqit, ishte i gatshëm që në të ardhmen pagesën e qirasë t’ua bënte institucioneve kosovare.

Pavarësisht kësaj, vikendica iu rrënua më 21 korrik. Ndërkohë, ai mori edhe një gjobë prej 2.000 eurosh për ndërtim pa leje.

Mihajlloviqi kërkon të dijë përse institucionet e Kosovës zgjodhën që aksionin kundër ndërtimeve pa leje ta nisnin pikërisht në veri të vendit, zonë ku shumicën e popullsisë e përbëjnë serbët.

Pas reagimeve ndërkombëtare për rrënimet në Ujman, Ministria e Mjedisit, Planifikimit Hapësinor dhe Infrastrukturës deklaroi se ndërhyrja bën pjesë në një plan më të gjerë për mbrojtjen e burimeve ujore. Ministria paralajmëroi se largimi i ndërtimeve pa leje do të vazhdojë në të gjithë Kosovën.

Ministrja në detyrë, Fitore Pacolli, bëri të ditur se deri tani në zonën pranë liqenit të Ujmanit janë hequr 17 objekte.

Çfarë përcakton ligji për rrënimin?

Eksperti i çështjeve pronësore, Korab Dibra, kishte shpjeguar më herët për Radion Evropa e Lirë se neni 23 i Ligjit për Pronën Publike e përcakton qartë pamundësinë e përfitimit të pronësisë publike përmes posedimit afatgjatë ose ndërtimit të një objekti në kundërshtim me rregullat për të drejtën e ndërtimit.

Sipas Dibrës, kjo dispozitë e përjashton fitimin e pronësisë mbi një pronë publike kur ndërtimi është kryer pa leje, edhe nëse është dorëzuar një kërkesë për legalizimin e tij.

Ai ka shtuar se ligji i njeh ndërmarrjes “Ibër-Lepenci” si të drejtën, ashtu edhe detyrimin për ta mbrojtur pronën që menaxhon nga çdo ndërhyrje e paautorizuar e palëve të treta.

Megjithatë, Dibra ka theksuar se organi përgjegjës nuk mund ta zbatojë vendimin për rrënim për aq kohë sa një ankesë ose kërkesë për legalizim vazhdon të jetë në shqyrtim.

Ai ka sqaruar gjithashtu se ligji nuk i jep “Ibër-Lepencit”, apo ndonjë ndërmarrjeje tjetër publike, kompetencën për t’i shembur vetë objektet. Sipas tij, këtë përgjegjësi e kanë institucionet përkatëse: komuna për ndërtimet e kategorisë së parë dhe të dytë, kurse ministria kompetente për ato të kategorisë së tretë.

Meqë shtëpitë dhe vilat klasifikohen si objekte të kategorisë së parë, Dibra thotë se vetëm komuna mund të lëshojë leje ndërtimore dhe të marrë vendime për rrënimin e tyre.

Kryetari i Komunës së Zubin Potokut, Millosh Peroviq, kishte thënë më herët se organet komunale nuk kishin dhënë miratim për shembjen e shtëpive dhe vikendicave në Ujman. Ai kishte kërkuar që çështja të zgjidhej përmes një kompromisi.

On the same day that the excavation of a mass grave containing Albanians officially began in northern Kosovo, Serbian President Aleksandar Vučić did not address the issue, instead portraying Serbia as the victim, even though it was the state that had concealed the people it had killed.

During his visit to the municipality of Čačak on Thursday, Vučić claimed that Kosovo’s authorities were terrorizing Serbian citizens. He referred to the operation to demolish illegal structures in the area around Lake Ujman, as well as the Kosovo government’s decision that, starting August 1, visits to cultural, historical and religious heritage sites must be led exclusively by certified tour guides.

“Pristina’s terror is continuing, but no terror has lasted forever,” he said.

Vučić, who previously served as a senior official in the Serbian Radical Party, described in the same terms the local authorities’ work to repair roads within the Visoki Dečani Monastery’s Special Protective Zone.

“They constantly come up with something new. When they had to accept court rulings, because everything depended on them, in relation to the Europeans, the Americans and so on, they accepted them under pressure, while waiting for a new opportunity to harass our monks at the Visoki Dečani Monastery,” Vučić said.

According to a clarification from the Municipality of Deçan, work on the mountain roads within this Special Protective Zone is limited to filling potholes, clearing vegetation and shrubs, and removing dust that has accumulated along the road.

The intervention near Ujman is also a continuation of the inspectorate’s operation to demolish illegal structures that had not been removed within the deadline set by the “Ibër–Lepenc” enterprise.

Vučić’s accusations came on the very day that Kosovo’s acting president, Albulena Haxhiu, accused him of refusing to reveal the locations of Albanians who were killed and disappeared, and of failing to open archives that would help shed light on war crimes.

Jordan Jakshiq, owner of the Lake (Jezero) motel and beach bar, which Kosovo authorities demolished today in Ujman, said the intervention took him by surprise, as he claims that court proceedings over ownership of the properties were still ongoing.

Speaking to Zubin Potok Info, he said his family had filed a lawsuit against the “Ibër-Lepenci” company. According to Jakshiq, they had been notified just one day earlier that the court hearing was scheduled for August 12.

“Since we had filed a lawsuit against Ibër-Lepenci, we did not think they would come. Yesterday, we learned that the trial had been set for August 12. We believed the court proceedings would take place first and that only then would a decision be made,” he said on Thursday, after his motel and beach bar were demolished.

According to Jakshiq, two members of his family were inside the building when the intervention began, while those who entered were, as he claimed, “carrying long-barreled weapons.”

“My son and son-in-law spent the night here. They forced their way in, breaking down the dining room door and the main entrance. They found him in bed with long-barreled weapons. We did not think this would happen. We have lived here for more than 30 years,” Jakshiq said.

The building was the 17th to be demolished this month by the inspectorate of the Ministry of Environment and Spatial Planning. The actions followed a request from the “Ibër-Lepenc” company, which said all the buildings had been erected on land belonging to the public enterprise in the Lake Ujman area. The company also said that the previous owners had refused to vacate them, despite having been asked to do so at the beginning of the month.

Thursday’s demolition was carried out even though the European Union had recently called on the Kosovo authorities to halt all action until the conclusion of court proceedings concerning ownership of the buildings around Ujman.
