The Special Prosecution Office has concluded its investigation and submitted to the Special Court of First Instance a request for trial in criminal proceeding no. 184/3 of 2024 against 15 defendants, accused as follows:

Artur Hoxhosmani, for committing the criminal offenses of:

“Trafficking in narcotic substances,” committed in cooperation, in the form of a structured criminal group, more than once, provided for by Articles 283/a/2 and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,”

“Structured criminal group,” provided for by Article 333/a/1 of the Criminal Code in the form of leadership,

“Unauthorized possession and manufacture of weapons, explosive weapons and ammunition,” in relation to the bullets found in the residence, provided for by Article 278/3 of the Criminal Code,

“Unauthorized possession and manufacture of weapons, explosive weapons and ammunition,” in the residence, provided for by Article 278/4 of the Criminal Code, as well as

“Introducing or keeping prohibited items in an institution for the execution of prison sentences,” provided for by Article 324/a/1 of the Criminal Code.

Genti (alias Kili, alias Ekil) Nderjaku and Nazmi Shahini (alias Drazhi), for committing the criminal offenses of:

“Trafficking in narcotic substances,” committed in cooperation, in the form of a structured criminal group, more than once, provided for by Articles 283/a/2 and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,” as well as

“Structured criminal group,” provided for by Article 333/a/1 of the Criminal Code in the role of leader.

“Trafficking in narcotic substances,” committed in cooperation, in the form of a structured criminal group, (in the episode of 13.12.2020, Guayaquil, Ecuador) provided for by Articles 283/a/1 and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,” as well as

“Structured criminal group” provided for by Article 333/a/1 of the Criminal Code in the form of leadership.

2. Klevis Hoxhosmani, for committing the criminal offenses of:

“Trafficking in narcotic substances,” committed in cooperation, in the form of a structured criminal group, more than once (in the episodes dated 06-07.06.2020, Rotterdam, Netherlands; and 28.10.2020, Rotterdam, Netherlands), provided for by Articles 283/a/2 and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,” as well as

“Structured criminal group,” provided for by Article 333/a/2 of the Criminal Code in the form of participant.

3. Ramazan Rraja, Plaurent Dervishaj, Amar (alias Dritan) Shkëmbi, and Amer (alias Ilir) Lloshi, for committing the criminal offenses of:

“Trafficking in narcotic substances,” committed in cooperation, in the form of a structured criminal group, provided for by Articles 283/a/1 (in the episode dated 28.10.2020, Rotterdam, Netherlands) and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,” as well as

“Structured criminal group” provided for by Article 333/a/2 of the Criminal Code in the form of participant.

4. Julian Meçaj and Bledar Polovina, for committing the criminal offenses of:

“Production and sale of narcotics,” committed in the special form of cooperation, namely that of a structured criminal group (with the typology of a continuing crime, during the period January 2020-March 2021, carried out in the form of sales and offers for sale), provided for by Articles 283/1 and 28 points 4 and 6 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,”

“Structured criminal group,” committed in the form of leadership, provided for by Article 333/a/1 of the Criminal Code.

Bashkim Haxhija and Endrit Sinani, for committing the criminal offenses of:

“Production and sale of narcotics,” committed in the special form of cooperation, namely that of a structured criminal group (with the typology of a continuing crime during the period January 2020-March 2021, carried out in the form of sales and offers for sale), provided for by Articles 283/1 and 28 points 4 and 6 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group.”

The collected case files showed that the defendants and their associates coordinated with one another in various criminal activities also through communications on the encrypted SkyEcc platform, which were obtained by the French judicial authorities within the framework of mutual legal assistance.

The investigation established and proved that the defendants, in cooperation among themselves, with persons convicted by foreign authorities, with persons prosecuted by Albanian authorities, or with persons still unidentified, trafficked from Latin American countries (Brazil, Ecuador and Colombia) and from Spain and Morocco to European countries (Italy, Belgium, Spain, the Netherlands, etc.), and also traded and offered for sale in these European countries, in the special form of cooperation of a structured criminal group, considerable quantities of 8,126 kg of narcotic substances:

7,261 kg of cocaine

590 kg of hashish

275 kg of cannabis sativa.

At the conclusion of the investigation, it was determined that defendants Artur Hoxhosmani, Genti Nderjaku (alias Kili, alias Ekil Nderjaku), Nazmi Shahini (alias Drazhi), Devid Patrut (alias Devid Boraj, alias Elidon Skëndaj, alias Fatmir Pepaj), Ermir Ndreaj and Erion Alibej (alias Erion Dylgjeri, alias Andrea Dylgjeri) had the role of leaders and financiers in the illegal activity related to narcotics, while defendants Klevis Hoxhosmani, Ramazan Rraja, Plaurent Dervishaj, Amar (alias Dritan) Shkëmbi, Amer (alias Ilir) Lloshi, Bashkim Haxhija, Julian Meçaj, Bledar Polovina and Endrit Sinani had the role of participants.

The Special Prosecution Office has submitted to the preliminary hearing judge a request to discontinue the investigation against 3 (three) persons under investigation, suspected of committing the criminal offenses provided for by Articles 283/a, 28/4, 333/a and 334/1 of the Criminal Code.

Based on the evidence collected during the investigation, it was concluded that, for one of the episodes attributed to Devid Patrut, he had already been convicted by the Belgian judicial authorities.

Consequently, in this case the principle of res judicata (ne bis in idem) applies. Meanwhile, for the investigated persons Ilir Lloshi and Julian Pjetri, it was concluded that the alleged criminal act did not exist or that the commission of the criminal offenses could not be proven.

The investigation into this criminal proceeding was carried out in close cooperation with the French, Spanish, Belgian, British, Dutch, Brazilian, Italian and Ecuadorian judicial authorities, and the National Bureau of Investigation, as well as during the phase of executing personal security measures in cooperation with investigative structures and the State Police.

With the aim of identifying the defendants’ accomplices who took part in the illegal narcotics activity and continuing the asset/financial investigation, we proceeded with the separation of the files from criminal proceeding no. 184/3 of 2024 and registered them as criminal proceeding no. 184/3.1 of 2026.

“Structured criminal group” provided for by Article 333/a/2 of the Criminal Code in the form of participant.

4. Julian Meçaj and Bledar Polovina, with committing the criminal offences of:

“Production and sale of narcotics”, committed in the special form of cooperation, namely that of a structured criminal group (with the typology of a continuing crime, during the period January 2020-March 2021, committed in the form of sales and offers for sale), provided for by Articles 283/1 and 28 points 4 and 6 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offences by a criminal organisation or structured criminal group”,

“Structured criminal group”, committed in the form of directing, provided for by Article 333/a/1 of the Criminal Code.

Bashkim Haxhija and Endrit Sinani, with committing the criminal offences of:

“Production and sale of narcotics”, committed in the special form of cooperation, namely that of a structured criminal group (with the typology of a continuing crime during the period January 2020-March 2021, committed in the form of sales and offers for sale), provided for by Articles 283/1 and 28 points 4 and 6 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offences by a criminal organisation or structured criminal group”.

The evidence gathered showed that the defendants and their associates coordinated with one another in various criminal activities also through communications on the encrypted SkyEcc platform, which were obtained by the French judicial authorities within the framework of mutual legal assistance.

Nga aktet e administruara ka rezultuar se të pandehurit dhe bashkëpunëtorët e tyre kanë koordinuar me njëri-tjetrin në aktivitete të ndryshme kriminale edhe përmes komunikimeve në platformën e enkriptuar SkyEcc, të cilat janë administruar nga autoritetet e drejtësisë franceze në kuadër të ndihmës së ndërsjelltë juridike.

Nga hetimet e kryera ka rezultuar e provuar se të pandehurit në bashkëpunim mes tyre, me persona të dënuar nga autoritetet e huaj, me persona të proceduar nga autoritetet shqiptare, apo persona ende të paidentifikuar, kanë trafikuar nga vendet e Amerikës Latine (Brazil, Ekuador e Kolumbi) dhe Spanja e Maroku për në vendet evropiane (Itali, Belgjikë, Spanjë, Holandë etj.,), si dhe kanë tregtuar dhe ofruar për shitje në këto shtete evropiane në formën e veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, sasi të konsiderueshme prej 8126 kg lëndë narkotike:

7261 kg, lëndë narkotike e llojit kokainë

590 kg, bimë narkotike e llojit hashash

275 kg, bimë narkotike e llojit kanabis sattiva.

Në përfundim të hetimeve është konkluduar se të pandehurit Artur Hoxhosmani, Genti Nderjaku (alias Kili, alias Ekil Nderjaku), Nazmi Shahini (alias Drazhi), Devid Patrut (alias Devid Boraj, alias Elidon Skëndaj, alias Fatmir Pepaj), Ermir Ndreaj dhe Erion Alibej (alias Erion Dylgjeri, alias Andrea Dylgjeri), kanë pasur rolin e drejtuesit dhe financuesit në veprimtarinë e paligjshme që lidhen me narkotikët, ndërsa të pandehurit Klevis Hoxhosmani, Ramazan Rraja, Plaurent Dervishaj, Amar (alias Dritan) Shkëmbi, Amer (alias Ilir) Lloshi, Bashkim Haxhija, Julian Meçaj, Bledar Polovina dhe Endrit Sinani, kanë patur rolin e pjesëmarrësve.  

Prokuroria e Posaçme, ka depozituar pranë gjyqtarit të seancës paraprake kërkesën për pushimin e hetimeve ndaj 3 (tre) personave nën hetim, të dyshuar për kryerjen e veprave penale të parashikuara nga nenet 283/a, 28/4, 333/a dhe 334/1 të Kodit Penal.

Bazuar në aktet e administruara gjatë hetimit, është konkluduar se, për një nga episodet e atribuuara të hetuarit Devid Patrut, ky i fundit është dënuar nga autoritetet belge të drejtësisë.

Për rrjedhojë, në këtë rast gjen zbatim parimi i gjësë së gjykuar (ne bis in idem). Ndërsa, për të hetuarit Ilir Lloshi dhe Julian Pjetri, u konkludua se fakti penal i atribuuar nuk ekzistonte ose nuk u arrit të provohej kryerja e veprave penale.

Hetimet rreth këtij procedimi penal janë zhvilluar në bashkëpunim të ngushtë me autoritetet franceze, spanjolle, belge, britanike, holandeze, braziliane, italiane, ekuadoriane të drejtësisë, dhe Byronë Kombëtare të Hetimit, si dhe gjatë fazës së ekzekutimit të masave të sigurimit personal në bashkëpunim me strukturat e hetimit me Policinë e Shtetit.

Me qëllim identifikimin e bashkëpunëtorëve të të pandehurve që kanë marrë pjesë në aktivitetin e paligjshëm në fushën e narkotikëve dhe vijimin e hetimit pasuror/financiar kemi proceduar me ndarjen e akteve të procedimit penal nr. 184/3 të vitit 2024, dhe numërtimin si procedimi penal nr. 184/3.1 i vitit 2026.

SPAK falenderon autoritetet e drejtësisë franceze, spanjolle belge, britanike, holandeze, braziliane, italiane, ekuadoriane, Eurojust dhe Europol, për mbështetjen dhe ndihmën në këtë procedim.

Criminal proceeding No. 9 of 2024 was registered on 18.1.2024 for the criminal offenses of “Trafficking in narcotic substances,” committed in cooperation in the form of a structured criminal group, provided for by Articles 283/a and 28 point 4 of the Criminal Code; “Structured criminal group,” provided for by Article 333/a of the Criminal Code; as well as “Commission of criminal offenses by a criminal organization and structured criminal group,” provided for by Article 334 of the Criminal Code, with no identified perpetrator.

The investigation was carried out in close cooperation with European judicial authorities, the Criminal Police Department, the National Bureau of Investigation (BKH), as well as with the support of Eurojust and Europol.

Investigations so far have created reasonable suspicion that the criminal group organized the trafficking of narcotic substances from Albania to Montenegro with Germany as the final destination, from Albania to Turkey, and from South American countries to European Union countries.

Part of the communications between the suspected members was obtained through analysis of conversations on the encrypted Sky ECC platform, administered by the French authorities within the framework of international legal assistance.

The investigations have documented three episodes of international drug trafficking:

On November 3, 2020, Montenegrin authorities seized 1,722 kilograms of marijuana, transported from Albania with Germany as its final destination.

On January 26, 2021, Turkish authorities seized 236 kilograms of marijuana, sent from Albania to Turkey.

On November 23, 2020, Dutch authorities seized 475 kilograms of cocaine at the Port of Vlissingen, a shipment that had arrived from Ecuador.

Through the examination and analysis of the collected data, it was initially possible to identify 14 (fourteen) persons under investigation, previously prosecuted for the purposes of this criminal proceeding: I. S., (alias X.,), E. Sh., R. Rr., B. S (alias X), A. N (alias L. S.,), H. S (alias X, alias L.,), V. B., P. Rr., G. Rr., A. A., (alias Ç.,), A. Gj., (alias I.,), A. Q., J. Ç., and M. B., against whom personal security measures have also been imposed, as they are suspected of having been involved in criminal activity related to drug trafficking.

As a result of further investigations, citizen E.B was identified as one of the leaders of the structured criminal group, particularly in relation to the second episode, the trafficking of narcotic substances to Turkey. The Special Prosecution requested that the Special Court of First Instance impose a personal security measure against citizen E.B. By decision No. 51, dated 3.7.2026, the Special Court imposed the security measure of “arrest in prison” against him, provided for by Article 238 of the Criminal Procedure Code. This measure was executed on 6.7.2026 by State Police structures.

As for the person under investigation, E. B., against whom there are reasonable suspicions based on evidence that he committed elements of the criminal offenses of “Trafficking in narcotic substances,” committed in cooperation in the special form of cooperation, that of a structured criminal group, provided for by Articles 283/a and 28 point 4 of the Criminal Code, in connection with Article 334/1 of the Criminal Code, “Commission of criminal offenses by a criminal organization or structured criminal group,” and “Structured criminal group,” provided for by Article 333/a/1 of the Criminal Code.

The investigation continues with the collection of evidence on the involvement of other persons suspected of being part of these illegal criminal activities.

Procedimi penal nr.9 i vitit 2024, është rregjistruar më 18.1.2024 për veprat penale: “Trafikim i lëndëve narkotike”, kryer në bashkëpunim në formë të grupit të strukturuar kriminal, parashikuar nga nenet 283/a dhe 28 pika 4 të Kodit Penal; “Grup i strukturuar kriminal”, parashikuar nga neni 333/a të Kodit Penal, si dhe “Kryerje e veprave penale nga organizata kriminale dhe grup i strukturuar kriminal”, parashikuar nga neni 334 i Kodit Penal, pa autor.

Hetimet kanë dokumentuar tre episode të trafikut ndërkombëtar të drogës:

• Më 3 nëntor 2020, autoritetet malazeze sekuestruan 1,722 kilogramë marijuanë, e transportuar nga Shqipëria me destinacion përfundimtar Gjermaninë.
• Më 26 janar 2021, autoritetet turke sekuestruan 236 kilogramë marijuanë, të nisur nga Shqipëria drejt Turqisë.
• Më 23 nëntor 2020, autoritetet holandeze sekuestruan 475 kilogramë kokainë në Portin e Vlissingen, ngarkesë e ardhur nga Ekuadori.

Nga këqyrja dhe analiza e të dhënave të administruara, është bërë e mundur identifikimi fillimisht i 14 (katërmbëdhjetë) personave nën hetim, të proceduar më parë për interesa të këtij procedimi penal: I. S., (alias X.,), E. Sh., R. Rr., B. S (alias X), A. N (alias L. S.,), H. S (alias X, alias L.,), V. B., P. Rr., G. Rr., A. A., (alias Ç.,), A. Gj., (alias I.,), A. Q., J. Ç., dhe M. B., ndaj të cilëve, janë caktuar dhe masat e sigurimit personal pasi dyshohen se kanë qenë të përfshirë në veprimtari kriminale në trafikimin të lëndëve narkotike.

Si rezultat i hetimeve të mëtejshme është identifikuar shtetasi E.B, njëri prej drejtuesve të grupit të strukturuar kriminal, veçanërisht për episodin e dytë, të trafikut të lëndës narkotike drejt Turqisë. Prokuroria e Posaçme i kërkoi Gjykatës së Posaçme të Shkallës së Parë caktimin e masës së sigurimit personal ndaj shtetasit E.B. Me vendimin nr. 51, datë 3.7.2026, Gjykata e Posaçme vendosi ndaj tij masën e sigurimit “arrest në burg”, parashikuar nga neni 238 i Kodit të Procedurës Penale. Kjo masë u ekzekutua më 6.7.2026 nga strukturat e Policisë së Shtetit.

Ndaj personit nën hetim E. B., ndaj të cilit ekzistojnë dyshime të arsyeshme të bazuara në prova se ka konsumuar elementë të veprave penale:“Trafikim i lëndëve narkotike”, kryer në bashkëpunim në formën e veçantë të bashkëpunimit, atë të grupit të strukturuar kriminal, parashikuar nga nenet 283/a dhe 28 pika 4 të Kodit Penal, në lidhje me nenin 334/1 të Kodit Penal, “Kryerje e veprave penale nga organizata kriminale ose grup i strukturuar kriminal”, dhe “Grup i strukturuar kriminal”, parashikuar nga neni 333/a/1 i Kodit Penal.

Hetimet vazhdojnë me administrimin e provave për implikimin e personave të tjerë, që dyshohet të jenë përfshirë në këto veprimtari të paligjshme kriminale.

The defendants are Domingo Romillo Iriarte, Mihaela Munteanu Manole, Alvaro Romillo Castillo and Doris Pere.

According to SPAK, the first three are accused of money laundering as part of a structured criminal group, while Doris Pere is accused of money laundering in collaboration.

The investigation found that during 2024 the defendants created three commercial companies in Albania: specifically, “Wingwort” sh.p.k., “Wortnova” sh.p.k. and “Wortend” sh.p.k., which did not carry out real economic activity but were used to introduce funds of suspected criminal origin into the formal economy.

SPAK says high-value banking transactions were identified, along with invoices suspected of being fictitious, international transfers without supporting documentation, and investments in real estate and luxury vehicles.

According to the investigative file, part of the funds were used to buy two properties in the Dhërmi area, with a total surface area of 23.16 hectares, for a declared value of 1.62 million euros. An expert assessment found that the actual market value of these properties was higher than the value declared in the sale contracts.

SPAK’s announcement:

The Special Prosecution Against Corruption and Organized Crime has submitted to the Special Court of First Instance the request for the trial of criminal proceeding no. 136 of 2024 against the defendants:

1. Domingo Romillo Iriarte, accused of the criminal offense of “Laundering the proceeds of a criminal offense or criminal activity,” committed in the special form of cooperation, namely that of a structured criminal group, “Structured criminal group,” and “Commission of criminal offenses by a structured criminal group and criminal organization,” provided for by Articles 287, 28/4, 333/a/1 and 334 of the Criminal Code.

2. Mihaela Munteanu Manole, accused of the criminal offense of “Laundering the proceeds of a criminal offense or criminal activity,” committed in the special form of cooperation, namely that of a structured criminal group, “Structured criminal group,” and “Commission of criminal offenses by a structured criminal group and criminal organization,” provided for by Articles 287, 28/4, 333/a/2 and 334 of the Criminal Code.

3. Alvaro Romillo Castillo, accused of the criminal offense of “Laundering the proceeds of a criminal offense or criminal activity,” committed in the special form of cooperation, namely that of a structured criminal group, “Structured criminal group,” and “Commission of criminal offenses by a structured criminal group and criminal organization,” provided for by Articles 287, 28/4, 333/a/2 and 334 of the Criminal Code.

4. Doris Pere, accused of the criminal offense of “Laundering the proceeds of a criminal offense or criminal activity,” committed in collaboration, provided for by Article 287/2 of the Criminal Code.

The investigation found that the defendants created and used the commercial companies “Wingwort” sh.p.k., “Wortnova” sh.p.k. and “Wortend” sh.p.k., registered in Albania during June 2024 with minimal capital, with the same address for all three companies, but without carrying out any real economic activity.

According to the evidence collected, these companies were used as mechanisms for introducing funds of suspected criminal origin into circulation and integrating them into the formal economy. The investigation identified banking and tax transactions of considerable value, invoices suspected of being fictitious, payments without supporting economic documentation, as well as international transfers with foreign entities linked to the people involved in this scheme.

The company “Wortend” sh.p.k. carried out high-value financial turnover that does not match its declared activity and its real economic capacity. Bank credits exceeding the value of issued invoices were also identified, as well as payments to foreign companies without supporting documentation and purchases of real estate and high-value vehicles. Part of the funds were used to purchase two real estate properties in the Dhërmi area, with a total surface area of 23.16 hectares, for the value of 1,621,200 euros.

The valuation expert report found that the market value of these properties at the time of sale was higher than the value declared in the contract.

During the investigation, information obtained through international cooperation from the judicial authorities of the Kingdom of Spain was collected, showing that some of the defendants are under investigation for the criminal offense of fraud.

From the analysis of the evidence, it emerged that defendant Domingo Romillo Iriarte had the leading and organizing role in the creation and operation of the scheme, managing the commercial companies, directing the movement of funds and deciding on investments in real estate and other assets.

The defendants Mihaela Munteanu Manole and Alvaro Romillo Castillo are suspected of having taken part in this criminal structure through their formal roles in the companies “Wortnova” sh.p.k. and “Wortend” sh.p.k., contributing to the creation of a lawful appearance for the economic activity and to the circulation of the funds.

Meanwhile, defendant Doris Pere is suspected of having assisted in the operation of the scheme by carrying out administrative, banking and organizational actions in Albania, including securing and using addresses for the commercial companies, as well as making various payments on their behalf.

A “preventive seizure” asset security measure has been imposed on assets owned by the defendants Domingo Romillo Iriate, Alvaro Romillo Castillo and Mihaela Munteanu Manote.

At the conclusion of the investigation, the Special Prosecution assessed that the evidence gathered is sufficient to send the case to trial against the above-mentioned defendants.

Nga hetimet ka rezultuar se gjatë vitit 2024 të pandehurit krijuan tre shoqëri tregtare në Shqipëri. Konkretisht, “Wingwort” sh.p.k., “Wortnova” sh.p.k. dhe “Wortend” sh.p.k. të cilat nuk ushtronin aktivitet real ekonomik, por përdoreshin për të futur në ekonominë formale fonde me origjinë të dyshuar kriminale.

SPAK thotë se janë konstatuar transaksione bankare me vlera të larta, fatura të dyshuara si fiktive, transferta ndërkombëtare pa dokumentacion justifikues, si dhe investime në pasuri të paluajtshme dhe automjete luksoze.

Sipas dosjes hetimore, një pjesë e fondeve janë përdorur për blerjen e dy pronave në zonën e Dhërmiut, me sipërfaqe totale 23.16 hektarë, për një vlerë të deklaruar prej 1.62 milionë eurosh. Ekspertiza ka konstatuar se vlera reale në treg e këtyre pasurive ishte më e lartë se ajo e deklaruar në kontratat e shitblerjes.

4.Doris Pere, e akuzuar për veprën penale “Pastrim i produkteve të veprës penale ose veprimtarisë kriminale”, kryer në bashkëpunim, parashikuar nga neni 287/2 i Kodit Penal.

Nga hetimet e kryera ka rezultuar se të pandehurit kanë krijuar dhe përdorur shoqëritë tregtare “Wingwort” sh.p.k., “Wortnova” sh.p.k. dhe “Wortend” sh.p.k., të regjistruara në Shqipëri gjatë muajit qershor 2024 me kapital minimal, me të njëjtën adresë për të tre shoqëritë, por pa zhvilluar veprimtari reale ekonomike.

Sipas provave të administruara, këto shoqëri janë përdorur si mekanizma për futjen e fondeve me origjinë të dyshuar kriminal, në qarkullimin dhe integrimin në ekonominë formale. Hetimet kanë evidentuar, transaksione bankare dhe tatimore me vlera të konsiderueshme, fatura të dyshuara si fiktive, pagesa pa dokumentacion ekonomik justifikues, si dhe transferta ndërkombëtare me subjekte të huaja, të lidhura me personat e përfshirë në këtë skemë.

Shoqëria “Wortend” sh.p.k. ka realizuar qarkullime financiare në vlera të larta, të cilat nuk përputhen me aktivitetin e deklaruar dhe kapacitetet reale ekonomike të saj. Gjithashtu, janë konstatuar kreditime bankare që tejkalojnë vlerën e faturave të lëshuara, pagesa ndaj shoqërive të huaja pa dokumentacion justifikues, si dhe blerje të pasurive të paluajtshme dhe automjeteve me vlerë të lartë. Një pjesë e fondeve janë përdorur për blerjen e dy pasurive të paluajtshme në zonën e Dhërmiut, me sipërfaqe totale 23.16 hektarë, kundrejt vlerës 1,621,200 euro.

Nga akti i ekspertimit vlerësues ka rezultuar se vlera e tregut e këtyre pasurive në momentin e shitblerjes ishte më e lartë se vlera e deklaruar në kontratë.

Gjatë hetimit është administruar informacion i ardhur përmes bashkëpunimit ndërkombëtar nga autoritetet gjyqësore të Mbretërisë së Spanjës, ku rezulton se disa prej të pandehurve janë subjekt hetimi për vepra penale të mashtrimit.

Nga analiza e provave, ka rezultuar se i pandehuri Domingo Romillo Iriarte ka pasur rolin drejtues dhe organizues në krijimin dhe funksionimin e skemës, duke administruar shoqëritë tregtare, duke orientuar qarkullimin e fondeve dhe vendosur për investimet në pasuri të paluajtshme dhe asete të tjera.

Të pandehurit Mihaela Munteanu Manole dhe Alvaro Romillo Castillo dyshohet se kanë marr pjesë në këtë strukturë kriminale përmes rolit të tyre formal në shoqëritë, “Wortnova” sh.p.k. dhe “Wortend” sh.p.k., duke kontribuar në krijimin e pamjes së ligjshme të veprimtarisë ekonomike dhe në qarkullimin e fondeve.

Ndërsa e pandehura, Doris Pere dyshohet se ka ndihmuar në funksionimin e skemës duke kryer veprime administrative, bankare dhe organizative në Shqipëri përfshirë sigurimin dhe përdorimin e adresave për shoqëritë tregtare, si dhe kryerjen e pagesave të ndryshme në emër të tyre.

Mbi pasuritë në pronësi të të pandehurve Domingo Romillo Iriate, Alvaro Romillo Castillo dhe Mihaela Munteanu Manote është vendosur masa e sigurimit pasuror “sekuestro preventive”.

Në përfundim të hetimeve, Prokuroria e Posaçme ka çmuar se provat e mbledhura janë të mjaftueshme për dërgimin e çështjes në gjyq në ngarkim të të pandehurve të sipërcituar.

The defendant’s lawyer, Gurali Brahimllari, argued that Xoxa is unable to review the contents of the case materials and to communicate freely with her defense lawyers after giving birth by surgery.

According to Brahimllari, Xoxa’s position is the one set out in the request submitted to the court, while her health condition does not allow her to take part in the proceedings.

“Mrs. Xoxa’s position is the one expressed in the request submitted to the court. She has been unable to familiarize herself with their contents. Even previously she was on medical leave, but we prepared and worked on the preliminary requests. The defendant has expressed her position, making known the fact that on June 29 she gave birth by surgery and cannot communicate freely and privately with her defense lawyers, therefore an effective defense cannot be carried out. The postponement of the hearing is requested until the end of the work incapacity report. Under the Labor Code, the postponement of the process is requested until this issue ceases. The law guarantees 63 days of leave after childbirth. In view of the above, in this factual situation, being unable to ensure an effective defense, the suspension of the process is requested, based on the right of every mother,” lawyer Gurali Brahimllari said.

According to the request filed with the court, Xoxa argues that she wishes to be personally present in the proceedings to guarantee an effective defense and does not authorize her lawyers to represent her in her absence.

“I request to be personally present and I do not authorize my defense lawyers to continue my defense without my presence,” Xoxa said in a statement.

On the other hand, SPAK opposed Xoxa’s request, asking the Special Court Against Corruption and Organized Crime to separate her case from that of Veliaj and the other defendants. Prosecutor Altin Dumani said the conditions have been met for the judicial process to continue and that the defendant’s lawyers’ request to suspend the trial until the end of maternity leave is not provided for by law. Speaking about Xoxa’s request to be present at the proceedings, Dumani said the law refers only to postponing the hearing, while suspending the trial is not a measure предусмотрено in this case.

Altin Dumani: We believe the conditions are in place for the judicial process to continue. Regarding Xoxa’s request, the law refers to postponing the hearing, while the lawyers have requested suspension of the trial until the end of maternity leave. The law does not provide for such a thing. But we are in a situation where the defendant states that she wishes to be present. This judicial review began in September of last year and she has not been present at any hearing. If the court considers Xoxa’s presence necessary, then her case should be separated.

Gurali Brahimllari: We oppose the Prosecution’s position, because the law provides for the uninterrupted conduct of the trial. However, suspension of the review is provided for in certain cases, such as when an expert examination is carried out or an assessment of the defendant’s mental condition. So there are cases where suspension is expressly determined. In circumstances where the mother has given birth by cesarean section, we are in such a situation. Since she is on medical leave, determined by the doctor, like every mother in the Republic of Albania, we request that the request for postponement and suspension of the process be accepted. If the court decides to separate the case, that would not be economical.
