According to the published decisions, the complaints of two Democratic Party of Kosovo candidates for MP, Qëndrim Kryeziu and Bekim Haxhiu, were rejected. They had requested a full recount of the votes for PDK candidates as part of the recount process.

Likewise, the complaint of the Serb List was not accepted, nor were two complaints from Nova Demokratska Stranka. All of these complaints concerned allegations of irregularities during the voting and counting process.

In the Supreme Court’s reasoning, these complaints were deemed unfounded.

If these decisions are not challenged by the parties in the Supreme Court within the 48-hour deadline, then the Central Election Commission (KQZ) will be cleared to announce the final election result.

Sipas vendimeve të publikuara, janë refuzuar ankesat e dy kandidatëve të Partisë Demokratike të Kosovës për deputetë, Qëndrim Kryeziu dhe Bekim Haxhiu, të cilët kishin kërkuar rinumërim të plotë të votave të kandidatëve të PDK-së në kuadër të procesit të rinumërimit.

According to information made public by the Electoral Complaints and Appeals Panel (PZAP), political entities have submitted a total of five complaints.

Of these, two complaints were filed by the Democratic Party of Kosovo (PDK), one by the Serb List, and two by the New Democratic Party (Nova Demokratska Stranka – NDS).

PDK based its two complaints on claims of missing votes, while the Serb List and the New Democratic Party raised objections over irregularities related to ballot papers.

The CEC spokesperson, Valmir Elezi, also spoke on the matter, saying that the institution does not comment on complaints while they are under review.

“The Central Election Commission does not comment on matters that are in the appeals process. As in every case, within the deadline, the CEC will respond to the request of PZAP, the institution competent to review complaints in the electoral process, clarifying all necessary issues,” Elezi said.

He also announced that the process of certifying the results will take place only after the appeals procedures are concluded and the relevant institutions have issued their decisions.

“Since several complaints have been submitted against the final results announced by the CEC, the CEC will await the decisions of PZAP and the Supreme Court, implement their decisions if they contain obligations for the CEC, and only then will it be able to proceed with certifying the final results of the early elections for the Assembly of Kosovo,” Elezi said.

Among the latest cases is that of parliamentary candidates from the Democratic Party of Kosovo (PDK), Bekim Haxhiu and Qëndrim Kryeziu, who had requested a full recount of the votes from the snap elections of June 7.

This request, however, was rejected by the Electoral Complaints and Appeals Panel (PZAP), which described their complaint as unfounded.

The published decision shows that the panel assessed that the claims presented were not accompanied by sufficient evidence and arguments that would justify launching a new recount on a general scale.

Haxhiu and Kryeziu’s complaint was directed against the Central Election Commission (KQZ), with a request that all votes for PDK parliamentary candidates be reviewed.

Both candidates had expressed doubts about the way the counting had been conducted, requesting additional verification of the results already published.

In its reasoning, PZAP stressed that a request for a recount must be supported by concrete facts and convincing evidence capable of proving irregularities that directly affect the election result. According to the panel, in this case the complaint did not meet that legal standard.

In this situation, the question arises as to whether PDK is using the request for a full recount more as an instrument to cast doubt on the election result than as a claim supported by facts, given that PZAP dismissed the complaint as unfounded, and whether this reflects a lack of confidence within PDK itself in the electoral process and in the results of its own candidates.

Burjani: There must be serious irregularities that could affect the integrity of the electoral process

On this issue, lawyer Blerim Burjani spoke to “Bota sot.”

According to him, dissatisfaction among certain individuals may exist, but strong evidence affecting the integrity of the electoral process is needed in order to request a vote recount.

“Yes, there is dissatisfaction from certain individuals, but in order to proceed to a vote recount, there must be strong reasons and evidence. In such cases, there must be serious irregularities that could affect the integrity of the electoral process,” he said.

Burjani underlines that a recount or a challenge to election results cannot be requested merely on the basis of suspicions or dissatisfaction, but must be supported by evidence and concrete facts, while the final decision is made by PZAP after reviewing all the circumstances and relevant reports.

“To assess whether there are grounds for a recount or for contesting the result, the Electoral Complaints and Appeals Panel (PZAP) decides, based on the investigations it conducts, the reports of the Central Election Commission (KQZ) and, when necessary, in cooperation with law enforcement bodies.

Therefore, in order to request a recount or challenge the election result, serious facts and concrete evidence must be presented. These requests may be submitted by political entities, but also by their parliamentary candidates,” Burjani told “Bota sot.”

Mehmeti: I believe the aim was for the process to be closed as quickly as possible and not prolonged further

In a statement to “Bota sot,” political analyst Faton Mehmeti assesses that PDK may have chosen not to push further the idea of a full recount, out of fear that such a process would reveal changes in the ranking of candidates and deepen internal debates and dissatisfaction.

“If PDK’s request is analyzed, I think the main reason was to avoid further opening the issue of the ballot boxes and the recount process. If a full recount had taken place, considerable changes could have emerged in the candidates’ results, which would have opened new debates within the party,” he said.

The analyst adds that PDK, in all likelihood, sought for the entire electoral process to conclude as quickly as possible in order to avoid further tensions, stressing that this time the disagreements and dissatisfaction are mainly developing within the party itself and among its candidates.

“For this reason, I believe the aim was for the process to be closed as quickly as possible and not prolonged further. I do not think there was any other essential reason. Within PDK there have always been competitions and internal dissatisfaction after elections, but this time it seems the clashes are not coming from rival parties, but from the party’s own candidates and structures.

This shows that internal competition has been strong and that debates over the result are taking place mainly within the political entity itself,” analyst Mehmeti concluded to “Bota sot.”

Burjani: Duhet të ketë parregullsi serioze që mund të ndikojnë në integritetin e procesit zgjedhor

Lidhur me këtë çështje, për “Bota sot” ka folur juristi Blerim Burjani.

Sipas tij, pakënaqësitë e individëve të caktuar mund të ekzistojnë, por për të kërkuar rinumërim votash nevojiten prova të forta që prekin integritetin e procesit zgjedhor.

“Po, ka pakënaqësi nga individë të caktuar, por që të shkohet në rinumërim të votave duhet të ekzistojnë arsye dhe prova të forta. Në raste të tilla, duhet të ketë parregullsi serioze që mund të ndikojnë në integritetin e procesit zgjedhor”, u shpreh ai.

Burjani nënvizon se rinumërimi ose kontestimi i rezultateve zgjedhore nuk mund të kërkohet vetëm mbi bazën e dyshimeve apo pakënaqësive, por duhet të mbështetet në prova dhe fakte konkrete, ndërsa vendimin përfundimtar e merr PZAP pasi shqyrton të gjitha rrethanat dhe raportet përkatëse.

“Për të vlerësuar nëse ka bazë për rinumërim apo kontestim të rezultatit, vendos Paneli Zgjedhor për Ankesa dhe Parashtresa (PZAP), duke u bazuar në hetimet që zhvillon, raportet e Komisionit Qendror të Zgjedhjeve (KQZ) dhe, kur është e nevojshme, në bashkëpunim me organet e rendit.

Prandaj, për të kërkuar rinumërim ose për të kontestuar rezultatin zgjedhor, duhet të paraqiten fakte serioze dhe dëshmi konkrete. Këto kërkesa mund të parashtrohen nga subjektet politike, por edhe nga kandidatët e tyre për deputetë”, foli Burjani për “Bota sot”.

Mehmeti: Besoj se synimi ka qenë që procesi të mbyllet sa më shpejt dhe të mos zgjatet më tej

Në një prononcim për “Bota sot”, analisti politik Faton Mehmeti vlerëson se PDK-ja mund të ketë zgjedhur të mos e shtyjë më tej idenë e rinumërimit të plotë, nga frika se një proces i tillë do të nxirrte ndryshime në renditjen e kandidatëve dhe do të thellonte debatet dhe pakënaqësitë e brendshme.

“Nëse analizohet kërkesa e PDK-së, mendoj se arsyeja kryesore ka qenë shmangia e hapjes së mëtejshme të çështjes së kutive dhe procesit të rinumërimit. Në rast se do të bëhej një rinumërim i plotë, mund të dilnin në pah ndryshime të konsiderueshme në rezultatet e kandidatëve, gjë që do të hapte debate të reja brenda parties”, foli ai.

Analisti shton se PDK-ja, me gjasë, ka synuar që i gjithë procesi zgjedhor të përfundojë sa më shpejt për të shmangur tensione të tjera, duke theksuar se këtë herë mosmarrëveshjet dhe pakënaqësitë po zhvillohen kryesisht brenda vetë partisë dhe ndërmjet kandidatëve të saj.

“Për këtë arsye, besoj se synimi ka qenë që procesi të mbyllet sa më shpejt dhe të mos zgjatet më tej. Nuk mendoj se ka pasur ndonjë arsye tjetër thelbësore. Brenda PDK-së ka pasur gjithmonë gara dhe pakënaqësi të brendshme pas zgjedhjeve, por këtë herë duket se përplasjet nuk po vijnë nga partitë kundërshtare, por nga vetë kandidatët dhe strukturat e partisë.

Kjo tregon se konkurrenca e brendshme ka qenë e fortë dhe se debatet rreth rezultatit po zhvillohen kryesisht brenda vetë subjektit politik”, përfundoi analisti Mehmeti për “Bota sot”.

Këto kërkesa u dorëzuan pas Zgjedhjeve të Parakohshme për Kuvendin e Kosovës, të zhvilluara më 7 qershor 2026. Sipas tyre, fakti që ishte vendosur rinumërim i pjesshëm në disa vendvotime ngjallte dyshime se pasaktësi mund të kishte edhe në pjesën tjetër të procesit të numërimit.

Në vendimet e miratuara në seancën e 22 qershorit, PZAP ka arritur në përfundimin se pretendimet e paraqitura mbeten në nivel hamendësimesh dhe nuk mbështeten me prova konkrete dhe materiale.

Në ankesat e tyre, kandidatët i janë referuar vendimit të Komisionit Qendror të Zgjedhjeve për rinumërimin e 185 vendvotimeve të rregullta, që përbëjnë rreth 7.41 për qind të 2,498 vendvotimeve gjithsej. Ata kanë argumentuar se gabimet e konstatuara në këtë mostër mund të tregonin për parregullsi edhe në vendvotime të tjera.

Bekim Haxhiu, i renditur me numrin 109 në listën e PDK-së, kishte nënvizuar se pas rinumërimit kishte marrë gjashtë vota shtesë, ndërsa diferenca me kandidatin që ndodhej para tij mbetej 102 vota. Qëndrim Kryeziu, i renditur me numrin 103, pretendonte se atij i takonin 589 vota shtesë nga ky proces.

Nga ana e saj, KQZ kishte kërkuar që ankesat të refuzoheshin, duke sqaruar se rinumërimi i 185 vendvotimeve përbënte një mekanizëm ligjor kontrolli dhe jo provë të ekzistencës së parregullsive sistematike. Po sipas KQZ-së, pretendimi i Kryeziut për 589 vota shtesë nuk qëndronte, sepse të dhënat zyrtare tregonin se ai kishte vetëm dy vota më pak pas rinumërimit.

Në arsyetimin e tij, PZAP ka theksuar se përdorimi i një mostre kontrolluese nuk krijon prezumim juridik për pasaktësi të përgjithshme në procesin e numërimit. Paneli ka sqaruar se rinumërimi i plotë mund të urdhërohet vetëm kur ka prova për parregullsi të mëdha dhe sistematike.

“Nuk mund të urdhërohet rinumërimi i plotë vetëm mbi bazën e pretendimeve hipotetike apo dyshimeve abstrakte, por vetëm kur ekzistojnë fakte dhe prova objektive”, thuhet në vendimin e PZAP-së.

Sipas vlerësimit të panelit, ndryshimet e konstatuara në vendvotimet që iu nënshtruan rinumërimit kanë qenë minimale dhe në të dy drejtimet, çka nuk dëshmon për parregullsi të përgjithshme.

Palët mund t’i kundërshtojnë këto vendime në Gjykatën Supreme të Kosovës brenda 48 orëve nga momenti i pranimit të vendimit.
