Former Democratic Party of Kosovo MP Dr. Shaip Muja has sent a letter to the Kosovo Specialist Chambers in The Hague, stating that after being questioned in 2019, he chose to remain silent publicly because he had been summoned as a suspect in connection with the allegations raised in the Dick Marty Report.

Muja recalls that at the time he appeared without a defense lawyer, although he had been offered that option, and told investigators: “If you have evidence, arrest me, because I have nothing to fear.” He reaffirms his belief that the allegations of human organ trafficking made against him and other members of the Kosovo Liberation Army were untrue.

In his letter, the former MP strongly criticizes the way the allegations in the Dick Marty Report were turned into serious public accusations over the years. He adds that these accusations have had tangible consequences for him personally and for his family.

Muja openly declares that he stands behind Hashim Thaçi, Jakup Krasniqi, Kadri Veseli and Rexhep Selimi, strongly believing in their innocence. A particular concern in his letter is the length of the judicial process and the long period the accused have spent in detention, while he emphasizes that the final verdict must be based solely on evidence and the law.

According to him, the case of the four accused carries weight that goes beyond their personal fate, as the verdict could shape how Kosovo’s war is remembered and interpreted. He insists that the trial must be conducted independently of political beliefs and perceptions that have become entrenched over the years.

“Facts, the law and justice must be stronger than stigmatization, propaganda, politics and prejudice,” Dr. Shaip Muja concludes in the letter. In the document, he explains that his silence for so many years was not an admission of the accusations, but respect for an ongoing judicial process.

He describes the Dick Marty Report as a political document adopted by the Council of Europe which, in his view, generated major institutional and legal consequences, exposing certain people to public suspicion long before justice had its say. Muja also draws attention to the political context, mentioning Serbia’s interest in influencing the interpretation of the war and the role of the Kosovo Liberation Army, also using materials and allegations from Serbian sources.

He acknowledges that the origin of information does not automatically invalidate it as evidence, but insists that the context in which certain accusations were devised and disseminated cannot be ignored. Muja recounts that he has faced continuous defamation, with suspicion against him treated as an established fact, damaging him professionally, publicly and personally.

Although he does not deny anyone the right to think differently, he raises the question of what remains of the presumption of innocence when someone lives for nearly 16 years under the weight of an unproven public accusation. Muja reaffirms his pride in the Kosovo Liberation Army’s war and describes it as a liberation army, but adds that no one is above the law.

He warns that a possible conviction of the Kosovo Liberation Army’s main leaders would be used and interpreted as a judgment on the organization itself and the character of its war, bringing historical and political consequences beyond the individual legal ones. Nevertheless, he emphasizes that individual responsibility, if proven, cannot be turned into the responsibility of an entire organization or into a judgment on the war in Kosovo.

Muja emphasizes that Kosovo was not liberated on its own and that the role of NATO, the United States and European countries was decisive, adding that the Euro-Atlantic orientation remains a strategic choice for the state of Kosovo. He also recalls that the Kosovo Specialist Chambers themselves were established through Kosovo’s institutions and that the accused did not evade justice when they were summoned.

In the letter, he expresses concern about such a prolonged judicial process and about the years spent in detention by people who still enjoy the presumption of innocence. He adds that a court should not be influenced by questions about whether the accused will have a political role in the future.

Muja explains that his support for the accused is not a request for the court to share his belief, but that he hopes that, once the process is over, they will return freely to Kosovo. He insists that the final verdict must be shaped neither by his beliefs nor by those of people who declared them guilty beforehand, but solely by what has been proven in the courtroom.

He concludes the letter by saying that, for him, this story is not simply an abstract debate, but a part of his life with real costs, and that the only thing he asks is for the legal assessment not to be influenced by everything that has been said and written over the years.

Shaip Muja, ka dërguar një letër drejtuar Dhomave të Specializuara në Hagë, ku shprehet se pasi u mor në pyetje në vitin 2019, zgjodhi të heshtë publikisht për shkak se ishte thirrur në cilësinë e të dyshuarit, lidhur me akuzat e ngritura në Raportin e Dick Marty-t.

Muja rikujton se në atë kohë u paraqit pa avokat mbrojtës, ndonëse kjo mundësi i ishte ofruar, dhe u kishte thënë hetuesve: “Nëse keni fakte, më arrestoni, sepse nuk kam për çfarë të kem frikë”. Ai rikonfirmon bindjen e tij se pretendimet për trafikim të organeve njerëzore, të ngritura ndaj tij dhe pjesëtarëve të tjerë të UÇK-së, kanë qenë të pavërteta.

Në letrën e tij, ish-deputeti shpreh kritika të ashpra për mënyrën se si, gjatë viteve, pretendimet e raportit të Dick Marty-t janë shndërruar në akuza të rënda publike. Ai shton se këto akuza i kanë sjellë pasoja të prekshme atij personalisht dhe familjes së tij.

Muja deklaron hapur se qëndron pas Hashim Thaçit, Jakup Krasniqit, Kadri Veselit dhe Rexhep Selimit, duke besuar fuqishëm në pafajësinë e tyre. Një shqetësim i veçantë në letrën e tij është edhe kohëzgjatja e procesit gjyqësor dhe periudha e gjatë që të akuzuarit po kalojnë në paraburgim, teksa thekson se vendimi përfundimtar duhet të mbështetet vetëm në prova dhe në ligj.

Sipas tij, rasti i katër të akuzuarve ka një peshë që tejkalon fatin e tyre personal, pasi vendimi mund të formësojë mënyrën se si do të kujtohet dhe interpretohet lufta e Kosovës. Ai insiston se gjykimi duhet të bëhet i shkëputur nga bindjet politike dhe perceptimet e ngulitura përgjatë viteve.

“Faktet, ligji dhe drejtësia duhet të jenë më të forta se stigmatizimi, propaganda, politika dhe paragjykimi”, përmbyll letrën dr. Shaip Muja. Në shkresë, ai sqaron se heshtja e tij për vite me radhë nuk ishte pranim i akuzave, por respekt për një proces gjyqësor në zhvillim.

Ai e cilëson Raportin e Dick Marty-t një dokument politik të miratuar në Këshillin e Europës, i cili, sipas tij, gjeneroi pasoja të mëdha institucionale dhe juridike, duke i ekspozuar disa njerëz ndaj dyshimit publik shumë përpara se drejtësia të jepte fjalën e saj. Muja tërheq vëmendjen edhe mbi kontekstin politik, duke përmendur interesin e Serbisë për të ndikuar në interpretimin e luftës dhe rolit të UÇK-së, duke përdorur gjithashtu materiale dhe pretendime nga burime serbe.

Ai pranon se prejardhja e një informacioni nuk e zhvlerëson automatikisht atë si provë, por insiston se konteksti në të cilin u sajuan dhe u përhapën disa akuza nuk mund të injorohet. Muja rrëfen se është përballur me përgojime të vazhdueshme, duke e trajtuar dyshimin ndaj tij si fakt të vërtetuar, gjë që e ka dëmtuar në sferën profesionale, publike dhe personale.

Ndonëse nuk ia mohon askujt të drejtën për të menduar ndryshe, ai ngre pyetjen se ç’mbetet nga prezumimi i pafajësisë kur dikush jeton gati 16 vjet nën peshën e një akuze publike të paprovuar. Muja ripohon krenarinë për luftën e UÇK-së dhe e cilëson atë një ushtri çlirimtare, por shton se askush nuk është mbi ligjin.

Ai paralajmëron se një dënim i mundshëm i drejtuesve kryesorë të UÇK-së do të përdorej dhe do të interpretohej si një gjykim mbi vetë organizatën dhe karakterin e luftës së saj, duke sjellë pasoja historike dhe politike përtej atyre juridike individuale. Megjithatë, ai thekson se përgjegjësia individuale, nëse provohet, nuk mund të shndërrohet në përgjegjësi të një organizate të tërë apo në një gjykim mbi luftën e Kosovës.

Muja nënvizon se Kosova nuk u çlirua e vetme dhe se roli i NATO-s, SHBA-së dhe vendeve europiane ishte vendimtar, duke shtuar se orientimi euroatlantik mbetet një zgjedhje strategjike e shtetit të Kosovës. Ai kujton gjithashtu se vetë Dhomat e Specializuara u krijuan përmes institucioneve të Kosovës dhe se të akuzuarit nuk iu shmangën drejtësisë kur u thirrën.

Në letër, ai shpreh shqetësimin për një proces gjyqësor kaq të zgjatur dhe për vitet e kaluara në paraburgim nga persona që ende gëzojnë prezumimin e pafajësisë. Ai shton se një gjykatë nuk duhet të ndikohet nga pyetjet nëse të akuzuarit do të kenë apo jo rol politik në të ardhmen.

Muja sqaron se mbështetja e tij për të akuzuarit nuk është një kërkesë që gjykata të ndajë bindjen e tij, por shpreson që pas përfundimit të procesit, ata të kthehen të lirë në Kosovë. Ai insiston se vendimi përfundimtar nuk duhet të formësohet as nga bindjet e tij, as nga ato të atyre që i kanë shpallur fajtorë që më parë, por vetëm nga ajo që është provuar në sallën e gjyqit.

Ai e mbyll letrën duke thënë se për të kjo histori nuk është thjesht një debat abstrakt, por një pjesë e jetës me kosto reale, dhe se e vetmja gjë që kërkon është që vlerësimi juridik të mos ndikohet nga gjithçka që është thënë dhe shkruar në këto vite.
