Deputy of the Democratic Party, Jorida Tabaku, has reconstructed the chronology of the Law on Strategic Investments, from its adoption in 2015 to the continuous extensions and today’s debates on its repeal.

Tabaku recalled that the law was initially presented as a temporary instrument aimed at attracting foreign investors and promoting investments in strategic sectors of the economy.

But, according to her, after a decade of implementation, it has turned into a mechanism for distributing public assets and properties without competition to a limited group of beneficiaries.

The Democratic deputy stated that the law has been amended nine times, while six of these interventions had the sole purpose of extending its deadline.

“Before the ink had even dried on the law, the government brought the first request to extend the deadline in 2018. The law has been amended nine times, six of which just to extend its deadline,” stated Tabaku.

She recalled that, from the moment the law was adopted in 2015, she had proposed several amendments aimed at protecting private property and prohibiting state intervention in relations between two private owners.

According to Tabaku, the amendments sought to prevent the taking of a citizen’s property at a reference price and then handing it over to another private entity, but they were rejected by the votes of the socialist majority.

The PD deputy also focused on her 2022 initiative to halt the effects of the law. She said the proposal was rejected with the argument from government representatives that the law had been useful and that work was underway on a new, permanent investment framework.

For the PD deputy, the Law on Strategic Investments is one of the clearest examples of tailor-made laws, while Parliament has been used as a “government’s notary” for narrow interests.

“This system cannot be dismantled by those who created, conceived, voted for, and implemented it. This system will be changed by Albanian society. The repeal of this law means removing one of the bricks upon which the system of favors has been built,” Tabaku concluded.

For weeks and months, the whole of Albania has risen up against a dishonest system. A system that has been built day by day by the socialist majority; built brick by brick, through decisions and laws that, unfortunately, have burdened the middle class.

A system so dishonest that 95 percent of it rests on the back and the fragile shoulders of the middle class and Albanian families, while wealth is distributed to the few.

This dishonest system was not built overnight. It is linked to tailor-made laws, to decisions, and to the way the country has been governed during these years.

The example par excellence, the best example of abuse and implementation of a law that shows how the government acts and operates, is today the Law on Strategic Investments.

The Law on Strategic Investments was first adopted, on the government’s proposal, in 2015. It was presented as a law that would bring foreign investors from every corner of the world and attract investment to Albania.

Investors would receive public assets, private property, permits, access to procedures, tax breaks, and fiscal favors to invest in our country.

But, at the end of the day, during ten years of its implementation, this law has served to distribute these public assets and private properties, taken from Albanian families and citizens, only to a tiny handful of people.

At the moment the law was adopted, in 2015, I proposed several amendments specifically related to the issue of property. To the fact that the state cannot intervene in a relationship between private parties, take the land of a citizen or a family, expropriate it at a reference price—and not at the market price—and then give it to another private party. These amendments were rejected by the force of voting cards, as always.

Before the ink had even dried on this law, the Albanian government brought the first request to extend its deadline in 2018.

The law has been amended nine times. A full nine times, six of which only to extend its deadline. The first extension came with a request from the majority.

Meanwhile, they had promised to work on a framework law for investments. It is said that they are still working on that law today. The new law never came; only successive amendments to the Law on Strategic Investments arrived.

The second request came from a group of deputies in 2019. Request after request and amendment after amendment, in every case we proposed amendments.

In 2022, even after the European Commission’s demands and after it had emerged as the most abusive law, granting public assets without competition or fair tendering to a small group of businesses close to the government, I requested that its effects be halted.

In the lengthy debate we held in several parliamentary committees, government representatives proudly defended the law and its results.

They cited “Durrës Marina” as an example, which, again, is an extraordinary example of abuse, corruption, and lack of competition in the economy. Instead of attracting a Western investor, we again chose the usual government suspects. In 2019, in 2020, and in 2023, all of these were extensions of the Law on Strategic Investments.

All these extensions were approved by the force of voting cards. Deputy after deputy and group of deputies after group of deputies, without any compromise, raised the card and voted for this abusive law; for the law against which citizens across Albania have risen up to protest today.

Just a few months before the 2025 elections, the government requested the next extension, until December 31, 2026, while having undertaken to suspend this law.

This commitment was also linked to Albania’s obligations and negotiating position in the integration process, as well as to the issues regarding the Stabilisation and Association Agreement.

The law distributes public assets and properties without competition and without tendering. It kills the economy and has mainly granted permits for hotel construction in tourism, without attracting serious foreign investors.

In another attempt, a request was made that the deadline be extended until December 31, 2027. This was later accompanied by changes to the law on tourist ports, to give every strategic investor the opportunity to also acquire a port.

This is the chronological history of this law. This is the truth. These are the facts, written in black and white, about this abusive law; about this law that today it is promised will be suspended.

About this law that has become a long debate between Albania and the European Commission. About this law that, unfortunately, reveals the socialist system, the system of the few, and the system of favors.

It is the system of taking public and private lands, the system of removing taxes and granting access to public assets without competition. Now, how much can the government’s propaganda be trusted?

How much can those who built this system be trusted that they will dismantle it? How much can those who today weep with crocodile tears and say that the protesters or the opposition are to blame be trusted? How much can those who have changed this law six times only to extend its deadline be trusted?

Nine amendments in total and never to improve competition in the economy, never for meritocracy, and never for competition. Always to favor a small group of people.

This system cannot be dismantled by those who created it. This system, with laws that pass through Parliament turning it into a mere government notary; with laws that change for narrow interests and that capture the state, cannot be changed by those who designed, conceived, voted for, approved, and implemented it.

This system will be changed by Albanian society. We must all change it together. Perhaps the results have been slow to come, because this law has caused much damage to the economy.

But dismantling this law is removing one of the bricks upon which the system has been built.

The system of the few, the socialist system, the system that has suffocated the economy, that has killed competition and that today has become the main obstacle to Albania’s development. Only by removing this majority can this system be dismantled.

Little by little, law by law, decision by decision, and favor by favor. Just as they have granted them, so they must be removed. We will change this system.

Tabaku kujtoi se ligji u prezantua fillimisht si një instrument i përkohshëm, që synonte të tërhiqte investitorë të huaj dhe të nxiste investime në sektorët strategjikë të ekonomisë.

Por, sipas saj, pas një dekade zbatimi, ai është kthyer në një mekanizëm për shpërndarjen pa garë të aseteve dhe pronave publike te një grup i kufizuar përfituesish.

Deputetja demokrate deklaroi se ligji është ndryshuar nëntë herë, ndërsa gjashtë prej ndërhyrjeve kanë pasur si qëllim vetëm shtyrjen e afatit të tij.

“Pa iu tharë ende boja ligjit, qeveria solli kërkesën e parë për shtyrjen e afatit në vitin 2018. Nëntë herë është ndryshuar ligji, gjashtë prej të cilave vetëm për t’i shtyrë afatin”, u shpreh Tabaku.

Ajo rikujtoi se, që në momentin e miratimit të ligjit në vitin 2015, kishte propozuar disa amendamente që synonin mbrojtjen e pronës private dhe ndalimin e ndërhyrjes së shtetit në marrëdhëniet ndërmjet dy pronarëve privatë.

Sipas Tabakut, amendamentet synonin të pengonin marrjen e pronës së një qytetari me çmim reference për t’ia kaluar më pas një subjekti tjetër privat, por ato u rrëzuan nga votat e mazhorancës socialiste.

Deputetja e PD-së u ndal edhe te nisma e saj e vitit 2022 për ndërprerjen e efekteve të ligjit. Ajo tha se propozimi u rrëzua me argumentin e përfaqësuesve të qeverisë se ligji kishte qenë i dobishëm dhe se po punohej për një kuadër të ri e të përhershëm për investimet.

Për deputeten e PD-së, Ligji për Investimet Strategjike, është një nga shembujt më të qartë të ligjeve me porosi, ndërsa Parlamenti është përdorur si “noter i qeverisë” për interesa të ngushta.

“Këtë sistem nuk mund ta zhbëjnë ata që e krijuan, e konceptuan, e votuan dhe e zbatuan. Këtë sistem do ta ndryshojë shoqëria shqiptare. Shfuqizimi i këtij ligji është heqja e njërës prej tullave mbi të cilat është ngritur sistemi i favoreve”, përfundoi Tabaku.

Prej javësh e muajsh, e gjithë Shqipëria është ngritur në këmbë kundër një sistemi të pandershëm. Një sistemi që është ndërtuar ditë pas dite nga mazhoranca socialiste; është ngritur tullë pas tulle, përmes vendimeve dhe ligjeve që, fatkeqësisht, kanë rënduar shtresën e mesme.

Një sistem kaq i pandershëm, që në masën 95 për qind mbahet në kurrizin dhe mbi supet e brishta të shtresës së mesme dhe të familjeve shqiptare, ndërkohë që pasuria u shpërndahet të paktëve.

Ky sistem i pandershëm nuk është ngritur brenda një dite. Ai lidhet me ligjet me porosi, me vendimet dhe me mënyrën se si është qeverisur gjatë këtyre viteve.

Shembulli par excellence, shembulli më i mirë i abuzimit dhe i zbatimit të një ligji që tregon se si vepron dhe operon qeveria, është sot Ligji për Investimet Strategjike.

Ligji për Investimet Strategjike u miratua për herë të parë, me propozim të qeverisë, në vitin 2015. U prezantua si një ligj që do të sillte investitorë të huaj nga çdo cep i botës dhe që do të tërhiqte investime në Shqipëri.

Investitorët do të merrnin asete publike, prona private, leje, akses në procedura, heqje taksash dhe favore fiskale për të investuar në vendin tonë.

Por, në përfundim të ditës, gjatë dhjetë viteve të zbatimit të tij, ky ligj ka shërbyer për t’ua shpërndarë këto asete publike dhe prona private, të marra nga familjet dhe qytetarët shqiptarë, vetëm një grushti të vogël njerëzish.

Në momentin e miratimit të ligjit, në vitin 2015, propozova disa amendamente që lidheshin pikërisht me çështjen e pronës. Me faktin se shteti nuk mund të ndërhyjë në një marrëdhënie ndërmjet privatëve, t’i marrë tokën një qytetari apo një familjeje, ta shpronësojë me çmim reference — dhe jo me çmimin që ofron tregu — për t’ia dhënë më pas një privati tjetër. Këto amendamente u rrëzuan me forcën e kartonëve, si gjithmonë.

Pa iu tharë ende boja këtij ligji, qeveria shqiptare solli kërkesën e parë për shtyrjen e afatit të tij në vitin 2018.

Nëntë herë është ndryshuar ligji. Plot nëntë herë, gjashtë prej të cilave vetëm për t’i shtyrë afatin. Shtyrja e parë erdhi me një kërkesë të mazhorancës.

Ndërkohë kishin premtuar se do të punonin për një ligj kuadër për investimet. Për atë ligj thuhet se po punohet edhe sot. Ligji i ri nuk erdhi kurrë; erdhën vetëm ndryshimet e njëpasnjëshme të Ligjit për Investimet Strategjike.

Kërkesa e dytë erdhi nga një grup deputetësh në vitin 2019. Kërkesë pas kërkese dhe ndryshim pas ndryshimi, në çdo rast ne kemi propozuar amendamente.

Në vitin 2022, edhe pas kërkesave të Komisionit Europian dhe pasi ky ishte shfaqur si ligji më abuziv, që pa konkurrencë dhe pa garë të ndershme u jepte asetet publike një grupi të vogël biznesesh pranë qeverisë, kërkova që efektet e tij të ndaleshin.

Në debatin e gjatë që zhvilluam në disa prej komisioneve parlamentare, përfaqësuesit e qeverisë e mbronin me krenari ligjin dhe rezultatet e tij.

Ata jepnin si shembull “Durrës Marinën”, e cila, përsëri, është një shembull i jashtëzakonshëm i abuzimit, i korrupsionit dhe i mungesës së garës në ekonomi. Në vend që të tërhiqnim një investitor perëndimor, përsëri zgjodhëm të dyshuarit e zakonshëm të qeverisë. Në vitin 2019, në vitin 2020 dhe në vitin 2023, të gjitha këto ishin shtyrje të Ligjit për Investimet Strategjike.

Të gjitha këto shtyrje u miratuan me forcën e kartonëve. Deputet pas deputeti dhe grup deputetësh pas grupi deputetësh, pa asnjë kompromis, ngrinin kartonin dhe votonin për këtë ligj abuziv; për ligjin kundër të cilit sot qytetarët në të gjithë Shqipërinë janë ngritur në këmbë për të protestuar.

Vetëm pak muaj para zgjedhjeve të vitit 2025, qeveria kërkoi shtyrjen e radhës, deri më 31 dhjetor 2026, ndërkohë që kishte marrë angazhimin për ta pezulluar këtë ligj.

Ky angazhim lidhej edhe me detyrimet dhe pozicionin negociues të Shqipërisë në procesin e integrimit, si dhe me problematikat në raport me Marrëveshjen e Stabilizim-Asociimit.

Ligji i ndan asetet dhe pronat publike pa konkurrencë dhe pa garë. Ai vret ekonominë dhe ka dhënë kryesisht leje për ndërtime hotelesh në turizëm, pa tërhequr investitorë seriozë të huaj.

Në një tjetër përpjekje u kërkua që afati të shkonte deri më 31 dhjetor 2027. Kjo u shoqërua më pas edhe me ndryshimet në ligjin për portet turistike, për t’i dhënë mundësi çdo investitori strategjik të merrte edhe një port.

Ky është historiku kronologjik i këtij ligji. Kjo është e vërteta. Këto janë faktet, të shkruara e zeza mbi të bardhë, për këtë ligj abuziv; për këtë ligj që sot premtohet se do të pezullohet.

Për këtë ligj që është kthyer në një debat të gjatë ndërmjet Shqipërisë dhe Komisionit Europian. Për këtë ligj që, fatkeqësisht, tregon sistemin socialist, sistemin e pakicës dhe sistemin e favoreve.

Është sistemi i marrjes së trojeve publike dhe private, sistemi i heqjes së taksave dhe i dhënies së aksesit në asetet publike pa garë. Tani, sa mund t’i besohet propagandës së qeverisë?

Sa mund t’u besohet atyre që e kanë ngritur këtë sistem se do ta zhbëjnë atë? Sa mund t’u besohet atyre që sot vajtojnë me lot krokodili dhe thonë se fajin e kanë protestuesit apo opozita? Sa mund t’u besohet atyre që plot gjashtë herë e kanë ndryshuar këtë ligj vetëm për t’i shtyrë afatin?

Nëntë ndryshime në total dhe asnjëherë për të përmirësuar garën në ekonomi, asnjëherë për meritokracinë dhe asnjëherë për konkurrencën. Gjithmonë për të favorizuar një grup të vogël njerëzish.

Këtë sistem nuk mund ta zhbëjnë ata që e kanë krijuar. Këtë sistem, me ligje që kalojnë në Parlament duke e kthyer atë në një noter të rëndomtë të qeverisë; me ligje që ndryshojnë për interesa të ngushta dhe që kapin shtetin, nuk mund ta ndryshojnë ata që e ideuan, e konceptuan, e votuan, e miratuan dhe e zbatuan.

Këtë sistem do ta ndryshojë shoqëria shqiptare. Këtë sistem duhet ta ndryshojmë të gjithë bashkë. Ndoshta rezultatet kanë vonuar të vijnë, sepse ky ligj ka bërë shumë dëme në ekonomi.

Por zhbërja e këtij ligji është heqja e njërës prej tullave mbi të cilat është ngritur sistemi.

Sistemi i pakicës, sistemi socialist, sistemi që i ka marrë frymën ekonomisë, që ka vrarë garën dhe që sot është shndërruar në pengesën kryesore për zhvillimin e Shqipërisë. Vetëm duke larguar këtë mazhorancë mund të zhbëhet ky sistem.

Pak nga pak, ligj pas ligji, vendim pas vendimi dhe favor pas favori. Ashtu siç i kanë dhënë, ashtu duhet të hiqen. Këtë sistem do ta ndryshojmë.

Democratic Party MP Jorida Tabaku stated that her political force has appealed to the Assembly for the repeal of the strategic investment law since 2017, but received no response.

During her speech in Parliament, she emphasized that this law has brought no benefit to the country, but has only distributed favors.

“In 2017, we proposed the suspension of the strategic investment law. We pointed out this problem back then, but all our calls were ignored. So far, only one foreign investor has withdrawn with this law, while everything else has been simply a division of privileges. I brought a legal proposal, but it was rejected,” she declared.

Tabaku added that Albania has no reason to distribute properties as if they were dependent on family ties and that there cannot be two different standards. “We want it for copyright, but not for strategic investments,” she concluded.

Gjatë fjalës së saj në Kuvend, ajo nënvizoi se ky ligj nuk i ka sjellë asnjë përfitim vendit, por vetëm ka shpërndarë favore.

“Në vitin 2017 ne propozuam pezullimin e ligjit për investimet strategjike. E kemi vënë në dukje këtë problem që atëherë, por të gjitha thirrjet tona u injoruan. Deri tani, vetëm një investitor i huaj është tërhequr me këtë ligj, ndërsa gjithçka tjetër ka qenë thjesht ndarje privilegjesh. Unë solla një propozim ligjor, por ai u refuzua”, deklaroi ajo.

Tabaku shtoi se Shqipëria nuk ka pse t’i ndajë pronat sikur të ishin në varësi të lidhjeve familjare dhe se nuk mund të ketë dy standarde të ndryshme. “E duam për të drejtat e autorit, por jo për investimet strategjike”, përfundoi ajo.

In a social media post, she stressed that the euro has fallen to its historic low. According to Tabaku, however, this situation does not indicate that Albania’s economy has become stronger.

The MP stated that the exchange rate of around 93 lek per euro, recorded in recent days, is not the result of more sophisticated production, the expansion of the productive economy, increased productivity or higher exports. For this reason, she said, the development is not supported by any logical economic explanation.

Analysing which sectors benefit and which are harmed, Tabaku said the losses affect businesses that invoice in euros, as well as tourism enterprises that receive payments in euros while paying their expenses in lek.

According to her, agriculture, Albanian exports, the garment and footwear sector, production and Albanian families are also being harmed by this situation.

Tabaku stressed that many families in Albania rely on income sent by relatives who have left the country. At the current exchange rate, the same amount sent in euros converts into fewer lek, reducing the income received by these families.

She reiterated that the depreciation of the euro is bringing negative consequences for the Albanian economy, domestic production and agriculture.

The Democratic MP described the situation as an alarm bell, stating that nearly one-third of the euro’s value has been lost without a justification stemming from real economic factors.

Faced with this situation, Tabaku called for immediate intervention and the drafting of a strategy that would help families, businesses, production and Albanian agriculture emerge from the crisis they currently face.

According to her, the problem is directly linked to the system and the economic model built by the Socialist majority, which she described as a failure.

Deputetja deklaroi se kursi prej rreth 93 lekësh për euro, i regjistruar gjatë ditëve të fundit, nuk është rezultat i një prodhimi më të sofistikuar, i zgjerimit të ekonomisë prodhuese, i rritjes së produktivitetit apo i shtimit të eksporteve.

Për këtë arsye, sipas saj, zhvillimi nuk mbështetet në ndonjë shpjegim logjik ekonomik.

Duke analizuar se cilët sektorë përfitojnë dhe cilët dëmtohen, Tabaku tha se humbjet prekin bizneset që faturojnë në euro, si edhe sipërmarrjet turistike që arkëtojnë pagesa në euro, ndërsa shpenzimet i kryejnë në lekë.

Sipas saj, nga kjo situatë dëmtohen gjithashtu bujqësia, eksportet shqiptare, fasoneria, prodhimi dhe familjet shqiptare.

Tabaku nënvizoi se shumë familje në Shqipëri mbështeten te të ardhurat që u dërgojnë të afërmit e larguar nga vendi. Me kursin aktual, e njëjta shumë e dërguar në euro konvertohet në më pak lekë, duke ulur të ardhurat që përfitojnë këto familje.

Ajo përsëriti se zhvlerësimi i euros po sjell pasoja negative për ekonominë shqiptare, prodhimin vendas dhe bujqësinë.

Deputetja demokrate e cilësoi situatën një kambanë alarmi, duke deklaruar se pothuajse një e treta e vlerës së euros është zhvlerësuar pa një arsyetim që buron nga faktorët realë ekonomikë.

Përballë kësaj gjendjeje, Tabaku kërkoi ndërhyrje të menjëhershme dhe hartimin e një strategjie që do t’i ndihmonte familjet, bizneset, prodhimin dhe bujqësinë shqiptare të dilnin nga kriza ku ndodhen aktualisht.

Sipas saj, problemi lidhet drejtpërdrejt me sistemin dhe me modelin ekonomik të ndërtuar nga mazhoranca socialiste, të cilin ajo e konsideroi të dështuar.

Kritike u tregua gjithashtu Ina Zhupa, e cila mbështeti shqetësimet e ngritura nga Leskaj, duke vënë në dyshim dobinë që sjell ky veprim për forcat opozitare.

Në reagimin e saj, deputetja demokrate kujtoi edhe pensionistët, duke thënë se 27% e tyre renditen si të varfër sipas standardeve kombëtare dhe ndërkombëtare.

Ajo shtoi gjithashtu se turizmi, i cilësuar si një nga shtyllat kryesore të ekonomisë, vihet në rrezik nga korrupsioni, informaliteti dhe mungesa e një vizioni afatgjatë.

Kryeministrit i ka mbetur vetëm vetëviktimizimi dhe shpikja e armiqve të brendshëm e të jashtëm, me qëllim ndërtimin e alibisë për dështimin e tij.

Nuk ka asnjë agresion të organizuar politik apo ekonomik kundër Shqipërisë. Ka qytetarë që janë ngritur kundër një qeverie dhe një sistemi që punon për pakicën dhe varfëron shumicën.

Dështimi ekonomik nuk mbulohet me propagandë. Ai shihet në tryezën gjithnjë e më të varfër të familjeve shqiptare. Ai është te pensionistët që jetojnë në kufijtë e varfërisë, ku 27% e tyre konsiderohen të varfër sipas çdo standardi kombëtar dhe ndërkombëtar.

Edhe turizmi, një nga shtyllat kryesore të ekonomisë, rrezikohet nga ky sistem i padrejtë, nga korrupsioni, informaliteti dhe mungesa e vizionit.

Ky sistem i pakicës ka krijuar moçalin që po fundos ekonominë dhe po largon shqiptarët nga vendi i tyre.

Çdo gjë tjetër është propagandë e vjetër dhe një përpjekje e dëshpëruar për të mbajtur në këmbë karakatinën e pushtetit. Koha është për ndryshim. Koha është të hapim një faqe të re për Shqipërinë.

In a reaction, she said the government is using the integration process not to build European standards, but to approve tailor-made laws.

“The system built by this majority has been based on the merging of the party with the state, the political use of institutions and citizens’ data, as well as turning the public administration into an electoral machine,” she wrote.

According to her, parliament has been turned into a notary for the interests of the ruling minority. SPAK has been constantly targeted whenever investigations touch people in power.

“SPAK’s latest files on organised crime have also shown that Albanians’ property has been treated as spoils of power, ready to be distributed to government clients and criminal groups. Meanwhile, lawful owners have spent years being sent from one administrative office to another, without receiving either their property or the justice they are entitled to,” she added.

After two days of debate in the Stabilisation and Association Committee, where opposition representatives presented with facts and arguments the real concerns of Albania and Albanians, Members of the European Parliament approved by consensus 31 of the 35 amendments submitted on behalf of the opposition in the final recommendations of the Joint Committee. These amendments are clear proof of the country’s condition.

They show that the European integration process has been used by the government not to build European standards, but to pass tailor-made laws, laws that serve a privileged minority. Integration has been treated as a notary of the abuses of those in power, not as an instrument for the democratisation of the country.

The system built by this majority has been based on the merging of the party with the state, the political use of institutions and citizens’ data, as well as turning the public administration into an electoral machine.

SPAK’s latest files on organised crime have also shown that Albanians’ property has been treated as spoils of power, ready to be distributed to government clients and criminal groups. Meanwhile, lawful owners have spent years being sent from one administrative office to another, without receiving either their property or the justice they are entitled to.

Public procurement has also been turned into spoils of war. It is micromanaged by the system to reward those who serve the machinery of power.

One of the most important amendments is the call for the repeal of the strategic investments law. For more than three years, we have called for this law to be scrapped, and most recently we have once again submitted to parliament a proposal for its repeal.

This law did not bring development. It created privileges, concentrated public and private assets in the hands of a minority, and turned the state into an intermediary for clientelist interests.

The approval of these amendments is a clear message: Europe does not accept laws on paper, nor facade integration. It demands the rule of law, competition, protected property, independent justice and institutions that serve citizens.

Albania does not need a system that works for the minority. It needs a state that works for the majority.
