Roberth Bosch, the former Dutch ambassador to Kosovo, has called the Specialist Chambers’ ruling against four former members of the Kosovo Liberation Army, led by former president Hashim Thaçi, scandalous.

In an interview with KosovaPress, he expressed surprise that the prosecutors and the trial panel had not taken into account the circumstances in which the war in Kosovo unfolded, as well as the testimony of international experts who had dealt with the issue more than a quarter of a century ago.

Bosch: The Specialist Chambers are overlooking the fact that the iPhone did not exist during the war in Kosovo

Bosch said the ruling was scandalous and that the judges and prosecutors had not listened to the experts, who had explained that the KLA did not operate according to such a structure. According to him, this had been emphasized by Mr. Clark, Mr. Hill, Mr. Rubin and other genuine experts.

He added that he himself had stressed the same point, but claimed that his position had not been heard, even though he had served at the time as a contact person between the Ministry of Foreign Affairs and the Ministry of Defense.

According to Bosch, it was repeatedly said at the time that the KLA provided the “boots on the ground,” meaning the forces operating in the field, but that communicating with it was very difficult precisely because of the lack of a structure. He asked how Thaçi and Rexhepi could be accused of coordination if such coordination did not exist.

The former diplomat also recalled that the events had taken place 26 years ago, at a time when there were no mobile phones and the iPhone did not exist. According to him, communication had to be conducted via satellite phones, which often did not work. Bosch said that he had used them himself and that, for this reason, it was very difficult to achieve any form of coordination.

The diplomat, who has admitted several times that he regrets having been among those who called for the establishment of the Specialist Chambers, said subsequent developments had shown that the court should cease to exist.

Bosch: This court should never have been established

According to him, the Specialist Chambers should not exist, because the entire process began with Marty’s report, which alleged organ trafficking. Bosch said that if such a claim had been true, it would, of course, have been something terrible.

He explained that the concern generated by the allegations led people to believe Marty’s report and call for a serious investigation, thus paving the way for the entire process. However, according to Bosch, once Judge Williamson conducted the investigation and found that there had been no organ trafficking, only fabricated stories, everything should have stopped.

Bosch emphasized that there was no longer any reason for the process to continue, because the organ-trafficking allegation had been the real reason for establishing the court. For that reason, he said, it should neither have been established nor continued to exist.

Disappointed by the first-instance verdict, Bosch said he did not expect any positive developments at the second instance either. He also expressed surprise over the nationality of those administering justice in the proceedings.

Bosch: The court belongs to Kosovo, is funded by Europeans, while Americans administer justice

Bosch said he did not expect much if the review was again conducted by more or less the same people. He said that, for a reason he did not understand, they all came from the United States, even though this was a Kosovo court funded by Europeans, while the prosecutors and judges were American.

“I do not understand anything. I do not understand how such things can happen. I do not know,” Bosch said.

Nevertheless, in light of the situation created by what he described as draconian sentences, Bosch said there might be a way out through Kosovo’s institutions.

Bosch: Kosovo’s next president could pardon those convicted

He recalled that the judge had begun by declaring that this was a Kosovo court. On that basis, Bosch raised the question of whether the president, as soon as Kosovo has one, could pardon all those convicted, although he acknowledged that his idea might sound absurd.

According to him, in a normal state, the president has the authority to pardon certain individuals. Bosch asked whether, once the LDK and VV finally reach an agreement on electing the president, the latter could pardon those convicted.

He said he was raising this only as a question, but that such a possibility would be logical. According to Bosch, if this is claimed to be a Kosovo court, then it should be under Kosovo’s jurisdiction. He asked who the country’s highest authority was, adding that it was not them, but the president.

“In any case, to end on a positive note, perhaps it is a good idea,” he said.

Until such a possibility materializes, the Dutchman remains convinced that Serbia is the only party benefiting from the process.

Bosch said the ruling was highly detrimental to Kosovo and served only the Serbs, who, according to him, were very happy. He said he continued to find the entire process strange, since even Marty’s report stated that most of the crimes had been committed by Serbs.

In this context, he asked why a special court had not been established against the Serbs. Bosch said Serbia had not convicted its own people, that they continued to be part of the government and that one of the most criminal individuals was at the head of the armed forces, while the others, according to him, were standing by and laughing.

Në një intervistë për KosovaPress, ai u shpreh i habitur që prokurorët dhe trupi gjykues nuk morën në konsideratë rrethanat në të cilat ishte zhvilluar lufta në Kosovë, si dhe dëshmitë e ekspertëve ndërkombëtarë që ishin marrë me këtë çështje më shumë se një çerek shekulli më parë.

Bosch tha se vendimi është skandaloz dhe se gjyqtarët e prokurorët nuk i kanë dëgjuar ekspertët, të cilët kishin shpjeguar se UÇK-ja nuk funksiononte sipas një strukture të tillë. Sipas tij, këtë e kishin nënvizuar zoti Clark, zoti Hill, zoti Rubin dhe ekspertë të tjerë të mirëfilltë.

Ai shtoi se të njëjtën gjë e kishte theksuar edhe vetë, por pretendoi se qëndrimi i tij nuk ishte dëgjuar, ndonëse në atë periudhë kishte shërbyer si person kontakti ndërmjet Ministrisë së Punëve të Jashtme dhe Ministrisë së Mbrojtjes.

Sipas Bosch, në atë kohë thuhej vazhdimisht se UÇK-ja përbënte “çizmet në terren”, pra forcat që vepronin në terren, por komunikimi me të ishte shumë i vështirë pikërisht për shkak të mungesës së një strukture. Ai pyeti se si mund të akuzohen Thaçi dhe Rexhepi për koordinim, nëse një koordinim i tillë nuk ekzistonte.

Ish-diplomati kujtoi gjithashtu se ngjarjet kishin ndodhur 26 vjet më parë, në një periudhë kur nuk kishte telefona portativë dhe iPhone nuk ekzistonte. Komunikimi, sipas tij, duhej të realizohej përmes telefonave satelitorë, të cilët shpesh nuk funksiononin. Bosch tha se edhe ai vetë i kishte përdorur dhe, për këtë arsye, ishte shumë e vështirë të realizohej çfarëdo forme koordinimi.

Diplomati, i cili disa herë ka pranuar se është penduar që kishte qenë në anën e atyre që kërkonin krijimin e Speciales, vlerësoi se zhvillimet e mëvonshme kanë treguar se kjo gjykatë duhet të pushojë së ekzistuari.

Bosch: Kjo gjykatë nuk duhej të krijohej

Sipas tij, Gjykata Speciale nuk duhej të ekzistonte, pasi i gjithë procesi kishte nisur nga raporti i Martyt, në të cilin flitej për trafikim organesh. Bosch tha se, po të kishte qenë i vërtetë një pretendim i tillë, kjo do të ishte natyrisht diçka e tmerrshme.

Ai shpjegoi se shqetësimi i krijuar bëri që raportit të Martyt t’i besohej dhe të kërkohej një hetim serioz, duke i hapur kështu rrugën gjithë procesit. Megjithatë, sipas Bosch, pasi gjyqtari Ëilliamson zhvilloi hetimet dhe rezultoi se nuk kishte trafikim organesh, por vetëm histori të sajuara, gjithçka duhej të ishte ndalur.

Bosch theksoi se nuk kishte më asnjë arsye për vazhdimin e procesit, pasi pretendimi për trafikim organesh kishte qenë shkaku i vërtetë për krijimin e gjykatës. Për këtë arsye, sipas tij, ajo nuk duhej të ishte themeluar dhe as të ekzistonte.

I zhgënjyer nga verdikti i shkallës së parë, Bosch tha se nuk pret ndonjë zhvillim pozitiv as në shkallën e dytë. Ai shprehu gjithashtu habi lidhur me përkatësinë kombëtare të personave që japin drejtësi në këtë proces.

Bosch: Gjykata është e Kosovës, financohet nga evropianët, ndërsa drejtësinë e japin amerikanët

Bosch deklaroi se nuk pret shumë nëse shqyrtimin do ta bëjnë sërish pak a shumë të njëjtët persona. Ai tha se, për një arsye që nuk e kupton, të gjithë vijnë nga Shtetet e Bashkuara, megjithëse bëhet fjalë për një gjykatë të Kosovës që financohet nga evropianët, ndërsa prokurorët dhe gjyqtarët janë amerikanë.

“Nuk kuptoj asgjë. Nuk e kuptoj se si mund të ndodhin gjëra të tilla. Nuk e di”, u shpreh Bosch.

Megjithatë, përballë situatës së krijuar nga ato që ai i cilësoi si dënime drakonike, Bosch tha se mund të ekzistojë një mundësidaljeje përmes institucioneve të Kosovës.

Bosch: Presidenti i ardhshëm i Kosovës mund t’i falë të dënuarit

Ai kujtoi se gjyqtari e kishte nisur duke deklaruar se bëhej fjalë për një gjykatë të Kosovës. Nisur nga kjo, Bosch ngriti pyetjen nëse presidenti, sapo Kosova ta ketë një të tillë, mund t’i falë të gjithë të dënuarit, ndonëse pranoi se ideja e tij mund të tingëllojë e pakuptimtë.

Sipas tij, në një shtet normal presidenti gëzon kompetencën për faljen e personave të caktuar. Bosch pyeti nëse, pasi LDK-ja dhe VV-ja të arrijnë më në fund një marrëveshje për zgjedhjen e presidentit, ky i fundit mund t’i falë të dënuarit.

Ai tha se po e shtronte këtë vetëm si pyetje, por se një mundësi e tillë do të ishte logjike. Sipas Bosch, nëse pretendohet se kjo është një gjykatë e Kosovës, atëherë ajo duhet të jetë nën juridiksionin e Kosovës. Ai pyeti se kush është autoriteti kryesor në vend, duke shtuar se nuk janë ata, por presidenti.

“Gjithsesi, për ta mbyllur me një notë pozitive, ndoshta është një ide e mirë”, deklaroi ai.

Deri në realizimin e një mundësie të tillë, holandezi mbetet i bindur se Serbia është e vetmja palë që përfiton nga ky proces.

Bosch: Serbia po qesh me verdiktin e Speciales

Bosch vlerësoi se vendimi është shumë negativ për Kosovën, ndërsa u shërben vetëm serbëve, të cilët, sipas tij, janë shumë të lumtur. Ai tha se vazhdon ta konsiderojë të çuditshëm të gjithë procesin, pasi edhe në raportin e Martyt thuhej se shumica e krimeve ishin kryer nga serbët.

Në këtë kontekst, ai pyeti se përse nuk është ngritur një gjykatë speciale kundër serbëve. Bosch deklaroi se Serbia nuk i ka dënuar njerëzit e saj, se ata vazhdojnë të jenë pjesë e qeverisë dhe se një prej personave më kriminalë ndodhet në krye të forcave të armatosura, ndërsa të tjerët, sipas tij, qëndrojnë dhe qeshin.
