With seven votes in favor, none against and no abstentions, the Kosovo Prosecutorial Council has approved the opening of a competition for the selection of new state prosecutors.

A total of 209 prosecutor positions have been approved within the prosecutorial system, 34 of which are currently vacant. Ten of these positions will be reserved for candidates from the Serb community as an affirmative action measure.

KPC Deputy Chair Dardan Vuniqi explained that 177 active prosecutors are currently serving as state prosecutors. According to human resources planning, two prosecutors are expected to end their terms due to retirement, bringing the number of vacant positions included in the competition to 34.

Vuniqi said that the Committee on Budget, Finance and Administration of Prosecutor’s Offices, based on official KPC data, had confirmed a total of 209 approved positions. After analyzing staffing needs, the committee determined that 10 positions could be reserved for candidates from the Serb community.

The competition will be published on August 17 and will remain open for 15 days.

The Union of Judges, the National Association of Judges, and the Association of Prosecutors of the Republic of Albania have reacted after the deadline set by the Constitutional Court for amending the law regulating the status of magistrates expired.

The associations state that Parliament did not approve the necessary changes to judges’ and prosecutors’ salaries.

By decision no. 15, dated 17.02.2026, the Constitutional Court accepted the request to annul articles 1 and 2, point 2, of law no. 33/2023, dated 25.05.2023 “On an amendment to law no. 96/2016 ‘On the status of judges and prosecutors in the Republic of Albania’, as amended”. The request was filed by the Union of Judges and later joined by the National Association of Judges.

According to the associations, the Court found that the changes approved by Parliament had violated the financial status of magistrates, as they had resulted in a hidden salary reduction. The same decision also defined the constitutional criteria on which the new salary formula should be drafted, while Parliament was given until 31 July 2026 to adopt the relevant legal amendments.

“With the expiration of the deadline provided, we note that Parliament has not acted to approve the legal changes,” the joint reaction from the magistrates’ organizations states.

The associations emphasize that Parliament’s inaction has not created a legal vacuum, as the Constitutional Court had already predetermined the method of implementation in this situation. For this reason, starting from 1 August 2026, magistrates’ salaries must be calculated according to the formula referring to the salary of the senior public administration official, in line with Constitutional Court decision no. 35/2022.

The same formula must also be applied retroactively for the period from 1 April 2023 to 31 July 2026. The associations have stated they will closely monitor the implementation of decision no. 15, dated 17.02.2026, and have called on the responsible institutions and officials to respect the obligations arising from article 132, point 1, of the Constitution of the Republic of Albania.

The Union of Judges, the National Association of Judges, and the Association of Prosecutors of the Republic of Albania express that they will remain united in this stance and will monitor every step taken to implement the decision. They have also reiterated their readiness to cooperate constructively with the responsible institutions, with the aim of guaranteeing constitutional standards and the status of the magistrate.

In a statement to “Bota sot,” Belgium-based legal expert Skënder Musliu said Kosovo continues to face political pressure, while Serbia, in his assessment, has not abandoned actions aimed at destabilizing the country.

Musliu criticized the European Union, arguing that Brussels pays greater attention to decisions made by Kosovo’s institutions but does not take the same approach to statements and actions coming from Belgrade.

He recalled that, under the agreements reached in 2013 during the EU-mediated Kosovo-Serbia dialogue, Kosovo had undertaken to integrate the Serb community into state institutions. As part of this process, he said, several hundred police officers and local government employees were hired, along with around 130 judges, prosecutors and administrative justice staff in the four northern municipalities.

According to Musliu, the departure of Serbian officials from Kosovo’s institutions was not an isolated action but a coordinated one. He said the issue of vehicle license plates served only as a pretext and was not the sole reason for the decision.

He said the resignations of the mayors of the four Serb-majority municipalities in the north, together with the departure of Serbian police officers, judges and prosecutors, resulted from pressure, blackmail and intimidation by Radoiçiq and the Belgrade regime. According to him, the aim was to destabilize Kosovo, undermine its security and damage its sovereignty.

The legal expert said subsequent requests by some judges and prosecutors to withdraw their resignations could not be handled by bypassing legal procedures. He stressed that judicial bodies must carry out their work independently and without political influence.

Referring to international reactions, Musliu singled out the position of the United States Embassy in Pristina as the most measured. According to him, the US mission was more cautious and constructive, recalling that Kosovo’s Constitution guarantees the representation of the Serb community in institutions and that the Kosovo government will ensure those rights.

By contrast, he described the European Union’s criticism of decisions by Kosovo’s institutions as direct interference in the justice system. Musliu said that through its statements and actions, the EU was interfering in a brutal and irresponsible manner in a system that is independent and separate from the government.

According to him, the European Union has yet to understand the reality in Kosovo and continues to behave as though the country were still under international supervision.

Musliu also criticized Brussels’ policy toward Serbia, saying the EU had not been sufficiently resolute in confronting Belgrade’s actions. He stressed that Serbia has pursued destructive policies against Kosovo for decades and has also displayed hegemonic ambitions toward other countries in the region, while Vuçiq’s regime continues to be praised by the EU as a participant in constructive dialogue.

He also referred to Serbian officials’ positions on Kosovo and Belgrade’s territorial claims. According to Musliu, statements that Kosovo is an inseparable part of Serbia, along with those justifying policies from previous years, demonstrate that Belgrade has still not moved away from destabilizing narratives.

Regarding the demolition of illegal structures in Zubin Potok, near Lake Ujman, Musliu said Kosovo’s institutions acted in accordance with the law. He explained that the buildings had been erected without permits on land belonging to the “Ibër-Lepenc” company, unlawfully occupying property within a protected area, and that the demolition was carried out only after legal procedures had been completed.

In this case as well, according to him, the European Union criticized the Kosovo government and gave credence to Serbia’s arguments.

Musliu’s response also addressed the discovery of a mass grave in Kalludër, Zubin Potok, where the bodies of 23 Albanians who disappeared during the war are suspected to be buried.

He said Serbia continues to deny war crimes to this day, while the European Union has never had the courage to punish Belgrade or impose serious sanctions over its destructive policies. On the contrary, he said, the EU continues to claim that Serbia is committed to constructive dialogue.

Musliu also criticized some media outlets, nongovernmental organizations and political parties in Kosovo, which he said produce narratives that undermine the country’s interests.

He said that, unfortunately, some media outlets and NGOs have aligned themselves with Belgrade’s destructive policies. According to him, such messages create a false image of Kosovo and serve only its opponents.

The legal expert said part of Kosovo’s opposition is also pursuing an approach that weakens the country’s institutions. He said the irresponsible actions and statements of some opposition politicians, media outlets and NGOs create false narratives against Kosovo and influence how the country is perceived internationally, leading international actors to criticize Kosovo’s institutions.

In conclusion, Musliu positively assessed the Kurti government’s policies aimed at extending sovereignty in the north. According to him, the decisions and actions of Kosovo’s institutions have always sought to strengthen sovereignty, establish the rule of law and protect the constitutional order.

“Under these agreements, several hundred police officers and local government employees were hired, along with around 130 judges, prosecutors and administrative employees of the justice system in the four municipalities in northern Kosovo,” Musliu declared.

According to him, the departure of Serbian officials from the institutions was not caused solely by disagreements over vehicle license plates. He considers it an organized action in which the license-plate issue served only as the apparent reason.

“The resignation of the mayors of the four Serbian-majority municipalities in the north, as well as of Serbian police officials, judges and prosecutors, did not come solely because of the license plates. The main cause was the pressure, blackmail and intimidation exerted by Radoičić and the Belgrade regime, with the aim of destabilizing Kosovo, undermining its security and damaging its sovereignty,” he said.

Musliu said that requests by some judges and prosecutors to withdraw their resignations cannot be handled outside the legal framework. He stressed that the justice system must operate independently and must not be influenced by political pressure.

In this context, he described some international reactions as one-sided, while singling out the United States Embassy in Pristina for taking a more measured stance.

“Unlike other international reactions, the US Embassy in Pristina acted more cautiously and constructively. It recalled that Kosovo’s Constitution guarantees representation of the Serbian community in institutions and that the Government of Kosovo will ensure these rights,” Musliu said.

The Belgian-based jurist described the EU’s criticism of decisions by Kosovo’s institutions as interference in the justice system.

“Through its statements and actions, the EU is interfering brutally and irresponsibly in an independent system that is separate from the executive branch. Unfortunately, it still has not understood the reality of Kosovo and continues to act as if the country were under the supervision of the international community,” he declared.

Musliu was also critical of Brussels’ relationship with Serbia. He said that, despite policies he described as destructive and Belgrade’s hegemonic claims toward Kosovo and other countries in the region, the EU continues to portray Vučić’s regime as a constructive party to the dialogue.

“For decades, Serbia has pursued destructive policies toward Kosovo, while also displaying hegemonic claims toward other states in the region. Nevertheless, the EU continues to praise Vučić’s regime as a factor in constructive dialogue,” he emphasized.

According to Musliu, statements by Serbian officials demonstrate that Belgrade has not broken with its old narratives. He cited claims that Kosovo is an inseparable part of Serbia, as well as statements that, in his view, justify the policies of previous years.

“These statements show that Belgrade continues to rely on destabilizing narratives,” Musliu said.

Speaking about the demolition of unauthorized structures in Zubin Potok, near Lake Ujman, he said that Kosovo’s institutions had acted within the law.

“The structures had been erected without construction permits on the property of the ‘Ibër-Lepenc’ enterprise and constituted an unlawful occupation of property in a protected area. The demolition took place only after the legal procedures had been completed. In this case as well, the EU criticized the Government of Kosovo and gave space to Serbia’s arguments,” he declared.

Musliu also commented on the discovery of the mass grave in Kalludër, Zubin Potok, where the bodies of 23 Albanians who disappeared during the war are suspected to be located.

“Serbia continues to deny war crimes. The EU has never had the courage to punish Belgrade and impose serious sanctions on it for its destructive policies. On the contrary, it repeatedly says that Serbia is committed to constructive dialogue,” he said.

He also criticized some media outlets and political entities in Kosovo which, according to him, are creating narratives that harm the country’s interests.

“Unfortunately, some media outlets and NGOs have aligned themselves with the same line as Belgrade’s destructive policies. These narratives create a false image of Kosovo and serve only its opponents,” Musliu declared.

“The irresponsible actions and statements of some opposition politicians, media outlets and NGOs create false narratives against Kosovo. They also influence the perception of international actors, who then direct their criticism at Kosovo’s institutions,” he said.

In conclusion, Musliu said that the Kurti government’s policies aimed at extending sovereignty in the north had been justified. He called for support for Kosovo’s institutions in their efforts to build the rule of law.

“The policies and actions of Kosovo’s institutions have aimed to strengthen sovereignty, build the rule of law and protect the constitutional order. For this reason, the institutions that defend these principles must receive unequivocal support,” Skënder Musliu told “Bota sot” in conclusion.

For several weeks, discussions have been taking place within Kosovo’s justice system and other institutions about the possible return of judges and prosecutors from the Serbian community. Alongside the debate, claims have also mounted that pressure is being exerted on the institutions responsible for the matter.

About 130 Serbian judges and prosecutors submitted their resignations at the end of November 2022, during the organized withdrawal of Serbs from Kosovo’s institutions in the four Serb-majority northern municipalities: North Mitrovica, Leposaviq, Zveçan and Zubin Potok.

The collective withdrawal was initiated by the Serbian List, the largest political party representing Serbs in Kosovo, which has the support of Belgrade. The move came in opposition to the Kosovo Government’s decision to phase out vehicle license plates issued by Serbia and replace them with Kosovo plates.

The issue of the resignations, which had remained unresolved, returned to the spotlight in mid-June. Acting President Albulena Haxhiu asked the Kosovo Judicial Council and the Kosovo Prosecutorial Council to fulfill their legal obligation without delay and submit the names of those who had resigned so that she could dismiss them from office by decree.

On July 21, Haxhiu decreed the dismissal of seven Serbian prosecutors who had resigned at the end of 2022. The decision followed the Kosovo Prosecutorial Council’s rejection of requests by five prosecutors and 15 administrative employees of the Basic Prosecution Office in Mitrovica to withdraw their resignations.

The move was criticized by the European Union. Days earlier, the EU had called on political parties not to exert pressure or interfere in the Kosovo Judicial Council’s decision-making after several representatives of the ruling Vetëvendosje Movement demanded that the council rule against reinstating the Serbian judges.

Haxhiu, for her part, said that the pressure on the Judicial Council and the Prosecutorial Council was coming from Kosovo’s international partners. On Friday, she called on the Kosovo Judicial Council not to be influenced by anyone, whether domestic or international actors.

Regarding the return of Serbian judges and prosecutors, caretaker Prime Minister Albin Kurti recently met with Peter Sorensen, the European Union’s special envoy for the dialogue and normalization of relations between Kosovo and Serbia.

Kurti conveyed to Sorensen the same position he had presented at a government meeting: a solution must be found on the basis of Kosovo’s Constitution and legislation.

According to Kurti, Kosovo’s authorities had called on Serbs not to leave the institutions, not to resign and not to abandon their jobs. However, he stressed that it had never been said, nor does any right exist, that they should now be asked to return.

The caretaker prime minister reiterated this position today, recalling the collective resignation of Serbian police officers in the north. He said the Kosovo Police suffered a severe blow on November 5, 2022, when about 550 Serbian officers collectively left their posts north of the Ibar River, acting, according to him, on orders from Belgrade.

Kurti said the aim of the move had failed because the multiethnic composition of the Kosovo Police had not collapsed, while state sovereignty, territorial integrity and institutional stability had not been undermined. He added that the Republic of Kosovo is safer than ever before.

The government’s position also received support from the Alliance’s Secretary General, Avni Arifi.

Meanwhile, lawyer Ardian Bajraktari told KosovaPress that the Kosovo Prosecutorial Council’s decision not to accept the request to withdraw the resignations is based on the legislation in force and the Constitutional Court’s interpretations.

Bajraktari urged the institutions to exercise caution when coordinating with international partners, particularly in relations with the United States of America.

Regarding the possibility of the former prosecutors returning to their previous positions, he explained that they may apply again if vacancies are announced and if they meet the conditions set by law.

According to him, the Council has already made a decision within the prosecutorial system and, in accordance with Article 26 of the law, sent its proposal to the President, who dismissed them from office by decree, as has been publicly announced. If the former prosecutors believe their rights have been violated, they may turn to the regular courts to seek judicial protection.

He also clarified that the former prosecutors are not denied the right to apply again if a vacancy is announced. If they meet the criteria and successfully complete the recruitment process, they may once again take up the position of prosecutor.

Addressing the potential impact of their return on the justice system, Bajraktari said that community representation is a guaranteed right. However, according to him, the return of these individuals could have consequences for public trust.

The Performance Evaluation Commission held its latest meeting today, chaired by Elza Bajrami-Kastrati, with members Aleksandër Lumezi and Nazan Shero also in attendance.

As part of the performance evaluation procedure, the Commission began reviewing the criminal cases handled by Group IV prosecutors for 2026.

The discussions focused on ensuring that the case analysis proceeds smoothly and that the established standards and criteria are observed, with the aim of assessing prosecutors’ work objectively, professionally and impartially.

The Commission will continue to carry out its activities in accordance with its legal powers and work plan to ensure a proper, transparent process based on the established performance evaluation criteria.
