The deadline for constituting Kosovo’s Assembly expires tonight. However, even the third attempt failed to produce a political agreement between LVV leader Albin Kurti and LDK leader Lumir Abdixhiku.

After the meeting, Kurti, who is also acting prime minister, said that a democratic balance must be established and that the will of the citizens expressed in the June 7 elections must be taken into account.

According to him, the main obstacle to reaching an agreement so far has been the significant gap between each party’s result and its specific ambitions. Despite this, he said that hope must not be lost and that the parties should remain optimistic about the possibility of reaching an agreement.

Speaking about the issue of the president, Kurti recalled that Osmani had been elected to the post after the race was structured in such a way that the first-place finisher would become prime minister and the second would become president.

This time, according to the LVV leader, a consensus figure—not a party candidate—is needed for the post of president. He said he knew a number of people with the values and principles required to carry out the task, but did not want to mention specific names so that it would not later be said that the candidacy had been proposed by Albin Kurti.

Kurti also stressed that he was doing everything possible to find a way out of the situation that had arisen.

On the other hand, after the meeting, Lumir Abdixhiku announced that the LDK wanted the right to nominate the president if a coalition with LVV was formed.

He described the December offer, under which the LDK would receive only the post of deputy prime minister and several ministries, as insufficient and undignified.

Abdixhiku said that his party could neither accept nor consider such an offer. According to him, if the LDK’s involvement was being sought, it should have representation. He acknowledged that the post of prime minister did not belong to the LDK and that, under the Constitution, the premiership belonged to LVV, while the only possibility for representation was a proposal for the presidency—but not a blank-check proposal, since the president should belong to all of Kosovo.

It remains to be seen whether the session on constituting the Assembly will be held tonight. So far, Prime Minister Albin Kurti has met only with representatives of the Democratic League of Kosovo. The Democratic Party of Kosovo has declared that it will remain in opposition, while the Alliance for the Future of Kosovo has set conditions and refused any meeting with Kurti.

Political analyst Lirim Gashi spoke to “Bota sot” about the positions of the PDK and AAK. He believes that the two parties have the right to disagree with LVV programmatically, but stresses that democracy is not limited to electoral competition alone.

According to Gashi, a clear distinction must be made between the opposition’s right not to join a coalition with LVV and its political responsibility to communicate when the functioning of the state is at risk. As he said, the PDK and AAK may have programmatic disagreements, may not want to enter a coalition government, and may set the conditions under which they would or would not support a particular solution, since this is normal in a democracy.

However, the analyst stressed that democracy also entails the ability to reach a compromise when the institutional interest requires it. He pointed out that Kosovo was not facing an ordinary party dispute, but an institutional blockade, the need to establish functioning institutions, and the election of a president.

For this reason, Gashi does not consider refusing dialogue to be a good political solution, regardless of which side it comes from. According to him, the most responsible course would be for all the parties to sit down at a common table without predetermining the outcome of the discussions.

He explained that taking part in talks does not mean accepting the opponent’s program, but recognizing that the state stands above party interests. In fact, he said, such a meeting would also serve the opposition, which could clearly state which issues it did not accept and on which matters it was willing to negotiate.

Gashi explained that when one side refuses to talk simply because it disagrees with the other, the situation remains at the level of political conflict. By contrast, when the parties communicate despite their differences in order to find a solution in the state’s interest, this constitutes institutional democracy.

However, he stressed that responsibility could not be placed solely on the PDK and AAK. LVV, he said, must also demonstrate a willingness for a genuine compromise and not hold consultations merely to prove to the public who was to blame. A serious agreement requires each side to give something up.

Gashi’s position is that the opposition does not have to join the government if it does not want to, but it should agree to sit at the negotiating table when the aim is to unblock the institutions. He directed the same request at LVV: not to seek only the opposition’s votes, but also to offer the compromise that would make such support possible.

Asked whether new elections, triggered by the failure to form institutions and the lack of consensus on a president, would significantly change the results or leave the balance between the political forces almost unchanged, Gashi said that a new electoral process could produce shifts.

He avoided making a categorical prediction, arguing that elections are not a poll that is mechanically repeated. According to him, changes are possible, particularly when citizens vote after a prolonged period of institutional crisis.

Referring to the results of the June 7 elections, Gashi said that he currently saw no strong reason to believe that holding new elections alone would enable either side to spectacularly overturn the existing political balance. LVV came convincingly first with 53 seats, the PDK won 22, the LDK 18, and the AAK 7.

Despite these figures, he underlined that a new result would not necessarily be identical. The next elections would take place in a completely different climate, as citizens had already seen the consequences of the parties’ inability to build a compromise.

According to Gashi, the question for each party would not be only how many votes it could win, but also what it would do with those votes. If, after a new electoral process, citizens once again faced the same deadlock, they could punish not only the losing parties but also the way in which political entities had used the mandate entrusted to them.

For this reason, the analyst expects more shifts in votes within the existing political landscape than an inevitable overturning of the entire political system.

Gashi said that some parties could gain a few percentage points while others could lose them, and that the electorate could become mobilized or demobilized. However, without a major political development, a radical change would remain much more difficult to predict.

He also drew attention to a paradox: if opposition parties believe that new elections would significantly improve their position, they must also consider the possibility that they could further strengthen LVV. At the same time, if LVV believes it can secure an absolute majority without difficulty, there is no guarantee that this will happen.

For Gashi, new elections represent a gamble for all parties. According to him, the main risk is not only linked to the number of seats each entity might win, but to whether Kosovo will emerge from the elections with functioning institutions or once again enter a new cycle of blockades.

For this reason, he would prefer the parties to exhaust every opportunity for an agreement before taking the country back to elections. Gashi concluded that elections are a democratic tool for resolving political disputes, but they should not be used as a way to avoid compromise. In the end, as he stressed, citizens do not vote only to determine the winner, but also so that someone will take responsibility for governing the country.

Afati përfundimtar për konstituimin e Kuvendit të Kosovës skadon sonte. Megjithatë, as përpjekja e tretë nuk solli një marrëveshje politike ndërmjet kryetarit të LVV-së, Albin Kurti, dhe kreut të LDK-së, Lumir Abdixhiku.

Pas takimit, Kurti, i cili është edhe kryeministër në detyrë, deklaroi se duhet të vendoset një ekuilibër demokratik dhe të merret parasysh vullneti i qytetarëve i shprehur në zgjedhjet e 7 qershorit.

Sipas tij, pengesa kryesore për arritjen e marrëveshjes deri tani është dallimi i madh ndërmjet rezultatit të secilës palë dhe ambicieve të saj konkrete. Pavarësisht kësaj, ai tha se shpresa nuk duhet humbur dhe se palët duhet të mbeten optimiste për mundësinë e një dakordimi.

Duke folur për çështjen e presidentit, Kurti kujtoi se Osmani ishte zgjedhur në këtë post pasi gara ishte ndërtuar në atë mënyrë që i pari të bëhej kryeministër, ndërsa i dyti president.

Këtë herë, sipas kreut të LVV-së, nevojitet një figurë konsensuale për postin e presidentit dhe jo një kandidat partiak. Nga ana tjetër, pas përfundimit të takimit, Lumir Abdixhiku bëri të ditur se LDK-ja kërkon të ketë të drejtën e propozimit të presidentit nëse krijohet një koalicion me LVV-në.

Ai e cilësoi të pamjaftueshme dhe jo dinjitoze ofertën e dhjetorit, sipas së cilës LDK-ja do të merrte vetëm postin e zëvendëskryeministrit dhe disa ministri.

Abdixhiku tha se partia e tij nuk mund ta pranojë apo ta trajtojë një ofertë të tillë. Sipas tij, nëse kërkohet përfshirja e LDK-së, atëherë ajo duhet të ketë përfaqësim. Ai pranoi se posti i kryeministrit nuk i takon LDK-së dhe se, sipas Kushtetutës, kryetari i takon LVV-së, ndërsa mundësia e vetme për përfaqësim mbetet një propozim për presidentin, por jo një propozim blanko, pasi presidenti duhet t’i përkasë gjithë Kosovës.

Ende pritet të shihet nëse seanca për konstituimin e Kuvendit do të mbahet sonte. Deri tani, kryeministri Albin Kurti është takuar vetëm me përfaqësuesit e Lidhjes Demokratike të Kosovës. Partia Demokratike e Kosovës ka deklaruar se do të qëndrojë në opozitë, kurse Aleanca për Ardhmërinë e Kosovës ka vendosur kushte dhe ka refuzuar çdo takim me Kurtin.

Për qëndrimet e PDK-së dhe AAK-së ka folur për “Bota sot” analisti politik Lirim Gashi. Ai vlerëson se këto dy parti kanë të drejtë të mos pajtohen në aspektin programor me LVV-në, por nënvizon se demokracia nuk kufizohet vetëm te gara zgjedhore.

Sipas Gashit, duhet bërë një ndarje e qartë ndërmjet së drejtës së opozitës për të mos u bërë pjesë e një koalicioni me LVV-në dhe përgjegjësisë politike për të komunikuar kur rrezikohet funksionimi i shtetit. PDK-ja dhe AAK-ja, siç tha ai, mund të kenë mospajtime programore, të mos e dëshirojnë bashkëqeverisjen dhe të përcaktojnë kushtet në të cilat do ta përkrahnin ose jo një zgjidhje të caktuar, pasi kjo është normale në demokraci.

Megjithatë, analisti theksoi se demokracia nënkupton edhe aftësinë për të arritur kompromis kur një gjë të tillë e kërkon interesi institucional. Ai vuri në dukje se Kosova nuk ndodhet përballë një mosmarrëveshjeje të zakonshme partiake, por përballë një bllokade institucionale, nevojës për ngritjen e institucioneve funksionale dhe zgjedhjen e presidentit.

Për këtë arsye, Gashi nuk e konsideron refuzimin e dialogut si zgjidhje të mirë politike, pavarësisht se nga cila palë vjen. Sipas tij, sjellja më e përgjegjshme do të ishte që të gjitha partitë të uleshin në një tryezë të përbashkët, pa e paracaktuar përfundimin e diskutimeve.

Ai sqaroi se pjesëmarrja në bisedime nuk nënkupton pranimin e programit të kundërshtarit, por njohjen e faktit se shteti qëndron mbi interesin partiak. Madje, sipas tij, një takim i tillë do t’i shërbente edhe opozitës, e cila mund të shprehte qartë se cilat çështje nuk i pranon dhe për cilat është e gatshme të negociojë.

Gashi shpjegoi se kur njëra palë refuzon të flasë vetëm sepse nuk pajtohet me tjetrën, situata mbetet në nivelin e konfliktit politik. Në të kundërt, kur palët komunikojnë pavarësisht dallimeve për të gjetur një zgjidhje në interes të shtetit, atëherë bëhet fjalë për demokraci institucionale.

Megjithatë, ai theksoi se përgjegjësia nuk mund t’u ngarkohet vetëm PDK-së dhe AAK-së. Edhe LVV-ja, sipas tij, duhet të tregojë gatishmëri për kompromis të vërtetë dhe jo të zhvillojë konsultime vetëm për të dëshmuar para publikut se kujt i takon faji. Një marrëveshje serioze kërkon që secila palë të heqë dorë nga diçka.

Qëndrimi i Gashit është se opozita nuk ka pse të hyjë në qeveri nëse nuk dëshiron, por duhet të pranojë të ulet në tryezën e bisedimeve kur synohet zhbllokimi i institucioneve. Të njëjtën kërkesë ai e drejtoi edhe ndaj LVV-së: të mos kërkojë vetëm votat e opozitës, por të ofrojë edhe kompromisin që do ta bënte të mundur atë mbështetje.

I pyetur nëse zgjedhjet e reja, të shkaktuara nga mosformimi i institucioneve dhe mungesa e konsensusit për presidentin, do t’i ndryshonin dukshëm rezultatet apo do t’i ruanin pothuajse të pandryshuara raportet ndërmjet forcave politike, Gashi tha se një proces i ri zgjedhor mund të prodhojë lëvizje.

Ai shmangu një parashikim kategorik, duke argumentuar se zgjedhjet nuk janë një sondazh që përsëritet në mënyrë mekanike. Sipas tij, ndryshimet janë të mundshme, veçanërisht kur qytetarët votojnë pas një periudhe të gjatë krize institucionale.

Duke iu referuar rezultatit të zgjedhjeve të 7 qershorit, Gashi tha se aktualisht nuk sheh ndonjë arsye të fuqishme për të besuar se vetëm mbajtja e zgjedhjeve të reja do t’i mundësonte njërës palë ta përmbyste në mënyrë spektakolare raportin ekzistues politik. LVV-ja doli bindshëm e para me 53 mandate, PDK-ja fitoi 22, LDK-ja 18 dhe AAK-ja 7.

Pavarësisht këtyre shifrave, ai nënvizoi se një rezultat i ri nuk do të ishte domosdoshmërisht identik. Zgjedhjet e ardhshme do të zhvilloheshin në një klimë krejt tjetër, pasi qytetarët tashmë kanë parë pasojat e paaftësisë së partive për të ndërtuar kompromis.

Sipas Gashit, pyetja për secilën parti nuk do të ishte vetëm sa vota mund të fitojë, por edhe çfarë do të bëjë me ato vota. Nëse pas një procesi të ri zgjedhor qytetarët përballen sërish me të njëjtin ngërç, ata mund të ndëshkojnë jo vetëm partitë humbëse, por edhe mënyrën se si subjektet politike e kanë përdorur mandatin e marrë prej tyre.

Për këtë arsye, analisti pret më shumë zhvendosje të votave brenda skenës ekzistuese sesa një përmbysje të pashmangshme të gjithë sistemit politik.

Gashi tha se disa parti mund të fitojnë disa pikë, të tjera mund të humbin, ndërsa elektorati mund të mobilizohet ose demobilizohet. Megjithatë, pa një zhvillim të madh politik, një ndryshim rrënjësor mbetet shumë më i vështirë për t’u parashikuar.

Ai tërhoqi vëmendjen edhe te një paradoks: nëse partitë opozitare mendojnë se zgjedhjet e reja do t’ua përmirësonin ndjeshëm pozitën, duhet të llogarisin edhe mundësinë që ato ta fuqizojnë më tej LVV-në. Në të njëjtën kohë, nëse LVV-ja beson se mund ta sigurojë pa vështirësi shumicën absolute, nuk ekziston asnjë garanci se kjo do të ndodhë.

Për Gashin, zgjedhjet e reja përbëjnë një bast për të gjitha partitë. Sipas tij, rreziku kryesor nuk lidhet vetëm me numrin e mandateve që mund të fitojë secili subjekt, por me pyetjen nëse Kosova do të dalë nga zgjedhjet me institucione funksionale apo do të futet sërish në një cikël të ri bllokadash.

Për këtë arsye, ai do të preferonte që partitë të shfrytëzonin deri në fund çdo mundësi për marrëveshje përpara se ta çonin vendin përsëri në zgjedhje. Gashi përfundoi se zgjedhjet janë mjet demokratik për zgjidhjen e mosmarrëveshjeve politike, por nuk duhet të përdoren si mënyrë për t’iu shmangur kompromisit. Në fund, siç theksoi ai, qytetari nuk voton vetëm për të përcaktuar fituesin, por edhe që dikush të marrë përgjegjësinë për qeverisjen e vendit.

PDK MP Arian Tahiri has expressed regret over today’s developments in the Assembly of Kosovo, accusing the Vetëvendosje Movement of abusing the parliamentary institution.

“It is painful to see how the most important institution is being misused. The scenarios may change, but the objective remains the same: undermining and violating the constitutional order. We know that LVV and Kurti have the necessary votes to elect the Speaker of the Assembly. Citizens voted for the institutions to become operational. What is happening in the Assembly shows a complete lack of responsibility and, at the same time, constitutes irresponsibility toward the lives of citizens,” he declared.

The constitutive session of the Assembly of Kosovo has once again been suspended.

The suspension came after VV leader Albin Kurti requested more time to nominate a candidate for Speaker of the Assembly. Kurti explained that the request was related to the lack of a political agreement.

“My communication and meetings, in my capacity as acting prime minister and leader of the winning political entity, the Vetëvendosje Movement, with the leaders of the other parliamentary parties have continued. We have still not reached a political agreement, so I ask you for additional time to avoid new elections,” Kurti said.

Following his request, Alliance MP Time Kadrijaj threw an egg at VV leader Albin Kurti. Because of the incident, presiding officer Dehari asked Assembly security to enter the hall.

Ne e dimë se LVV-ja dhe Kurti i kanë votat e nevojshme për ta zgjedhur kryetarin e Kuvendit. Qytetarët kanë votuar që institucionet të funksionalizohen. Ajo që po ndodh në Kuvend tregon mungesë të plotë përgjegjësie dhe, në të njëjtën kohë, është papërgjegjësi ndaj jetës së qytetarëve”, ka deklaruar ai.

Seanca konstituive e Kuvendit të Kosovës është ndërprerë sërish.

Ndërprerja erdhi pasi kryetari i VV-së, Albin Kurti, kërkoi më shumë kohë për të propozuar kandidatin për kryetar të Kuvendit. Kurti sqaroi se kërkesa lidhet me mungesën e një marrëveshjeje politike.

The Democratic Party of Kosovo has strongly opposed the announcement that the Assembly’s constitutive session will continue on Friday, stressing that the move ignores a binding ruling by the Constitutional Court.

According to an official statement, PDK noted that the court had ordered parliament to be constituted within 30 days of the certification of the election results, a deadline that, according to the party’s interpretation, expires on Thursday evening.

“Instead of fulfilling this obligation, the parliamentary majority decided to circumvent it through the oldest MP presiding over the solemn session, scheduling its continuation for the following day, after the legal deadline had expired,” the statement said.

The party described the move as a dangerous precedent for the rule of law and a serious violation of the Constitutional Court’s judgment. “No individual or group may place their will above the Constitution, especially those whose primary duty is to uphold and implement it,” PDK stressed.

In its response, the political party directly accused acting Prime Minister Albin Kurti of placing party interests above those of the state and manipulating deadlines for political gain. PDK said that a political entity entrusted by citizens with establishing the new institutions is now obstructing the process through narrow calculations, generating instability and constitutional uncertainty in the country.

Describing the Constitution as the pillar of the democratic and legal order, rather than merely a matter for political debate, PDK warned that it would not remain indifferent to this approach. “Just as we have acted in every other case when the constitutional order was threatened, we will not stand idly by now either. “Shumica parlamentare, në vend që të përmbushte këtë detyrim, vendosi ta anashkalojë atë përmes deputetit më të vjetër që drejton seancën solemne, duke caktuar vazhdimin për ditën e nesërme, pra pas përfundimit të afatit ligjor,” thuhet në komunikatë.

Partia e ka cilësuar këtë lëvizje si një precedent të rrezikshëm për shtetin e së drejtës dhe një cenim të rëndë të Aktgjykimit kushtetues. “Asnjë individ apo grup nuk mund të ngrejë vullnetin e vet mbi Kushtetutën, sidomos ata që kanë për detyrë parësore ta ruajnë dhe zbatojnë atë,” theksoi PDK.

Në reagimin e saj, forca politike akuzoi drejtpërdrejtë kryeministrin në detyrë, Albin Kurti, se ka vendosur interesat partiake mbi ato shtetërore, duke manipuluar afatet për përfitime politike. PDK vlerëson se një subjekt që ka marrë mandatin e qytetarëve për të ngritur institucionet e reja, tani po e bllokon procesin me përllogaritje të ngushta, duke gjeneruar destabilitet dhe pasiguri kushtetuese në vend.

Duke e konsideruar Kushtetutën si shtyllën e rendit demokratik e juridik dhe jo thjesht një çështje për debat politik, PDK paralajmëroi se nuk do të mbetet indiferente përballë kësaj qasjeje. “Ashtu siç kemi vepruar në çdo rast tjetër kur është kërcënuar rendi kushtetues, edhe tani nuk do të rrimë duarkryq. Mbrojtja e ligjit dhe e shtetit është detyrimi ynë ndaj qytetarëve dhe Republikës,” theksohet në deklaratë.

Në përmbyllje, PDK nënvizoi se Kosova ka nevojë urgjente për institucione të qëndrueshme dhe respekt të plotë të ligjit. “Një demokraci e shëndoshë nuk ekziston atje ku dëshira e një partie mbizotëron mbi normën themelore të shtetit. Fatkeqësisht, Albin Kurti zgjodhi sërish këtë rrugë,” përfundon reagimi.
