The Court of Appeals of Kosovo has decided to change the first-instance judgment in the case known as the “Veterans” case, acquitting Agim Çeku and nine former members of the Government Commission for the Verification of Veterans. The decision also upholds the acquittal of Nuredin Lushtaku and Smajl Elezaj.

The criminal panel of the Special Department of the Court of Appeals accepted the defense appeals and changed the judgment of the Basic Court in Pristina, dated 12 September 2025. Under that decision, ten defendants had been found guilty and sentenced to one year in prison each.

The acquittal covers Agim Çeku, Sadik Halitjaha, Shkumbin Demaliaj, Qelë Gashi, Shukri Buja, Ahmet Daku, Rrustem Berisha, Faik Fazliu, Fadil Shurdhaj and Xhavit Jashari.

According to the Court of Appeals, it was not proven during the proceedings that the defendants had jointly committed the criminal offense of abusing their official position or authority.

The court also deemed unfounded the Special Prosecution’s appeal against the decision to acquit Nuredin Lushtaku and Smajl Elezaj. Both had been found not guilty at the first-instance level.

With this decision, all 12 people involved in the proceedings have been acquitted. The decision was reported on 11 September, while the judgment of the Court of Appeals is dated 9 September 2026.

The Special Prosecution had requested that Lushtaku and Elezaj be found guilty, while seeking harsher sentences for the other ten defendants.

The Court of Appeals did not accept this position. The Prosecution’s appeal against the acquittal was rejected, while the request for harsher sentences became moot following the decision to acquit the defendants.

The costs of the criminal proceedings will be paid from the budget. Meanwhile, the Ministry of Labor and Social Welfare has been instructed to pursue any potential property-related claims through civil proceedings.

The defense had denied the defendants’ individual responsibility, arguing that applications had been reviewed in the field through the structures and chain of command of the operational zones.

In conclusion, the Court of Appeals assessed that it had not been proven that the defendants had committed the criminal offense with which they were charged.

Gjykata e Apelit e Kosovës ka vendosur të ndryshojë aktgjykimin e shkallës së parë në çështjen e njohur si “Veteranët”, duke i liruar nga akuzat Agim Çekun dhe nëntë ish-pjesëtarë të Komisionit Qeveritar për Verifikimin e Veteranëve. Vendimi konfirmon gjithashtu lirimin e Nuredin Lushtakut dhe Smajl Elezajt.

Kolegji penal i Departamentit Special të Gjykatës së Apelit ka pranuar ankesat e mbrojtjes dhe ka ndryshuar aktgjykimin e Gjykatës Themelore në Prishtinë, të datës 12 shtator 2025. Me atë vendim, dhjetë të akuzuar ishin shpallur fajtorë dhe ishin dënuar me nga një vit burgim.

Vendimi lirues përfshin Agim Çekun, Sadik Halitjahën, Shkumbin Demaliajn, Qelë Gashin, Shukri Bujën, Ahmet Dakun, Rrustem Berishën, Faik Fazliun, Fadil Shurdhajn dhe Xhavit Jasharin.

Sipas Apelit, gjatë procesit nuk është dëshmuar se të akuzuarit kanë kryer, në bashkëkryerje, veprën penale të keqpërdorimit të pozitës apo autoritetit zyrtar.

Po ashtu, gjykata e ka cilësuar të pabazuar ankesën e Prokurorisë Speciale ndaj vendimit për lirimin e Nuredin Lushtakut dhe Smajl Elezajt. Të dy ishin shpallur të pafajshëm që në shkallën e parë.

Me këtë vendim, të gjithë 12 personat e përfshirë në proces janë liruar nga akuzat. Vendimi është raportuar më 11 shtator, ndërsa aktgjykimi i Gjykatës së Apelit mban datën 9 shtator 2026.

Prokuroria Speciale kishte kërkuar që Lushtaku dhe Elezaj të shpalleshin fajtorë, ndërsa për dhjetë të akuzuarit e tjerë kishte kërkuar rritjen e dënimeve.

Apeli nuk e ka pranuar këtë qëndrim. Ankesa e Prokurorisë kundër pjesës liruese është refuzuar, ndërsa kërkesa për dënime më të ashpra ka mbetur pa objekt pas vendimit për lirimin e të akuzuarve.

Shpenzimet e procedurës penale do të paguhen nga buxheti. Ndërkohë, Ministria e Punës dhe Mirëqenies Sociale është udhëzuar që çdo kërkesë eventuale pasurore-juridike ta ndjekë në procedurë civile.

Çështja penale kishte të bënte me njohjen dhe verifikimin e statusit të veteranëve, si dhe të kategorive të tjera të dala nga lufta e Ushtrisë Çlirimtare të Kosovës.

Aktakuza pretendonte se të akuzuarit, në cilësinë e anëtarëve të Komisionit Qeveritar, kishin tejkaluar kompetencat ose kishin dështuar në përmbushjen e detyrave zyrtare. Sipas Prokurorisë, kjo u kishte krijuar personave të tjerë mundësinë të përfitonin në mënyrë të kundërligjshme statusin e veteranit.

Mbrojtja kishte mohuar përgjegjësinë individuale të të akuzuarve, duke argumentuar se shqyrtimi i aplikacioneve ishte kryer në terren përmes strukturave dhe zinxhirit komandues të zonave operative.

Në përfundim, Gjykata e Apelit ka vlerësuar se nuk është provuar se të akuzuarit e kanë kryer veprën penale për të cilën ngarkoheshin.

Shpenzimet e procedurës penale do të paguhen nga mjetet buxhetore. Ministria e Punës dhe Mirëqenies Sociale është udhëzuar që çdo kërkesë eventuale pasurore-juridike ta parashtrojë përmes një kontesti civil.

Për çfarë akuzoheshin?

Procesi kishte të bënte me njohjen dhe verifikimin e statusit të veteranëve, si edhe të kategorive të tjera të dala nga lufta e Ushtrisë Çlirimtare të Kosovës.

Në aktakuzë pretendohej se të akuzuarit, në cilësinë e anëtarëve të Komisionit Qeveritar, kishin tejkaluar autorizimet ose nuk kishin kryer detyrat zyrtare, duke u mundësuar personave të tjerë që të përfitonin në kundërshtim me ligjin statusin e veteranit.

Mbrojtja kishte mohuar përgjegjësinë individuale të të akuzuarve, duke theksuar se kontrolli i aplikacioneve ishte kryer në terren nga strukturat dhe përmes zinxhirit komandues të zonave operative.

Në përfundim, Gjykata e Apelit ka vlerësuar se nuk është provuar kryerja e veprës penale për të cilën akuzoheshin të pandehurit.
